IN RE THE MATTER OF THE REQUESTS FOR APPROVAL OF
(1) THE PLANNED UNIT DEVELOPMENT SKETCH PLAN FOR
THE BEATTY AND CHAVENO PARCELS, (2) AMENDMENT OF
THE VILLAGE CENTER PLANNED UNIT DEVELOPMENT, AND
(3) THE PLANNED UNIT DEVELOPMENT PRELIMINARY PLAN

WHEREAS, on or about July 1, 1991, the County of Eagle,
State of Colorado, accepted for filing applications submitted
by Kensington Land Investment Partners (hereinafter
"Applicant ") for approval of (1) the Zone District Amendment
and the Planned Unit Development Preliminary Plan for
Cordillera Phase II, in and above Squaw Creek Valley,
southwest of Edwards, Colorado ( "Cordillera "), (2) the
Planned Unit Development Sketch Plan for the Beatty and
Chaveno parcels of Cordillera, and (3) the amendment of the
previously approved PUD for Cordillera's Village Center
(collectively, File No. PD- 293- 91 -P); and
WHEREAS, the Applicant requested the approval of a
Planned Unit Development ( "PUD ") Preliminary Plan which would
allow for the development as follows:
There were five parcels included in the Phase
II Preliminary Plan proposal. The Western Parcel,
planned for one eighteen -hole golf course, a
clubhouse, and single family, townhome, duplex and
caretaker units, and employee apartments. The
Northern Parcel, planned for single family,
townhome, duplex and employee units. A Village
Center, planned for townhome units and employee
apartments and dorm rooms. The Chaveno Parcel,
planned for single family units and the Beatty
Parcel, planned for a fishing club, fire station and
employee apartments.
as, described in Exhibits A (map) and B (legal description)
attached hereto; and

WHEREAS, the Applicant subsequently agreed to include the
Southern Parcel in the Cordillera Phase II Planned Unit
Development, planned for single family units; and
WHEREAS, notice of the Beatty and Chaveno Sketch Plan,
the Village Center PUD Amendment, and the Phase II
Preliminary Plan was given to all proper agencies and
departments as required by the Eagle County Land Use
Regulations, Sections 2.17.02(1) and 2.18.02(1); and
WHEREAS, after its public hearings held on September 18,
October 3, October 16 and November 6, 1991, the Eagle and
Colorado Valley Planning Commission (hereinafter based upon
its findings, recommended approval of the proposed PUD Sketch
Plan for the Beatty and Chaveno Parcels, the PUD amendment
for the Village Center, and the Zone District Amendment and
the Phase II PUD Preliminary Plan, with certain conditions;
and
WHEREAS, at its public hearings held on December 17, 1991
and January 7, 1992, the Eagle County Board of Commissioners
(hereinafter "Board "), considered the PUD Sketch Plan for the
Beatty and Chaveno Parcels, the PUD amendment for the Village
Center, the Zone District Amendment and the Phase II PUD
Preliminary Plan, associated plans, and the statements and
concerns of the Applicant, the Eagle County Community
Development and Engineering Staff, and other interested
persons.
BASED ON THE EVIDENCE BEFORE IT, and with the
modifications imposed by the conditions hereinafter
described, THE BOARD FINDS AS FOLLOWS:
1. With respect to the PUD Sketch Plan review for the
Beatty and Chaveno Parcels, the Applicant has complied with
the application requirements set forth in Section 2.14.03 and
2.17.01 of the Eagle County Land Use Regulations (the
"Regulations "). In addition, the Board finds, pursuant to
Section 2.17.02 of the Regulations that the Beatty and
Chaveno Sketch Plans are in general conformance with the
Master Plan; to the extent applicable, with the Edwards sub-
area Master Plan; and with the policies, guidelines, zoning
and other applicable regulations. Furthermore, the resulting
development will not be inconsistent with the Master Plan

objectives. Specifically, with regard to the Master Plan,
the Board finds the development of this project as proposed:
a. to have a full range of public

b. to have a significant economic

The Board further finds that:

listed in Section 2.17.02(1) of the
Regulations, have been considered.
g. the evidence shows that access which is capable
of servicing the development from the state
highway system to the parcels of land proposed
for subdivision can be built by the Applicant.
h. the area around the development can be planned
to be insubstantial harmony with the proposed
PUD
i. no adjacent or nearby communities will be
detrimentally affected by the proposed PUD.
j. the PUD can be completed within a reasonable
period of time, as set forth in the Applicant's
phasing plan.
k. the proposed commercial development within the
proposed PUD is justified.

support the anticipated traffic, and the
development will not overload the streets
outside the planned area.
M. proposed utility and drainage facilities, upon
conformance to the conditions set forth herein,
are adequate for population densities and the
type of development proposed.

