PARTIES This Amendment (the “Amendment”) to the Original Contract shown on the Signature and Cover Page for this Amendment (the “Contract”) is entered into by and between the Contractor, and the State. 2. TERMINOLOGY Except as specifically modified by this Amendment, all terms used in this Amendment that are defined in the Contract shall be construed and interpreted in accordance with the Contract. 3. AMENDMENT EFFECTIVE DATE AND TERM A. Amendment Effective Date This Amendment shall not be valid or enforceable until the Amendment Effective Date shown under the State Controller Signature. PURPOSE The Parties entered into the agreement to make changes to policies that address current and long- standing injustices around housing by authentically engaging the community around healthy and affordable housing barries. The Parties now desire to increase funding and change Statement of Work for the following reason: Adding additional activies. 5. MODIFICATIONS The Contract and all prior amendments thereto, if any, are modified as follows: A. The Contract Maximum Amount table is deleted and replaced with the Current Contract Maximum Amount table shown on the Signature and Cover Page for this Amendment. B. The Parties now agree to modify Exhibit B, statement of work, of the agreement. Exhibit B, Statement of work, is deleted and replaced in its entirety with Exhibit, Statement of Work, attached to this Amendment for the following reason: add activities due to additional funding availability. C. The Parties now agree to modify Exhibit C, Budget, of the agreement. Exhibit C, Budget, is deleted and replaced in its entirety with Exhibit C, Budget, attached to this Amendment for the following reason: Increase in additional funding. 6. I. Entity Name: Eagle County Public Health and Environment II. Project Description: This health project serves to decrease risks of cardiovascular disease, chronic pulmonary disease, and cancer among underrepresented populations, by focusing on housing as an upstream determinant of population health. ECPHE will support community power building efforts in Eagle County to inform policy development and positively impact the physical, mental, social, fiscal and emotional health of Eagle County residents. Healthy Housing Eagle County will make policy, systems, and environmental changes to our land use code, comprehensive plans, affordable housing guidelines and mobile home park ordinances to address lo ng-standing injustices in our community related to inequities in housing and support stable, safe, and quality homes and neighborhoods. Our team will develop policies and systems to establish affordable new development, avoid future displacement, protect the stability and quality of existing homes, as well as the health of neighborhoods. Authentic community voice and empowerment will underpin the work of Healthy Housing Eagle County. Combined, this work will allow for instances of displacement to decrease, opportunities for stable, quality, attainable and connected housing will increase and policies that address current and long -standing injustices around housing will be implemented. In turn, this prevents cardiovascular disease, chronic pulmonary disease, a nd cancer by reducing chronic stress experienced by housing instability, reducing environmental toxins by improving the safety and quality of homes, and improving neighborhoods by offering active transportation opportunities and healthy food options. Underrepresented and disadvantaged Eagle County residents will benefit from this work beginning at the start of this grant in 2019 and see sustaining benefit for years to come. III. Definitions: 1. Affordable Housing Policy: policy that ensures that Eagle County residents do not pay more than 30% of their average monthly income on housing 2. CDPHE: Colorado Department of Public Health and Environment 3. Charlas (Spanish for “chat”): Discussions hosted for community members in person and virtually to discuss topics most important to them, similar to community meetings, but without a strict agenda 4. ECCOMDEV: Eagle County Community Development Department 5. ECHD: Eagle County Housing Department 6. ECPHE: Eagle County Public Health and Environment 7. HDGP: Health Disparities Grant Program 8. HDGP Affinity Group: a peer learning and networking opportunity that will occur quarterly by phone or video conferencing in which the agendas are driven by grantees to share best practices and challenges, discuss topics of their choosing and the opportunity to bring in external expertise 9. Land Use Policy: policy regulating the use of land in an effort to promote more social an d environmental outcomes as well as a more efficient use of resources 10. Public Health Element: A chapter or section of a comprehensive plan that serves as a single, comprehensive reference point for health-related goals, policies, and values; they often show the connection between health and the built environment 11. Quarters: Q1 – Quarter 1: executed date-September 30 Q2 – Quarter 2: October 1-December 31 Q3 – Quarter 3: January 1-March 31 Q4 – Quarter 4: April 1-June 30 12. Work Plan: Goal #1: To build partnerships to mobilize community power and transform systems to advance health equity and environmental justice. Objective #1: No later than the expiration date of this contract, make changes to policies that address current and long-standing injustices around housing by authentically engaging the community around healthy and affordable housing barriers and work together to build solutions. Primary Activity #1 The Contractor shall provide technical assistance to Eagle County Government departments to incorporate housing affordability in their policies. Sub-Activities #1 1. The Contractor shall attend meetings with leaders across Eagle County Government Departments a minimum of two (2) times to identify key challenges and opportunities around affordable housing policy. 2. The Contractor shall develop language detailing the connection between affordable housing and health to provide to ECHD to use when updating Eagle County’s Affordable Housing Guidelines. 3. The Contractor shall provide recommended language detailing the connection between affordable housing and health to ECCOMDEV in updating Eagle County’s Comprehensive Plan. 4. The Contractor shall develop a plan to create a utility transparency program in mobile home communities by researching existing programs. Primary Activity #2 The Contractor shall build support for the stability of existing housing stock in Eagle County by engaging with county departments. Sub-Activities #2 1. The Contractor shall develop a plan to create a landlord-tenant and tenant-tenant Eagle County mediation program by using best practices from the field. 