DocuSignEnvelopeID:79C91A0B-FE31-4ECC-BDDD-O275AEDC5OB13-08-0020-062-2020ThisOfferismadeonandSUBJECTTOTHEFOLLOWINGTERMSANDCONDITIONS:CONDITIONS1.MaximumObligation.ThemaximumobligationoftheUnitedStatespayableunderthisOfferis$840,000.Thefollowingamountsrepresentabreakdownofthemaximumobligationforthepurposeofestablishingallowableamountsforanyfuturegrantamendment,whichmayincreasetheforegoingmaximumobligationoftheUnitedStatesundertheprovisionsof49U.S.C.§47108(b):$0forplanning;$840,000forairportdevelopmentornoiseprogramimplementation;and$0forlandacquisition.2.PeriodofPerformance.TheperiodofperformancebeginsonthedatetheSponsorformallyacceptsthisagreement.UnlessexplicitlystatedotherwiseinanamendmentfromtheFAA,theenddateoftheperiodofperformanceis4years(1,460calendardays)fromthedateofformalgrantacceptancebytheSponsor.TheSponsormayonlychargeallowablecostsforobligationsincurredpriortotheenddateoftheperiodofperformance(2CFR§200.309).UnlesstheFAAauthorizesawrittenextension,thesponsormustsubmitallprojectcloseoutdocumentationandliquidate(payoff)allobligationsincurredunderthisawardnolaterthan90calendardaysaftertheenddateoftheperiodofperformance(2CFR§200.343).TheperiodofperformanceenddatedoesnotrelieveorreduceSponsorobligationsandassurancesthatextendbeyondthecloseoutofagrantagreement.3.IneligibleorUnallowableCosts.TheSponsormustnotincludeanycostsintheprojectthattheFAAhasdeterminedtobeineligibleorunallowable.4.IndirectCosts—Sponsor.Sponsormaychargeindirectcostsunderthisawardbyapplyingtheindirectcostrateidentifiedintheprojectapplication,asacceptedbytheFAA,toallowablecostsforSponsordirectsalariesandwages.5.DeterminingtheFinalFederalShareofCosts.TheUnitedStates’shareofallowableprojectcostswillbemadeinaccordancewiththeregulations,policies,andproceduresoftheSecretary.FinaldeterminationoftheUnitedStates’sharewillbebaseduponthefinalauditofthetotalamountofallowableprojectcostsandsettlementwillbemadeforanyupwardordownwardadjustmentstotheFederalshareofcosts.6.CompletingtheProjectWithoutDelayandinConformancewithRequirements.TheSponsormustcarryoutandcompletetheprojectwithoutunduedelaysandinaccordancewiththisagreement,andtheregulations,policies,andproceduresoftheSecretary.Per2CFR§200.30$,theSponsoragreestoreporttotheFAAanydisengagementfromperformingtheprojectthatexceedsthreemonths.Thereportmustincludeareasonfortheprojectstoppage.TheSponsoralsoagreestocomplywiththeassuranceswhicharepartofthisagreement.7.AmendmentsorWithdrawalsbeforeGrantAcceptance.TheFAAreservestherighttoamendorwithdrawthisofferatanytimepriortoitsacceptancebytheSponsor.8.OfferExpirationDate.ThisofferwillexpireandtheUnitedStateswillnotbeobligatedtopayanypartofthecostsoftheprojectunlessthisofferhasbeenacceptedbytheSponsoronorbeforeJune30,2020,orsuchsubsequentdateasmaybeprescribedinwritingbytheFAA.9.ImproperUseofFederalFunds.TheSponsormusttakeallsteps,includinglitigationifnecessary,torecoverFederalfundsspentfraudulently,wastefully,orinviolationofFederalantitruststatutes,ormisusedinanyothermannerforanyprojectuponwhichFederalfundshavebeenexpended.Forthepurposesofthisgrantagreement,theterm“Federalfunds”meansfundshoweverusedordispersedbytheSponsor,thatwereoriginallypaidpursuanttothisoranyotherFederalgrantagreement.TheSponsormustobtaintheapprovaloftheSecretaryastoanydeterminationoftheamountoftheFederalshareofsuchfunds.TheSponsormustreturntherecoveredFederalshare,includingfundsrecoveredbysettlement,order,orjudgment,totheSecretary.TheSponsormustfurnishtotheSecretary,uponrequest,alldocumentsandrecordspertainingtothedeterminationoftheamountoftheFederal2Page
