ZC- 250 -91 WHEREAS, on or about December 4 , 1991, the County of Eagle, State of Colorado, accepted for filing an application submitted by Kensington Land Investment Partners (hereinafter "Applicant") for approval of the Zone District Amendment for the Southern Parcel of Cordillera Phase II, in and above Squaw Creek Valley, southwest of Edwards, Colorado ( "Cordillera") (the legal description of the Southern Parcel is attached hereto as Exhibit A); and 'KH.7REAS, after its public hearing held on February 5, 1992, the Eagle and Colorado Valley Planning Commission, based upon its findings, recommended approval of the Zone District Amendment for the Southern Parcel of Cordillera Phase II; and WHEREAS, at its public hearing held on February 11, 1992, the Eagle County Board of Commissioners (hereinafter "Board"), considered the Zone District Amendment for the Southern Parcel of Cordillera Phase II, and the statements of the Applicant, the Eagle County Community Development Staff, and other interested persons. BASED ON THE EVIDENCE BEFORE IT, THE BOARD FINDS AS FOLLOWS: 1. The Applicant has complied with the Application requirements set forth in Section 2.14.03 of the Eagle County Land use Regulations (the "Regulations") and Submittal Dates, Review Procedure and Fees requirements of Section 2.25 of the Regulations. 2. With respect to the Review requirements set forth in Section 2.14.04 of the Regulations: (a) The rezoning is consistent with the Master Plan and the area possesses the geological, physical and other environmental conditions compatible with the characteristics of the use requested, and the advantages of the use requested outweigh the disadvantages; and (b) Conceptual evidence has been provided that the land has access and can be serviced with water and sewage disposal systems appropriate with the zone district being sought; and (c) The area for which rezoning is requested has changed or is changing to such a degree that it is in the public interest to encourage a new use or density in the area. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: 41 r,4 t� 2 Ln ON r, s THAT, the application for approval of the Zone District Amendment for the Southern Parcel of Cordillera Phase II from Resource to Planned Unit Development be and hereby is granted for 36 residential dwelling units. THE BOARD further finds, determines and declares that this Resolution is necessary for the health, safety and welfare of the inhabitants of the County of Eagle, State of Colorado.
