BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 92 - n �z
AUTHORIZING ADDITIONAL PAYMENT TO
SHAW CONSTRUCTION PARTNERS, LTD.
IN CONFORMANCE WITH FINAL SETTLEMENT
WHEREAS, final settlement of that certain contract between
SHAW CONSTRUCTION PARTNERS, LTD., and the County of Eagle, State
of Colorado, dated June 25, 1990, pertaining to construction of the
EAGLE COUNTY BUILDING, 500 Broadway, Eagle, Colorado, was scheduled
for Monday, August 26, 1991, before the Eagle County Board of
Commissioners (hereinafter "the Board "); and
WHEREAS, on that date, in public hearing, the Board determined
to table final settlement due to claims for payment having been
received; and
WHEREAS, on September 3, 1991, the Board acknowledged receipt
of claims for payment from Soderberg Masonry in the amount of
$156,072.82, and from Kemp and Co. in the amount of $1,447.02; and
WHEREAS, C.R.S. 38 -26 -107 (2) requires the Board to withhold
sufficient funds to insure the payment of said claims for a period
not to exceed ninety days following the date fixed for final
settlement, unless an action is commenced within that time to
enforce such unpaid claims; and
WHEREAS, ninety days have passed and no such action has been
commenced, and such sums heretofore retained due to said claims
should be paid over to Shaw Construction; and
WHEREAS, due to clerical error, the total amount of the claims
- $157,519.84 - was not retained, and cannot be paid over to Shaw
Construction; and
WHEREAS, the Project Manager recommends that the sum of
$10,000 be further retained to guarantee satisfactory completion
of the mechanical system within the Eagle County Building.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:

THAT, payment to Shaw Construction be authorized as calculated
below:
Amount retained by County
as of 1 -8 -92 $ 153,074
Amount to be further retained
for mechanical system - 10,000
Amount authorized to be paid
to Shaw Construction $ 143,074
THAT, the Project Manager is hereby authorized and directed
to voucher said sum for payment to Shaw Construction.
MOVED, READ AND ADOPTED by the Board of County Commissioners