DocuSignEnvelopeID:79C91A0B-FE31-4ECC-B000-O275AEDC5OB13-08-0020-062-2020shareortoanysettlement,litigation,negotiation,orothereffortstakentorecoversuchfunds.AllsettlementsorotherfinalpositionsoftheSponsor,incourtorotherwise,involvingtherecoveryofsuchFederalsharerequireadvanceapprovalbytheSecretary.10.UnitedStatesNotLiableforDamageorInjury.TheUnitedStatesisnotresponsibleorliablefordamagetopropertyorinjurytopersonswhichmayarisefrom,orbeincidentto,compliancewiththisgrantagreement.11.SystemforAwardManagement(SAM)RegistrationAndUniversalIdentifier.A.RequirementforSystemforAwardManagement(SAM):UnlesstheSponsorisexemptedfromthisrequirementunder2CFR25.110,theSponsormustmaintainthecurrencyofitsinformationintheSAMuntiltheSponsorsubmitsthefinalfinancialreportrequiredunderthisgrant,orreceivesthefinalpayment,whicheverislater.ThisrequiresthattheSponsorreviewandupdatetheinformationatleastannuallyaftertheinitialregistrationandmorefrequentlyifrequiredbychangesininformationoranotherawardterm.AdditionalinformationaboutregistrationproceduresmaybefoundattheSAMwebsite(currentlyathttp://www.sam.gov).B.DataUniversalNumberingSystem:DUNSnumbermeansthenine-digitnumberestablishedandassignedbyDunandBradstreet,Inc.(D&B)touniquelyidentifybusinessentities.ADUNSnumbermaybeobtainedfromD&Bbytelephone(currently866—705—5771)orontheweb(currentlyathttp://fedgov.dnb.com/webform).12.ElectronicGrantPayment(s).UnlessotherwisedirectedbytheFAA,theSponsormustmakeeachpaymentrequestunderthisagreementelectronicallyviatheDelphielnvoicingSystemforDepartmentofTransportation(DOT)FinancialAssistanceAwardees.13.InformalLetterAmendmentofAlPProjects.If,duringthelifeoftheproject,theFAAdeterminesthatthemaximumgrantobligationoftheUnitedStatesexceedstheexpectedneedsoftheSponsorby$25,000orfivepercent(5%),whicheverisgreater,theFAAcanissuealetteramendmenttotheSponsorunilaterallyreducingthemaximumobligation.TheFAAcanalsoissuealettertotheSponsorincreasingthemaximumobligationifthereisanoverruninthetotalactualeligibleandallowableprojectcoststocovertheamountoftheoverrunprovideditwillnotexceedthestatutorylimitationsforgrantamendments.TheFAA’sauthoritytoincreasethemaximumobligationdoesnotapplytothe“planning”componentofconditionNo.1.TheFAAcanalsoissueaninformalletteramendmentthatmodifiesthegrantdescriptiontocorrectadministrativeerrorsortodeleteworkitemsiftheFAAfindsitadvantageousandinthebestinterestsoftheUnitedStates.Aninformalletteramendmenthasthesameforceandeffectasaformalgrantamendment.14.AirandWaterQuality.TheSponsorisrequiredtocomplywithallapplicableairandwaterqualitystandardsforallprojectsinthisgrant.IftheSponsorfailstocomplywiththisrequirement,theFAAmaysuspend,cancel,orterminatethisagreement.15.FinancialReportingandPaymentRequirements.TheSponsorwillcomplywithallfederalfinancialreportingrequirementsandpaymentrequirements,includingsubmittaloftimelyandaccuratereports.16.BuyAmerican.UnlessotherwiseapprovedinadvancebytheFAA,theSponsorwillnotacquireorpermitanycontractororsubcontractortoacquireanysteelormanufacturedproductsproducedoutsidetheUnitedStatestobeusedforanyprojectforwhichfundsareprovidedunderthisgrant.TheSponsorwillincludeaprovisionimplementingBuyAmericanineverycontract.17.MaximumObligationIncreaseforPrimaryAirports.Inaccordancewith49U.S.C.§47108(b),asamended,themaximumobligationoftheUnitedStates,asstatedinConditionNo.1ofthisGrantOffer:A.maynotbeincreasedforaplanningproject;B.maybeincreasedbynotmorethan15percentfordevelopmentprojects;C.maybeincreasedbynotmorethan15percentforalandproject.3IPage

