BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 92 - 1 3S ,
CONCERNING REDEMPTION OF CERTIFICATES OF PURCHASE FOR
EXEMPT PROPERTY ERRONEOUSLY SOLD AT TAX SALE
( #1988 -0215 and #1991 -0172)
WHEREAS, in 1980, certain real property identified by Tax
Schedule Number 0012817 was transferred to the Town of Vail, a
body corporate and politic; and
WHEREAS, the Eagle County Treasurer has determined that said
property has been used by the general public since 1980, and that
said property has not provided any special benefit to any private
individual since that time, and that the property has been public
property for all intents and purposes since 1980 and should not
have been included on the assessment rolls; and
WHEREAS, said property remained on the assessment rolls
until 1991, and real property taxes were levied against the
property before its removal from the assessment roll; and
WHEREAS, the taxes assessed against the property were
unpaid, and were sold at tax sale; and
WHEREAS, the holder of one of the certificates of purchase
has applied for a Treasurer's Deed, and the Treasurer has
expended money in processing said application.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO ( "the
Board ") :
THAT, the sales of the tax liens described herein constitute
erroneous sales under C.R.S. 39 -12 -111, as amended.
THAT, the County shall reimburse the purchasers of the tax
liens described below; that reimbursements shall be made from the
various funds to which the tax was originally distributed; except
that the interest shall be paid from the County general fund,
interest to be calculated pursuant to C.R.S. 39- 12- 111(2), as
amended.

also be made from the general fund.
THAT, the Eagle County Budget Officer and the Eagle County
Treasurer are hereby directed to take all actions necessary to
effectuate this resolution.
THAT the Board hereby finds, determines and declares that
this Resolution is necessary for the health, safety and welfare
of the citizens of Eagle County.
MOVED, READ AND ADOPTED by the Board of County Commissioners
of the County g_f Eagle, State of Colorado, at its regular meeting
