This being a scheduled Public Hearing,the following items were presented to the Board of County
Commissioners for their consideration:
Commissioner Updates
Commissioner McQueeney gave a shout to everyone that attended the Community Conversation meeting
last Thursday. The discussion was centered on the community's response to COVID in terms of stopping the
disease, ensuring that kids could have a successful school year,and that the county could have a successful winter.
The group acknowledged the community collaboration and communication on the topic. It came down to everyone
taking a personal responsibility to follow the five commitments in order to achieve the three goals. In addition to
the commitment to contain the spread of the disease it was important to be kind.
Commissioner Scherr encouraged people to check their voter registration online in advanced of the
upcoming November general election.
Chairman Chandler-Henry gave a shout out to everyone who participated in the 4H program. The CSU
Extension did an outstanding job. There was a virtual online auction for the Jr. Livestock sale. She gave a shout
out to the community and the buyers who supported the kids. There were several projects going to the State Fair.
County Manager Updates
Jeff Shroll thanked the county's business partners that participated in the Community Conversation last
week as well as all of the county staff.
COVID-19 Update
Birch Baron provided a weekly update on the COVID status. He believed this had been a rough couple
weeks. Eagle County had seen a spread in the disease and the risk level was currently at concerning level. He
encouraged people to stay home when feeling sick. There had been a slight increase in hospitalizations at Vail
Health. In the last week there had been 32 daily outpatient respiratory visits. The number of new cases was
concerning. The percent of tests that came back positive was also concerning. Thirty four percent of individuals
tested at health care organizations that served lower income and uninsured came back positive.As of Monday,there
were 300 tests that were still pending. There has been a slight leveling off but more action was required. There had
been 169 cases over the past fourteen days.
Chairman Chandler-Henry asked Mr.Baron to talk about the risk meter.
Mr. Baron stated that the meter was being used by the school district and there had been discussions about
using the meter in collaboration with surrounding communities.

Commissioner Scherr moved to approve the Consent Agenda for July 28,2020, as presented.
Commissioner McQueeney seconded the motion. The vote was declared unanimous.
Constituent Input
Chairman Chandler-Henry opened and closed constituent input, as there was none.
Commissioner McQueeney moved to adjourn as the Eagle County Board of County Commissioners and
reconvene as the Eagle County Board of Equalization.
Commissioner Scherr seconded the motion. The vote was declared unanimous.
Eagle County Board of Equalization
1. Resolution 2020-052 Regarding Petitions to the Eagle County Board of Equalization 7-28-20

Commissioner Scherr moved to approve the Resolution regarding petitions to the Eagle County Board of
Equalization.
Commissioner McQueeney seconded the motion. The vote was declared unanimous.
Commissioner McQueeney moved to adjourn as the Eagle County Board of Equalization and reconvene as
the Eagle County Board of County Commissioners.
Commissioner Scherr seconded the motion. The vote was declared unanimous.

