BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 92 - :`
CONCERNING REDEMPTION OF CERTIFICATE OF PURCHASE FOR
ERRONEOUS TAX LIEN SOLD AT TAX SALE
( #1988 -0655)
WHEREAS, in 1988, the records of the Eagle County Treasurer
( "the Treasurer ") showed that the property tax for certain real
property identified by Tax Schedule Number 0010379 remained
unpaid for tax year 1987; and
WHEREAS, it has come to the attention of the Treasurer that
the unpaid tax resulted from the Vail Transfer Tax, which is
collected by the Treasurer pursuant to Intergovernmental
Agreement with the Town of Vail; and
WHEREAS, in 1988, the Town of Vail notified Eagle County
that the Transfer Tax for the subject property was forgiven, and
that these taxes were sold in error; and
WHEREAS, Dana Cook, the holder of the certificate of pur-
chase, has applied for a Treasurer's Deed, and the Treasurer has
expended money in processing said application.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO ( "the
Board "):
THAT, the sale of the tax lien described herein constitutes
an erroneous sale under C.R.S. 39 -12 -111, as amended.
THAT, the County shall reimburse Mr. Cook in the amounts set
forth below.
THAT, reimbursement shall be made from funds due the Town of
Vail; except that the interest shall be paid from the County
general fund, interest to be calculated pursuant to C.R.S. 39 -12-
111(2), as amended.
Redemption is as follows:
Tax Sale # 1988-0655
Certificate Amount $2,642.45
Interest through 3/92 801.26
Deposit for Treas. Deed 150.00
Total $3,593.71

Reimbursement for the $150.00 deposit for treasurer's deed shall
also be made from the general fund.
THAT, the Eagle County Budget officer and the Eagle County
Treasurer are hereby directed to take all actions necessary to
effectuate this resolution.
THAT, the Board hereby finds, determines and declares that
this Resolution is necessary for the health, safety and welfare
of the citizens of Eagle County.
MOVED, READ AND ADOPTED by the Board of County Commissioners
of the County f Eagle, State of Colorado, at its regular meeting
held the day of April, 1992.