2. The Contractor shall attend meetings with the County Attorney office and stakeholders a minimum of two (2) times to discuss policy recommendations to move toward enacting policies that support stable housing in Eagle County. Primary Activity #3 The Contractor shall build support systems for the safety and quality of homes in Eagle County by engaging with county departments. Sub-Activities #3 1. The Contractor shall observe Eagle County’s code compliance efforts and understand Eagle County’s code compliance protocols. 2. The Contractor shall create a health and safety checklist for mobile homes built prior to 1976. The checklist is to be completed by the Eagle County Assessor’s Office prior to the sale of these homes. Primary Activity #4 The Contractor shall provide technical assistance to Eagle County Government Departments to support the connectedness of communities in Eagle County. Sub-Activities #4 1. The Contractor shall create a public health element for the Eagle County Comprehensive Plan and Eagle County Affordable Housing Guidelines to recommend incorporation to the Eagle County Land Use Regulations. 2. The Contractor shall catalog mobile home parks and associated community resources through the use of GIS mapping. Primary Activity #5 The Contractor shall validate community voice and power in Eagle County. Sub-Activities #5 1. The Contractor shall facilitate a minimum of three (3) community charlas on the connection between health and place for community members in Eagle County culminating in a charla that allows for community discussions with elected officials. 2. The Contractor shall provide a minimum of two (2) opportunities for skill development for community leaders on civic engagement, guidance on speaking with elected officials and mediating disputes with neighbors. 3. The Contractor shall update a Facebook page titled Mi Salud Mi Charco, to serve as a resource and grassroots platform for community organizing in Eagle County. The Contractor shall develop a Mobile Home Owners Handbook to be distributed to mobile home residents in Eagle County by community leaders. 5. The Contractor shall develop policies and procedures for Eagle County Government Offices to increase meaningful participation of Eagle County residents during public meetings and public comment opportunities. Standards and Requirements 1. The Contractor shall monitor documents and website content for updates and comply with all updates as the content of electronic documents located on CDPHE and non- CDPHE website and information contained on CDPHE and non -CDPHE website may be updated periodically during the contract term. 2. The Contractor shall develop quarterly progress reports on the template provided by CDPHE and follow the Quarterly Reporting Guidance. The Contractor shall develop a Final Evaluation Report and follow the Final Evaluation Reporting Responsibility. The Contractor shall align efforts as required by the HDGP evaluation contractor and CDPHE to include: using specific tools, resources, templates and guidelines; a. Providing baseline data, metrics, measures and progress reporting via a reporting tool provided by the HDGP evaluation contractor; b. adhering to established timelines and schedules; c. participating in evaluation reporting and other data submissions; d. participating in evaluation-related trainings and technical assistance; e. providing access to program information and data as needed by the HDGP evaluation contractor; f. and other evaluation monitoring and data submissions as determined by the evaluation contractor and HDGP. 5. The Contractor shall align efforts with the HDGP training and technical assistance contractor and CDPHE to include: leveraging opportunities; sharing information about learning opportunities; identifying training topics and populating training calendars; and participating in the HDGP peer learning opportunities, affinity groups and other training and technical assistance activities. 6. The Contractor shall participate in conference calls with CDPHE staff as needed, including a minimum of one (1) per quarter. 7. The Contractor shall participate in HDGP Affinity Group meetings, including a minimum of one (1) per quarter. 8. The Contractor shall adhere with the National CLAS Standards. This standard is incorporated, made part of this contract by reference and is available on the following website: https://www.thinkculturalhealth.hhs.gov/clas/standards. 9. The Contractor shall provide CDPHE, upon request, written procedures related to gift card purchase and handling. At a minimum, the procedures must include the following: a. How the gift card inventory is tracked and maintained; b. Gift Card storage and safeguards against theft; c. The primary person responsible for securing and distributing gift cards; d. A gift card distribution log that records each gift card number, dollar amount and the printed name and signature of each gift card recipient. Monitoring: CDPHE’s monitoring of this contract for compliance with performance requirements will be conducted throughout the contract period by the Health Disparities Grant Program Manager and Fiscal Officer. Methods used will include a review of documentation determined by CDPHE to be reflect ive of performance to include fiscal and programmatic documentation as applicable. The Contractor’s performance will be evaluated at set intervals and communicated to the Contractor. A Final Contractor Performance Evaluation will be conducted at the end of the life of the contract. VI. Resolution of Non-Compliance: The Contractor will be notified in writing within ten (10) calendar days of discovery of a compliance issue. Within thirty (30) calendar days of discovery, the Contractor and the State will collaborate, when appropriate, to determine the action(s) necessary to rectify the compliance issue and determine when the action(s) must be completed. The action(s) and time line for completion will be documented in writing and agreed to by both parties. If exten uating circumstances arise that requires an extension to the time line, the Contractor must email a request to the Health Disparities Grant Program Manager and receive approval for a new due date. The State will oversee the completion/implementation of the action(s) to ensure time lines are met and the issue(s) is resolved. If the Contractor demonstrates inaction or disregard for the agreed upon compliance resolution plan, the State may exercise its rights under the provisions of this contract.