2. With respect to the Cordillera Village Center PUD
Amendment, the Board finds, pursuant to Section 2.06.13(11)
of that Regulations, that:
a. as the proposed amendment is consistent with
the efficient development and preservation of
the entire PUD; and
b. the proposed amendment does not affect, in a
substantially adverse manner, either the
enjoyment of land abutting upon or across the
street from the PUD or the public interest; and
C. the proposed amendment is not granted solely to
confer a special benefit on any person.
In addition, the board has reviewed the Village Center
PUD Amendment application under the criteria set forth under
Section 2.14.04 of the Regulations, and according to Section
2.21 of the Regulations.
3. With respect to the Cordillera Phase II Planned Unit
Development Preliminary Plan:
I. The application requirements set forth in Sections
2.14.03 and 2.18.01 of the Regulations were modified, as set
forth in the Board's Resolution 90 -104, dated October 20,
1990, and herein. The Applicant has also met the burden of
proof, and the Commission and the Board have considered the
matters set forth in Section 2.14.04(1) of the Regulations.
II. The Board further finds as follows with respect to the
Cordillera Phase II PUD Preliminary Plan, pursuant to the

Standards and Requirements under Section 2.06.13(2) of the
Regulations:
a. the PUD Plan is in general conformance and is
consistent with the intent of Master Plan, and the
policies therein, and to the extent applicable, it
is in general conformance and consistent with the
Edwards Sub -Area Master Plan.
b. the Applicant has provided design and construction
proof of adequate, safe, and convenient arrangements
for pedestrian and vehicular circulation, off - street
parking and loading space within the PUD.
C. the Applicant has provided sufficient setbacks, lot
widths, and space between buildings, necessary to
provide adequate access and fire protection, to
ensure proper ventilation, light, air, and snow -melt
between buildings, and the PUD is compatible with
other development in the area.
d. the open space in the PUD has been planned to
produce usefulness to the residents of the
development for purposes of recreation, scenery, and
to produce a feeling of openness. All areas
designated as common or public open space are
accessible by proper physical and legal access ways.
The open space areas serve as wildlife migration,
recreation and buffer areas and are more than
efficient to serve those functions. Even to the
extent that further encroachments into those
designated open space areas are necessary to achieve
the densities approved herein, more than adequate
open space exists. The County contemplates that
encroachments into the open space will be necessary
at the time of final plat. Said encroachments shall
maintain the integrity and general intent of the
preliminary plan approval.
e. Central water and sewer facilities are Provided for
within the PUD with the exception of ISDS in the
Chaveno Parcel, and wells and ISDS on the far
western portion of the Western Parcel. By virtue of
Condition 15 of this Resolution, that exception is
acceptable. Said facilities will comply with

applicable Board, Colorado Department of Health and
local health authority requirements.
f. The development has been designed to provide for
necessary commercial and recreational facilities
conveniently located to residential housing.
Provision for educational facilities will be worked
out pursuant to Condition 13 of this Resolution.
g. The development has provided for variety in type,
design and layout of buildings which promote maximum
open space and economy of development.
h. Maximum height of structures has been provided for
in the Cordillera PUD Guide.
III. Pursuant to Section 2.06.13(3) of the Regulations, the
Board has utilized the following criteria in evaluating the
Cordillera PUD Preliminary Plan:
a. The PUD Plan provides for a golf course, common
area, a community park and useable open space, which
substantially exceeds the minimum of 25 percent of
the PUD area to be devoted to open air recreation or
other usable open space, public or quasi- public.
b. The proposed and modified residential density as
within the limits required by the Board, upon
consideration of the Master Plan and the individual
characteristics of the subject land.
C. The density of uses, other than residential, comply
with the limitations set forth by the Board, upon
consideration of the Master Plan in the individual
characteristics of the subject land.
d. Architectural and design standards have been
proposed which are compatible with other units in
the area, yet avoiding uniformity and lack of
variety in structural designs among the PUD.
e. The PUD in designed to provide adequate commercial
and recreational amenities to its residents to
alleviate the necessity of increased traffic and
traffic Congestion. Educational amenities are to be