1. Eagle Park Reservoir Company Stock Agreement with the Upper Eagle Regional Water Authority

Executive Summary: Eagle County Government owns shares in the Eagle Park Reservoir Company and has
decided to convey the approximate 87 acre feet of water rights it owns in Eagle Park Reservoir to the Upper Eagle
Regional Water Authority to be allocated to affordable housing projects or to projects that promote river health in
Eagle County.The current value of the water is just over$3.45 million.The stock shall be used by the authority to
satisfy the water rights dedication requirements of developments within its service area that provide affordable,
employee or workforce housing units as defined by the Eagle County Affordable Housing Guidelines and
Administrative Procedures and that achieve water conservation goals,or for projects that enhance the health of
streams and rivers in the Eagle River basin.
Bryan Treu, Eagle County Attorney,provided some history behind the agreement. The agreement had been
a of couple years in the making. The Housing Department and Lynn Brooks had worked diligently to come up with
some criteria. He believed it would be a resource to the community to help with housing and to help with river
health and fill a gap.
George Gregory with the Upper Eagle River Regional Water Authority spoke. He expressed an
appreciation to work together and acknowledged the efforts. He believed this was the best example of government
working with other entities to co-labor for the common good of everyone in Eagle County. This was really
important because everyone in the room had worked so hard on affordable housing. This transfer would allow
significant economic benefits to people who want to develop in the future.
Lynn Brooks, General Manager of Eagle River Water and Sanitation District, spoke. They really
appreciated the transfer of water rights and appreciated all the work that the county staff had done to make this
happen. She recognized the Attorney's Office and Housing Department for their efforts. It was a good team. She
also thanked their board members for their insight and vision to create Eagle Park Reservoir and recognize the
importance of housing for the local workforce. This was all carried out by Glenn Porzak who put the agreement
together and helped make it happen. The project alighted with the Eagle River Water and Sanitation District's
values.They will use these rights to help the county further its goals in housing and look to the future and protect
the environment.
Kim Bell Williams,Eagle County Housing Director, spoke. She thanked the County Commissioners for
supporting housing. She expressed excitement for the partnership.

Commissioner McQueeney spoke about the importance of the criteria..
Commissioner Scherr believed this was a good example of the county working collaboratively with the
community to achieve objectives together in much broader way.
Chairman Chandler-Henry believed this was a historic moment. She believed that the Eagle River Water
and Sanitation District and Upper Eagle had been the leaders. This was a great win for everyone.
Commissioner Scherr moved to approve the Eagle River Reservoir Company Stock Agreement with the
Upper Eagle Regional Water Authority.
Commissioner McQueeney seconded the motion. The vote was declared unanimous.
2. Eagle Park Reservoir Special Warranty Deed(part of stock agreement)

Executive Summary: This Special Warranty Deed accompanies the EPRC Stock Agreement. Eagle County

Commissioner McQueeney moved to approve the Eagle Park Reservoir Special Warranty Deed
Commissioner Scherr seconded the motion. The vote was declared unanimous.
3. Resolution 2020-053 Amendment to the August 23, 2016 Eagle County Building(Hearing 2)

Executive Summary: To consider an amendment to the August 23, 2016 Building Resolution Chapter III, Table 7
- Electric Permit Fees to increase such fees yearly by 8%, the maximum allowed per year.
Morgan Beryl stated that there was no input from the public received.
Mr. Gasbossi stated that the amendment would allow for an increase in fees.
Commissioner McQueeney added that the board received a full presentation last week and this was an
opportunity for the public to weigh-in.
Commissioner Scherr moved to approve the Amendment to the August 23, 2016 Eagle County Building
Resolution regarding Chapter III,Table 7.
Commissioner McQueeney seconded the motion. The vote was declared unanimous.
4. Resolution 2020-054 Adopting the 2020 Colorado Communities for Climate Action Policy Statement
Executive Summary: This resolution is to adopt the 2020-2021 Colorado Communities for Climate Action
(CC4CA) Policy Statement, which identifies focus areas and opportunities for policy support in collaboration with
other CC4CA communities to potentially propose and support legislation aligned with policy goals. CC4CA is a
coalition of 27 local governments across the state that advocates for stronger state and federal climate policies.
Adam Palmer, Sustainable Communities Director, explained the process and recognized the challenges in
developing the policy.
Commissioner Scherr believed the group had done a remarkable job and the policy underlined the
importance of climate and environmental policy for Eagle County.
Commissioner McQueeney stated that once adopted the policy would become part of the county's policy
statement. People could review all of the policy statements online at eaglecounty.org.
Chairman Chandler-Henry encouraged people to take a look at the policy positions. They both support
what's being done at the county and challenge the county to do more.
Commissioner McQueeney moved to approve the Adoption of the 2020 Colorado Communities for
Climate Action Policy Statement.
Commissioner Scherr seconded the motion. The vote was declared unanimous.
5. The Board of County Commissioners will meet as necessary to review and take action on any issues related
to the COVID-19 Local Disaster Emergency.
