HomeMy WebLinkAboutR92-013 enterprise zone tax incentives for Eagle Gypsum ProductsCommissioner moved adoption of the following resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 92 - 13 CONCERNING ENTERPRISE ZONE TAX INCENTIVES FOR EAGLE- GYPSUM PRODUCTS' TAXABLE REAL AND PERSONAL PROPERTY WHEREAS, the Northwest Rural Enterprise Zone was established in accordance with the Urban and Rural Enterprise Zone Act, Section 39 -30 -101, C.R.S., et sect (hereinafter the "Act "); and WHEREAS, the Board of County Commissioners of Eagle County, Colorado (hereinafter "the Board ") has found that the purposes of the Act are to encourage, develop and expand opportunities for employment in the private sector in this state; to provide incentives for the expansion of private enterprise and for new businesses to locate in economically needy areas; to provide more job opportunities for residents of such areas; and, to establish tax incentives and other assistance in order to encourage private enterprises to expand and locate in this state; and WHEREAS, Eagle- Gypsum Products has established within the incorporated Town of Gypsum, Eagle County, Colorado, which is located in the Northwest Rural Enterprise Zone, a business facility for the manufacture of wall board products; and WHEREAS, the Board, by Resolution No. 90 -91 and Resolution No. 91 -3, granted a tax incentives relative to the taxable real property of Eagle- Gypsum Products known as tax schedule number 0006436, and the personal property identified by tax schedule number P020870, located in Gypsum (Eagle County), Colorado, pursuant to Section 39- 30- 107.5, C.R.S.; and WHEREAS, Eagle- Gypsum Products has requested that the Board grant similar incentives for the tax year 1991, which taxes are due and payable in 1992; and WHEREAS, the Board finds that the beneficial aspects of the Eagle - Gypsum Products' manufacturing facility located in Gypsum, Colorado, will be increased, and the general welfare of the residents of Eagle County will be further promoted, by granting a tax incentive relative to the taxable property of Eagle- Gypsum Products referenced above, hereinafter set forth. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT in 1992, the Board shall make an incentive payment to Eagle- Gypsum Products, Gypsum (Eagle County), Colorado, equal to Fifty Percent (50 %) of the difference between the taxes paid on the real and personal property for tax year 1991 and the tax liability for the real and personal property for the base year. THAT, the incentive payment granted hereby shall be limited to and only include reimbursement of that portion of the real and personal property taxes imposed and collected by the County, exclusive of the taxes levied by other governmental or quasi - governmental agencies and municipalities. THAT, the base year shall be the year preceding the year in which the enterprise zone was established (base year: 1989). The tax amount for that year is $0.00 for schedule number P020870 (personal property), and $216.51 for schedule number 0006436 (real property). THAT, upon timely and complete payment of all 1991 real and personal property taxes payable in 1992 by Eagle- Gypsum Products, the County Commissioners shall, within thirty days after Eagle - Gypsum Products has submitted proof of full payment of said taxes, provide incentive payment unto Eagle- Gypsum Products in the aforesaid percentage of benefit, excluding interest and penalties paid, if any. THAT, in no instance shall the total incentive payment issued under this resolution exceed $89,000.00. -2- THAT, the Board hereby reserves similar incentives, up to 100 percent between taxes paid and the base year Products for said property for the 1992 consideration shall include but not be need by Eagle - Gypsum Products and the budget resources. its ability to consider (100°x) of the difference taxes, for Eagle- Gypsum and 1993 tax years. Said limited to an analysis of Board's other demands on THAT, the Board hereby finds, determines and declares that this Resolution is necessary for the public health, safety and welfare of the residents of the County of Eagle, State of Colorado.