DocuSignEnvelopeID:79C91AOB-FE31-4ECC-BDDD-O275AEDC5Q19.PublicHearings.Inprojectsinvolvingthelocationofanairport,anairportrunway,oramajorrunwayextension,ithasaffordedtheopportunityforpublichearingsforthepurposeofconsideringtheeconomic,social,andenvironmentaleffectsoftheairportorrunwaylocationanditsconsistencywithgoalsandobjectivesofsuchplanningashasbeencarriedoutbythecommunityanditshall,whenrequestedbytheSecretary,submitacopyofthetranscriptofsuchhearingstotheSecretary.Further,forsuchprojects,ithasonitsmanagementboardeithervotingrepresentationfromthecommunitieswheretheprojectislocatedorhasadvisedthecommunitiesthattheyhavetherighttopetitiontheSecretaryconcerningaproposedproject.10.MetropolitanPlanningOrganization.Inprojectsinvolvingthelocationofanairport,anairportrunway,oramajorrunwayextensionatamediumorlargehubairport,thesponsorhasmadeavailabletoandhasprovideduponrequesttothemetropolitanplanningorganizationintheareainwhichtheairportislocated,ifany,acopyoftheproposedamendmenttotheairportlayoutplantodepicttheprojectandacopyofanyairportmasterplaninwhichtheprojectisdescribedordepicted.11.PavementPreventiveMaintenance.WithrespecttoaprojectapprovedafterJanuary1,1995,forthereplacementorreconstructionofpavementattheairport,itassuresorcertifiesthatithasimplementedaneffectiveairportpavementmaintenance-managementprogramanditassuresthatitwillusesuchprogramfortheusefullifeofanypavementconstructed,reconstructedorrepairedwithFederalfinancialassistanceattheairport.ItwillprovidesuchreportsonpavementconditionandpavementmanagementprogramsastheSecretarydeterminesmaybeuseful.12.TerminalDevelopmentPrerequisites.Forprojectswhichincludeterminaldevelopmentatapublicuseairport,asdefinedinTitle49,ithas,onthedateofsubmittaloftheprojectgrantapplication,allthesafetyequipmentrequiredforcertificationofsuchairportundersection44706ofTitle49,UnitedStatesCode,andallthesecurityequipmentrequiredbyruleorregulation,andhasprovidedforaccesstothepassengerenplaninganddeplaningareaofsuchairporttopassengersenplaninganddeplaningfromaircraftotherthanaircarrieraircraft.13.AccountingSystem,Audit,andRecordKeepingRequirements.a.Itshallkeepallprojectaccountsandrecordswhichfullydisclosetheamountanddispositionbytherecipientoftheproceedsofthisgrant,thetotalcostoftheprojectinconnectionwithwhichthisgrantisgivenorused,andtheamountornatureofthatportionofthecostoftheprojectsuppliedbyothersources,andsuchotherfinancialrecordspertinenttotheproject.TheaccountsandrecordsshallbekeptinaccordancewithanaccountingsystemthatwillfacilitateaneffectiveauditinaccordancewiththeSingleAuditActof1984.b.ItshallmakeavailabletotheSecretaryandtheComptrollerGeneraloftheUnitedStates,oranyoftheirdulyauthorizedrepresentatives,forthepurposeofauditandexamination,anybooks,documents,papers,andrecordsoftherecipientthatarepertinenttothisgrant.TheSecretarymayrequirethatanappropriateauditbeconductedbyarecipient.Inanycaseinwhichanindependentauditismadeoftheaccountsofasponsorrelatingtothedispositionoftheproceedsofagrantorrelatingtotheprojectinconnectionwithwhichthisgrantwasgivenorused,itshallfileacertifiedcopyofsuchauditwiththeComptrollerGeneraloftheUnitedStatesnotlaterthansix(6)monthsfollowingthecloseofthefiscalyearforwhichtheauditwasmade.AirportSponsorAssurances2/2020Page7of18