addressed pursuant to Condition 13 of this
Resolution.
f. The PUD Plan meets the minimum area requirements for
a PUD.
g. The Board is satisfied that the Applicant has
provided for and established an adequate
organization for the ownership and maintenance of
common open space and private roads, drives and
parking. The open space will be managed by a
property owners association and construction staff.
h. The Applicant has provided an employee housing plan
which satisfies Applicant's employees' housing
needs. Forty -six caretaker units and 27 employee
units, apartments or dorm rooms are provided for in
the PUD Preliminary Plan.
IV. In addition to the standard items previously in
subdivision review, the Board, pursuant to 2.06.13(7)(a) of
the Regulations, has considered the following in its review
of the Cordillera Phase II PUD Preliminary Plan, and finds as
follows:
a. The Final Environmental Impact Report submitted
by the Applicant has been reviewed, pursuant to
Section 2.10.05 of the Regulations, and the
Board finds that it is adequate and acceptable.
b. information requested or required by the Board
upon approving the Cordillera Phase II PUD
Sketch Plan has been provided by the Applicant,
has been considered by the Board, and this
Resolution either incorporates or supersedes
those requirements.
C. The application for an appropriate zone change
has been considered by the Board.
d. The Cordillera PUD control document (the
"Guide ") has been submitted, and with the
conditional modifications identified and
approved by the Board herein, this document
will be satisfactory. Once approved, the PUD

Guide must be filed with the Eagle County Clerk
and Recorder.
V. Pursuant to Section 2.18.02(3) of the Regulations
relating to the PUD Preliminary Plan review, the Board has
considered, approved and incorporated the following in its
review of the Cordillera Phase II PUD Preliminary Plan:
a. The Board has considered conformance to the
Cordillera Phase II PUD Sketch Plan and any
information requested or required by the Board
upon approving the Sketch Plan. The PUD Plan
in conformance with the Cordillera PUD Sketch
Plan and the conditions contained therein, and
those conditions have either been satisfied,
incorporated herein, or superseded by the
Conditions contained in this Resolution.
b. The proposed subdivision conforms to all
applicable County regulations, policies and
guidelines.
C. A review of the reports on file, and other
reports as available pertaining to geologic,
soils, wild fire, flood and airport hazards,
mineral resource areas and significant wildlife
areas has been affected, and the Board has
considered and incorporated, where applicable,
the guidelines and recommendations as prepared
by the appropriate agency, to mitigate hazards
and to protect resources.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the application for approval of the Cordillera
Planned Unit Development Sketch Plan for the Beatty and
Chaveno Parcels be and hereby is granted.
THAT, the application for approval of the Amendment
to the Cordillera Village Center Planned Unit Development be
and hereby is granted.
THAT, the application for approval of the Cordillera Zone

District Amendment and the Phase II Planned Unit Development
Preliminary Plan be and is hereby granted for a maximum of
800 residential dwelling units (including the Southern
Parcel, upon satisfaction of Condition 12 herein), including
727 free market units, 27 employee units, apartments and dorm
rooms, and 46 caretaker units. Lodging Units and Commercial
Use shall be allowed as described on Exhibit A. All such
units shall be generally located in the areas depicted on the
maps and charts submitted by Applicant, but may be relocated
to comply with the findings and conditions herein. Said
approval is subject to compliance with the following
conditions:
1. All development within the PUD shall be contained
within the Squaw Creek Valley. Specifically, the
following is not approved:

