RESOLUTION
OF THE
BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION N0. 81-~~~'
DISTRIBUTION OF RECEIPTS FROM THE MINERAL LEASING FUND,
THE FOREST RESERVE FUND AND THE WEED CONTROL DISTRICT FUND
WHEREAS, the Board of County Commissioners of the County
of Eagle, Colorado, hereinafter referred to as the "Board",
had received monies in the 1980 fiscal year from the respective
Federal and State Governments pursuant to the Federal Mineral
Lands Leasing Act, 30 U.S.C. 191 et seg., and the Act of
Congress of May 23, 1980, as amended, relating to receipts
from national forests, 31 U.S.C. 500 et se~C.; and
WHEREAS, the Treasurer of the County of Eagle had placed
such monies in special County funds designated as the "Mineral
Leasing Fund" and the "Forest Reserve Fund", respectively; and
WHEREAS, pursuant to the option of the Board set forth
in § 30-29-101, C.R.S. 1973, as amended, the Board desires to
remit to the Eagle County School District RE50J an amount of
five percent (5%) of the monies placed in the Forest Reserve
Fund; and
WHEREAS, there presently exists monies within a certain
county fund designated as the "Weed Control District Fund" of
which said fund presently serves no purpose by reason that the
County has discontinued the use of the Weed Control District;
and
WHEREAS, the Board has the authority to transfer monies
from the aforementioned County funds to other funds within the
County pursuant to §§ 29-1-101, et seq., 30-25-101, et sec.,
and 34-63-101, et seg. (Mineral Leasing Fund), respectively,
C.R.S. 1973, as amended, and the authority to remit funds to
the School District pursuant to § 30-29-101, C.R.S. 1973, as
amended, (Forest Reserve Fund).
NOW, THEREFORE, be it resolved by the Board of County
Commissioners of the County of Eagle, Colorado:
THAT, the Board hereby requests and directs the Treasurer
of the County of Eagle to transfer the sum of twenty-nine
thousand one hundred thirty-nine dollars and eighty-four cents
($ 29,139.84) from the Mineral Leasing Fund to the County General
Fund.
THAT, the Board hereby requests and directs the Treasurer
of the County of Eagle to transfer the sum of one hundred two
thousand fifty dollars and sixty-eight cents ($ 102,050.68)
from the Forest Reserve Fund to the County Road and Bridge
Department Fund.
THAT, the Board hereby requests and directs the Treasurer
to prepare the necessary documentation and remit to the Eagle
County School District RE50J the sum of five thousand three
hundred seventy-one dollars and nine cents ($ 5,371.09).
THAT, the Board hereby requests and directs the Treasurer
of the County of Eagle to transfer the sum of four hundred
forty-three dollars and fifty-seven cents ($ 443.57) from the
Weed Control District Fund to the County Road and Bridge
Department Fund.
'T'HAT, the Clerk of the Board is hereby directed to
deliver a copy of this Resolution to the Treasurer of the
County of Eagle and any other designated employees of Eagle
County whose duties include the transfer of funds.
THAT, the Board hereby finds, determines and declares
that this Resolution is necessary for the public health,
welfare and safety of the County of Eagle, Colorado.

MOVED, READ AND UNANIMOUSLY ADOPTED by the Board of
County Commissioners, County of Eagle, Colorado, at its
regular meeting held the `~ day of September, 1981.