DocuSignEnvelopeID:79C91A0B-FE3I-4ECC-BDDD-O275AEDC5OB114.MinimumWageRates.Itshallinclude,inallcontractsinexcessof$2,000forworkonanyprojectsfundedunderthisgrantagreementwhichinvolvelabor,provisionsestablishingminimumratesofwages,tobepredeterminedbytheSecretaryofLabor,inaccordancewiththeDavis-BaconAct,asamended(40U.S.C.276a-276a-5),whichcontractorsshallpaytoskilledandunskilledlabor,andsuchminimumratesshallbestatedintheinvitationforbidsandshallbeincludedinproposalsorbidsforthework.15.Veteran’sPreference.Itshallincludeinallcontractsforworkonanyprojectfundedunderthisgrantagreementwhichinvolvelabor,suchprovisionsasarenecessarytoinsurethat,intheemploymentoflabor(exceptinexecutive,administrative,andsupervisorypositions),preferenceshallbegiventoVietnameraveterans,PersianGulfveterans,Afghanistan-Iraqwarveterans,disabledveterans,andsmallbusinessconcernsownedandcontrolledbydisabledveteransasdefinedinSection47112ofTitle49,UnitedStatesCode.However,thispreferenceshallapplyonlywheretheindividualsareavailableandqualifiedtoperformtheworktowhichtheemploymentrelates.16.ConformitytoPlansandSpecifications.Itwillexecutetheprojectsubjecttoplans,specifications,andschedulesapprovedbytheSecretary.Suchplans,specifications,andschedulesshallbesubmittedtotheSecretarypriortocommencementofsitepreparation,construction,orotherperformanceunderthisgrantagreement,and,uponapprovaloftheSecretary,shallbeincorporatedintothisgrantagreement.Anymodificationtotheapprovedplans,specifications,andschedulesshallalsobesubjecttoapprovaloftheSecretary,andincorporatedintothisgrantagreement.17.ConstructionInspectionandApproval.Itwillprovideandmaintaincompetenttechnicalsupervisionattheconstructionsitethroughouttheprojecttoassurethattheworkconformstotheplans,specifications,andschedulesapprovedbytheSecretaryfortheproject.ItshallsubjecttheconstructionworkonanyprojectcontainedinanapprovedprojectapplicationtoinspectionandapprovalbytheSecretaryandsuchworkshallbeinaccordancewithregulationsandproceduresprescribedbytheSecretary.SuchregulationsandproceduresshallrequiresuchcostandprogressreportingbythesponsororsponsorsofsuchprojectastheSecretaryshalldeemnecessary.18.PlanningProjects.Incarryingoutplanningprojects:a.Itwillexecutetheprojectinaccordancewiththeapprovedprogramnarrativecontainedintheprojectapplicationorwiththemodificationssimilarlyapproved.b.ItwillfurnishtheSecretarywithsuchperiodicreportsasrequiredpertainingtotheplanningprojectandplanningworkactivities.c.ItwillincludeinallpublishedmaterialpreparedinconnectionwiththeplanningprojectanoticethatthematerialwaspreparedunderagrantprovidedbytheUnitedStates.d.Itwillmakesuchmaterialavailableforexaminationbythepublic,andagreesthatnomaterialpreparedwithfundsunderthisprojectshallbesubjecttocopyrightintheUnitedStatesoranyothercountry.e.ItwillgivetheSecretaryunrestrictedauthoritytopublish,disclose,distribute,andotherwiseuseanyofthematerialpreparedinconnectionwiththisgrant.AirportSponsorAssurances2/2020Page8of18
DocuSignEnvelopeID:79C91A0B-FE31-4ECC-BDDD-O275AEDC5OB11.ItwillgranttheSecretarytherighttodisapprovethesponsorsemploymentofspecificconsultantsandtheirsubcontractorstodoalloranypartofthisprojectaswellastherighttodisapprovetheproposedscopeandcostofprofessionalservices.g.ItwillgranttheSecretarytherighttodisapprovetheuseofthesponsor’semployeestodoalloranypartoftheproject.h.ItunderstandsandagreesthattheSecretary’sapprovalofthisprojectgrantortheSecretary’sapprovalofanyplanningmaterialdevelopedaspartofthisgrantdoesnotconstituteorimplyanyassuranceorcommitmentonthepartoftheSecretarytoapproveanypendingorfutureapplicationforaFederalairportgrant.19.OperationandMaintenance.a.Theairportandallfacilitieswhicharenecessarytoservetheaeronauticalusersoftheairport,otherthanfacilitiesownedorcontrolledbytheUnitedStates,shallbeoperatedatalltimesinasafeandserviceableconditionandinaccordancewiththeminimumstandardsasmayberequiredorprescribedbyapplicableFederal,stateandlocalagenciesformaintenanceandoperation.Itwillnotcauseorpermitanyactivityoractionthereonwhichwouldinterferewithitsuseforairportpurposes.Itwillsuitablyoperateandmaintaintheairportandallfacilitiesthereonorconnectedtherewith,withdueregardtoclimaticandfloodconditions.Anyproposaltotemporarilyclosetheairportfornon-aeronauticalpurposesmustfirstbeapprovedbytheSecretary.Infurtheranceofthisassurance,thesponsorwillhaveineffectarrangementsfor-1)Operatingtheairport’saeronauticalfacilitieswheneverrequired;2)Promptlymarkingandlightinghazardsresultingfromairportconditions,includingtemporaryconditions;and3)Promptlynotifyingairmenofanyconditionaffectingaeronauticaluseoftheairport.Nothingcontainedhereinshallbeconstruedtorequirethattheairportbeoperatedforaeronauticaluseduringtemporaryperiodswhensnow,floodorotherclimaticconditionsinterferewithsuchoperationandmaintenance.Further,nothinghereinshallbeconstruedasrequiringthemaintenance,repair,restoration,orreplacementofanystructureorfacilitywhichissubstantiallydamagedordestroyedduetoanactofGodorotherconditionorcircumstancebeyondthecontrolofthesponsor.b.ItwillsuitablyoperateandmaintainnoisecompatibilityprogramitemsthatitownsorcontrolsuponwhichFederalfundshavebeenexpended.20.HazardRemovalandMitigation.Itwilltakeappropriateactiontoassurethatsuchterminalairspaceasisrequiredtoprotectinstrumentandvisualoperationstotheairport(includingestablishedminimumflightaltitudes)willbeadequatelyclearedandprotectedbyremoving,lowering,relocating,marking,orlightingorotherwisemitigatingexistingairporthazardsandbypreventingtheestablishmentorcreationoffutureairporthazards.21.CompatibleLandUse.Itwilltakeappropriateaction,totheextentreasonable,includingtheadoptionofzoninglaws,torestricttheuseoflandadjacenttoorintheimmediatevicinityoftheairporttoactivitiesandpurposescompatiblewithnormalairportoperations,includinglandingandtakeoffofaircraft.Inaddition,iftheprojectisfornoisecompatibilityprogramimplementation,itwillnotcauseorpermitanychangeinlanduse,withinitsjurisdiction,thatwillreduceitscompatibility,withAirportSponsorAssurances2/2020Page9of18
DocuSignEnvelopeID:79C91AOB-FE31-4ECC-BDDD-O275AEDC5OB1respecttotheairport,ofthenoisecompatibilityprogrammeasuresuponwhichFederalfundshavebeenexpended.22.EconomicNondiscrimination.a.ItwillmaketheairportavailableasanairportforpublicuseonreasonabletermsandwithoutunjustdiscriminationtoalLtypes,kindsandclassesofaeronauticalactivities,includingcommercialaeronauticalactivitiesofferingservicestothepublicattheairport.b.Inanyagreement,contract,lease,orotherarrangementunderwhicharightorprivilegeattheairportisgrantedtoanyperson,firm,orcorporationtoconductortoengageinanyaeronauticalactivityforfurnishingservicestothepublicattheairport,thesponsorwillinsertandenforceprovisionsrequiringthecontractorto-1)furnishsaidservicesonareasonable,andnotunjustlydiscriminatory,basistoallusersthereof,and2)chargereasonable,andnotunjustlydiscriminatory,pricesforeachunitorservice,providedthatthecontractormaybeallowedtomakereasonableandnondiscriminatorydiscounts,rebates,orothersimilartypesofpricereductionstovolumepurchasers.a.Eachfixed-basedoperatorattheairportshallbesubjecttothesamerates,fees,rentals,andotherchargesasareuniformlyapplicabletoallotherfixed-basedoperatorsmakingthesameorsimilarusesofsuchairportandutilizingthesameorsimilarfacilities.b.Eachaircarrierusingsuchairportshallhavetherighttoserviceitselfortouseanyfixed-basedoperatorthatisauthorizedorpermittedbytheairporttoserveanyaircarrieratsuchairport.c.Eachaircarrierusingsuchairport(whetherasatenant,non-tenant,orsubtenantofanotheraircarriertenant)shallbesubjecttosuchnondiscriminatoryandsubstantiallycomparablerules,regulations,conditions,rates,fees,rentals,andotherchargeswithrespecttofacilitiesdirectlyandsubstantiallyrelatedtoprovidingairtransportationasareapplicabletoallsuchaircarrierswhichmakesimilaruseofsuchairportandutilizesimilarfacilities,subjecttoreasonableclassificationssuchastenantsornon-tenantsandsignatorycarriersandnonsignatorycarriers.Classificationorstatusastenantorsignatoryshallnotbeunreasonablywithheldbyanyairportprovidedanaircarrierassumesobligationssubstantiallysimilartothosealreadyimposedonaircarriersinsuchclassificationorstatus.d.Itwillnotexerciseorgrantanyrightorprivilegewhichoperatestopreventanyperson,firm,orcorporationoperatingaircraftontheairportfromperforminganyservicesonitsownaircraftwithitsownemployees[including,butnotlimitedtomaintenance,repair,andfueling]thatitmaychoosetoperform.e.Intheeventthesponsoritselfexercisesanyoftherightsandprivilegesreferredtointhisassurance,theservicesinvolvedwillbeprovidedonthesameconditionsaswouldapplytothefurnishingofsuchservicesbycommercialaeronauticalserviceprovidersauthorizedbythesponsorundertheseprovisions.f.Thesponsormayestablishsuchreasonable,andnotunjustlydiscriminatory,conditionstobemetbyallusersoftheairportasmaybenecessaryforthesafeandefficientoperationoftheairport.AirportSponsorAssurances2/2020Page10of18
DocuSignEnvelopeID:79C91AOB-FE31-4ECC-BDDD-0275AE0C50B1g.Thesponsormayprohibitorlimitanygiventype,kindorclassofaeronauticaluseoftheairportifsuchactionisnecessaryforthesafeoperationoftheairportornecessarytoservethecivilaviationneedsofthepublic.23.ExclusiveRights.Itwillpermitnoexclusiverightfortheuseoftheairportbyanypersonproviding,orintendingtoprovide,aeronauticalservicestothepublic.Forpurposesofthisparagraph,theprovidingoftheservicesatanairportbyasinglefixed-basedoperatorshallnotbeconstruedasanexclusiverightifbothofthefollowingapply:a.Itwouldbeunreasonablycostly,burdensome,orimpracticalformorethanonefixed-basedoperatortoprovidesuchservices,andb.Ifallowingmorethanonefixed-basedoperatortoprovidesuchserviceswouldrequirethereductionofspaceleasedpursuanttoanexistingagreementbetweensuchsinglefixed-basedoperatorandsuchairport.Itfurtheragreesthatitwillnot,eitherdirectlyorindirectly,grantorpermitanyperson,firm,orcorporation,theexclusiverightattheairporttoconductanyaeronauticalactivities,including,butnotlimitedtocharterflights,pilottraining,aircraftrentalandsightseeing,aerialphotography,cropdusting,aerialadvertisingandsurveying,aircarrieroperations,aircraftsalesandservices,saleofaviationpetroleumproductswhetherornotconductedinconjunctionwithotheraeronauticalactivity,repairandmaintenanceofaircraft,saleofaircraftparts,andanyotheractivitieswhichbecauseoftheirdirectrelationshiptotheoperationofaircraftcanberegardedasanaeronauticalactivity,andthatitwillterminateanyexclusiverighttoconductanaeronauticalactivitynowexistingatsuchanairportbeforethegrantofanyassistanceunderTitle49,UnitedStatesCode.24.FeeandRentalStructure.Itwillmaintainafeeandrentalstructureforthefacilitiesandservicesattheairportwhichwillmaketheairportasself-sustainingaspossibleunderthecircumstancesexistingattheparticularairport,takingintoaccountsuchfactorsasthevolumeoftrafficandeconomyofcollection.NopartoftheFederalshareofanairportdevelopment,airportplanningornoisecompatibilityprojectforwhichagrantismadeunderTitle49,UnitedStatesCode,theAirportandAirwayImprovementActof1982,theFederalAirportActortheAirportandAirwayDevelopmentActof1970shallbeincludedintheratebasisinestablishingfees,rates,andchargesforusersofthatairport.25.AirportRevenues.a.AllrevenuesgeneratedbytheairportandanylocaltaxesonaviationfuelestablishedafterDecember30,1987,willbeexpendedbyitforthecapitaloroperatingcostsoftheairport;thelocalairportsystem;orotherlocalfacilitieswhichareownedoroperatedbytheowneroroperatoroftheairportandwhicharedirectlyandsubstantiallyrelatedtotheactualairtransportationofpassengersorproperty;orfornoisemitigationpurposesonorofftheairport.Thefollowingexceptionsapplytothisparagraph:1)IfcovenantsorassurancesindebtobligationsissuedbeforeSeptember3,1982,bytheowneroroperatoroftheairport,orprovisionsenactedbeforeSeptember3,1982,ingoverningstatutescontrollingtheowneroroperator’sfinancing,providefortheuseoftherevenuesfromanyoftheairportowneroroperator’sfacilities,includingtheairport,tosupportnotonlytheairportbutalsotheairportowneroroperator’sgeneraldebtobligationsorotherfacilities,thenthislimitationontheuseofallrevenuesgeneratedAirportSponsorAssurances2/2020Page11of18

DocuSignEnvelopeID:79C91AOB-FE31-4ECC-BDDD-O275AEDC5OB127.UsebyGovernmentAircraft.ItwillmakeavailableallofthefacilitiesoftheairportdevelopedwithFederalfinancialassistanceandallthoseusableforlandingandtakeoffofaircrafttotheUnitedStatesforusebyGovernmentaircraftincommonwithotheraircraftatalltimeswithoutcharge,except,iftheusebyGovernmentaircraftissubstantial,chargemaybemadeforareasonableshare,proportionaltosuchuse,forthecostofoperatingandmaintainingthefacilitiesused.UnlessotherwisedeterminedbytheSecretary,orotherwiseagreedtobythesponsorandtheusingagency,substantialuseofanairportbyGovernmentaircraftwillbeconsideredtoexistwhenoperationsofsuchaircraftareinexcessofthosewhich,intheopinionoftheSecretary,wouldundulyinterferewithuseofthelandingareasbyotherauthorizedaircraft,orduringanycalendarmonththat—a.bygrossweightsofsuchaircraft)isinexcessoffivemillionpoundsFive(5)ormoreGovernmentaircraftareregularlybasedattheairportoronlandadjacentthereto;orb.Thetotalnumberofmovements(countingeachlandingasamovement)ofGovernmentaircraftis300ormore,orthegrossaccumulativeweightofGovernmentaircraftusingtheairport(thetotalmovementofGovernmentaircraftmultiplied.28.LandforFederalFacilities.ItwillfurnishwithoutcosttotheFederalGovernmentforuseinconnectionwithanyairtrafficcontrolorairnavigationactivities,orweather-reportingandcommunicationactivitiesrelatedtoairtrafficcontrol,anyareasoflandorwater,orestatetherein,orrightsinbuildingsofthesponsorastheSecretaryconsidersnecessaryordesirableforconstruction,operation,andmaintenanceatFederalexpenseofspaceorfacilitiesforsuchpurposes.SuchareasoranyportionthereofwillbemadeavailableasprovidedhereinwithinfourmonthsafterreceiptofawrittenrequestfromtheSecretary.29.AirportLayoutPlan.a.SubjecttotheFAAReauthorizationActof2018,PublicLaw115-254,Section163,itwillkeepuptodateatalltimesanairportlayoutplanoftheairportshowing:1)boundariesoftheairportandallproposedadditionsthereto,togetherwiththeboundariesofalloffsiteareasownedorcontrolledbythesponsorforairportpurposesandproposedadditionsthereto;2)thelocationandnatureofallexistingandproposedairportfacilitiesandstructures(suchasrunways,taxiways,aprons,terminalbuildings,hangarsandroads),includingallproposedextensionsandreductionsofexistingairportfacilities;3)thelocationofallexistingandproposednon-aviationareasandofallexistingimprovementsthereon;and4)allproposedandexistingaccesspointsusedtotaxiaircraftacrosstheairport’spropertyboundary.Suchairportlayoutplansandeachamendment,revision,ormodificationthereof,shallbesubjecttotheapprovaloftheSecretarywhichapprovalshallbeevidencedbythesignatureofadulyauthorizedrepresentativeoftheSecretaryonthefaceoftheairportlayoutplan.ThesponsorwillnotmakeorpermitanychangesoralterationsintheairportoranyofitsfacilitieswhicharenotinconformityAirportSponsorAssurances2/2020Page13of18