a. Ridge -top development ;`-
b. Development in the Lake Creek Valley
C. Development visible to the I -70 and Lake Creek
corridor.
2. The visual impact guidelines contained in the Visual
Quality Section of the Environmental Impact Report
for the Village Center and the Western Parcel shall
be included in the PUD Guide.
3. Applicant shall provide public access to the golf
course in addition to private memberships, use by
resort quests and use by homeowners and guests.
4. No sale of real estate will occur in any phase or
subsequent phase until Applicant has either
completed or fully collateralized all
infrastructure, including the golf course.
5. Public access through Cordillera property shall be
provided to the National Forest from West SquaW
Creek Road, provided public access is obtained
through adjoining private lands. The dedication of
said access shall be effected no later than the date
of approval of the Final Plat which contains said
access.
6. A "land survey plat" of the Squaw Creek Road

right -of -way must be submitted and approved by the
County Engineer prior to submittal of a Final Plat.
7. The first organizational meeting of the "Cordillera
Habitat Enhancement for Wildlife" committee shall
meet within 30 days of Preliminary Plan approval and
will perform the commitments and responsibilities
contained in the Final Environmental Impact Report
dated July 1991. Applicant will fund the committee
prior to the submittal of a Final Plat with an
amount sufficient to yield $2,000 annually to cover
the cost of operations. The CHEW committees shall
submit a summary of the following representatives
and as further described in the PUD Guide:
a. The Applicant's representative
b. The biologist designated by the Applicant}
C. The homeowners association's representative
d. The CDOW representative
e. Two adjoining landowners who are affected by
the plan.
The CHEW committee shall submit a summary of the
years activities to the Department of Community
Development by January 1 of each year until the year
2000.
8. Prior to operation of the golf course, Squaw Creek
Road, from the exiting Cordillera entry gate to the
primary access to the golf course, and, the primary
access itself, must be paved. The intersection
improvements at Highway 6 and Squaw Creek Road must
be designed and constructed in accordance with the
Department of Transportation Access Permit. The
County agrees to evaluate the benefits of the
intersection improvements to users with property in
other developments, and to reimburse fees collected,
if any, to Applicant from the other developers, up
to the amount of intersection improvement costs
incurred by Applicant.
9. The Applicant shall be responsible for dust control
on Squaw Creek Road, from the exiting Cordillera
entry gate to the primary Western Parcel access
road, until the pavement is accepted by Eagle
County. The Applicant shall be responsible for dust

control on roads providing construction access to
the Western Parcel and areas subject to golf course
grading.
10. If the proposed sewer line along Squaw Creek Road is
installed, the Applicant will grade a recreation
path along the alignment within Applicant owned
property if logical connections are available on
either end.
11. The Applicant shall make application and pursue
annexation into the fire district by the time Phase
III is initiated. Alternative fire house locations
may be approved by the Board without the requirement
of a PUD amendment.
12. Inclusion of the Southern Parcel within the PUD
shall be accomplished in conformance with this
Resolution and the conditions herein.
13. The Applicant shall work with staff and the Eagle
County School District to dedicate appropriate
acreage for a school site or pay the required fee in
lieu of dedication prior to issuance of a Plat.
14. A comprehensive water supply and sewage disposal
plan shall be prepared by a professional engineer
showing the location of the wells and on -site sewage
disposal systems for Planning Parcel N and the
Chaveno Parcel, in conjunction with Final Plat
applications for Planning Parcel N and Chaveno
Parcel phases.
THAT, the Cordillera Phase II PUD Preliminary Plan
submitted under this application and hereby approved, does
not constitute a "Site Specific Development Plan" as that
phrase is defined and used in C.R.S. 24 -68 -101, at se q.
THAT, pursuant to Section 2.18.03 of the Regulations,
approval of the Cordillera Phase II PUD Preliminary Plan is
extended until a time sufficient to complete the various
phases of the PUD, and, pursuant to Section 2.06.13(10)(b) of
the Regulations, if construction permits have been issued
within three years of the date of final approval of the
Cordillera Phase II PUD Preliminary Plan on a portion of the

property covered by that Plan, and if work is proceeding in
accordance with said permits, the Cordillera Phase II PUD
Preliminary Plan is extended until such time as is reasonably
necessary to complete all phases of the PUD.
THE BOARD further finds, determines and declares that
this Resolution is necessary for the health, safety and
welfare of the inhabitants of the County of Eagle, State of
Colorado.
