HomeMy WebLinkAboutMinutes 07/21/20 PUBLIC HEARING July 21, 2020 Present: Matt Scherr Pro-Tern Commissioner Jeanne McQueeney Commissioner Jeff Shroll County Manager Holly Strablizky Assistant County Attorney Kathy Parker Assistant County Attorney Kathy Scriver Deputy Clerk to the Board Absent: Kathy Chandler-Henry Chairman This being a scheduled Public Hearing,the following items were presented to the Board of County Commissioners for their consideration: Commissioner Updates Commissioner McQueeney stated that she was amazed by the work getting done on a regular basis to protect everyone's health and safety. She was grateful for the people she worked alongside and the people that were part of the county and making it run. She believed it was going to be a long haul and appreciated everyone's efforts. Commissioner Scherr spoke about the start of the school and the challenges of working to find ways that wouldn't normally need to be considered. The school board would be considering in an upcoming board meeting to extend the summer break by one week. County Manager Updates Jeff Shroll announced that there would be a community conversation forum on Thursday to talk about how to continue working together on all matters of COVID. There would be guests from the county,the School District, representation from the Hispanic community,Vail Resorts, and Vail Health. He also encouraged everyone to visit the new Crown Mountain bike park. It was an amazing facility for all ages and a great benefit to the El Jebel and Basalt areas. COVID-19 Update Birch Baron,Emergency Manager stated that he looked forward to the upcoming community conversation meeting on Thursday as well. He stated that the COVID risk level went up to"concerned"in the last week. On a personal level,he encouraged people to stay home and only get out if it was necessary. He stated that the state and national trends were"cautious." Hospital admissions,medical visits, and severe disease level was"comfortable." There was still a delay in testing. Twenty one percent of tested individuals came back positive for COVID-19, and 30%of individuals tested at health care organizations that serve lower income and uninsured came back positive. The increase in test positively indicated an increase in disease transmission and the increased likelihood of undetected cases. The local disease spread was concerning. Forty one percent of newly reported cases in the past 10 days reported close contact to a known case with5%exposed outside of the county and 54%had an exposure that could not be identified. Contact tracing was beginning to break down due to a delay in testing.The county had taken steps and proposed a mitigation plan to control the spread. The county was now limiting social gatherings, 1 07/21/2020 requiring face coverings, and requiring people to stay home if ill. He spoke about the resources available on ecemergency.org Consent Agenda 1. Agreement for Services between Eagle County and Phoenix Industries, LLC -Brush Creek Bridge Scour Mitigation Project Riche Davies,Engineering 2. Regarding Petitions to the Eagle County Board of Equalization 7-21-20 Rhea Silverkorn,Administration Commissioner McQueeney moved to approve the Consent Agenda for July 21,2020, as presented. Commissioner Scherr seconded the motion. Of the two voting Commissioners,the vote was declared unanimous. Constituent Input Chairman Pro-Tern Scherr opened public comment. Chris Neuswanger,Eagle County resident commented on the public hearing process for the Edwards River Park development application. He believed that the process needed to be revised to allow for a better method to handle public comment. He wondered how the application process got so far.He hoped the board would consider denying the proposal as the development was in no one's best interest. Morgan Beryl stated that the hearing before the BoCC was scheduled for August 19 and additional dates may be added to allow for additional public comment. Chairman Pro-Tern Scherr closed constituent input. Business Items 1. Amendment to the August 23,2016 Eagle County Building Resolution Regarding Electric Permit Fees (Hearing 1) Morgan Beryl-Community Development,Vance Gobossi-Building Department,and Kathy Parker, Attorney's Office Executive Summary: To consider an amendment to the August 23, 2016 Building Resolution Chapter III,Table 7 - Electric Permit Fees to increase such fees yearly by 8%,the maximum allowed per year. Morgan Beryl stated that the amendment was sent out for to referral agencies and no public comments had been received. Vance Gobossi stated that the fees had been updated not to exceed the allowable maximums. The state had just increased their fees as well by 25%. 2. The Board of County Commissioners will meet as necessary to review and take action on any issues related to the COVID-19 Local Disaster Emergency. Presentation - Eagle County Room 2 07/21/2020 1. Presentation of the 2019 Eagle County Audit Jill Klosterman,Finance Executive Summary: McMahan and Associates, L.L.C.,the county's independent auditor,will present the audited 2019 Eagle County Comprehensive Annual Financial Report to the BoCC. Planning File - Eagle County Room 1. Kudel Planned Unit Development-PDSP-9022/ZC-9023 -Combined PUD Sketch/Preliminary Plan and Zone Change(second hearing) Morgan Landers,AICP-Planning Manager Executive Summary: The applicant seeks approval for the filing of the Final Phase 2 Plat for the Tree Farm Planned Unit Development.The Planned Unit Development land use file number is PDP-4986 and was approved under Eagle County resolution number 2017-064.This hearing is the second of two hearings on this file,the first hearing was held on July 14, 2020. There were no public comments received prior to the first hearing.New public comments received through the link below will be published to the website following the close of public comment on July 16, 2020. Morgan Landers stated that this was the second hearing for file no. PDSP-9022 and ZC-9023. She presented a PowerPoint presentation. The first hearing was held last week, and there was a site visit on July 20, 2020. Ms. Landers provided a recap and stated that as of today staff had not received any public comment. Mauriello Planning stated that the applicant had no presentation and believed the process had been beneficial. Commissioner Scherr closed public comment. Commissioner McQueeney appreciated the work by the applicant and believed the application met the standards for approval. Commissioner McQueeney moved to approve file no. PDSP-9023, incorporating staff's findings as the application meets the standards for approval for a PUD Sketch/Preliminary Plan. Commissioner Scherr seconded the motion. Of the two voting Commissioners, the vote was declared unanimous. Commissioner McQueeney moved to approve file no.ZC-9023, incorporating staff's findings, as the application meets the standards for approval of a Zone Change. Commissioner Schen seconded the motion. Of the two'voting Commissioners, the vote was declared unanimous. Planning File - Eagle County Room 1. Tree Farm Phase Two Final Plat(second hearing) Tez Hawkins,Community Development 2. Subdivision and Off-Site Improvements Agreement for Tree Farm-Phase 2(2nd Hearing) Riche Davies,Engineering 3 07/21/2020 Executive Summary: The Tree Farm PUD was approved by the Board of County Commissioners on June 26, 2017. The Final Plat for Tree Farm Phase 2 is scheduled for Board approval on July 21, 2020 (the second of two scheduled hearings). In conjunction with the approval of the Final Plat,the developer is required to enter into this Subdivision and Off-Site Improvements Agreement to govern the construction of and collateralization of public improvements and landscape improvements for the PUD. The developer has provided the required collateral for the public and landscape improvements in the form of a letter of credit in the amount of$6,984,095.88. Mr. Hawkins stated that this was the second of two hearings. He provided an overview of the proposal. There were seven standards of approval. Mr. Hawkins reviewed those standards and indicated that all seven standards had been met. No public comment has been received as of today. Jon Fredericks, Landwest Planning stated that the applicant had nothing to add. Commissioner Scherr closed public comment. Commissioner McQueeney expressed her appreciation for a thorough application and the slides went straight to the standards.Based on review of the standards she believed an approval was appropriate. Commissioner Scherr believed it was a great project and believed the application met the standards. Commissioner McQueeney moved to approve the proposed Tree Farm Phase Two Final Plat,File No. PDF-09092-2020,the accompanying Subdivision and Off-Site Improvements Agreement, and construction plans for the subdivision,dated July 21, 2020; authorizing the Chair to sign these documents.
