RESOLUTION
OF THE
BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION N0. 81-a~
RESOLUTION PERTAINING TO THAT CERTAIN HOTEL AND RESTAURANT
LIQUOR LICENSE HELD BY ROWDY'S PLACE, INC. RELATIVE TO
ROWDY'S PLACE LOCATED AT 1423 STATE HIGHWAY 82, EL JEBEL,
COLORADO
WHEREAS, pursuant to a complaint filed by Mr. Gary
Bates, State Liquor Enforcement Officer, with respect to that
certain hotel and restaurant liquor license held by Rowdy's
Place, Inc. for Rowdy's Place located at 1423 State Highway
82, El Jebel, Colorado, the Board of County Commissioners of
the County of Eagle, Colorado, in its capacity as the Eagle
County Local Liquor Licensing Authority, hereinafter referred
to as the "Board", adopted Resolution No. 81-21 on June 24,
1981, which ordered that a show cause hearing be held to
determine whether the aforesaid liquor license should be revoked
or suspended; and
WHEREAS, prior to such show cause hearing, representatives
of the licensee and Mr. Gary Bates discussed Mr. Bates' complaint
filed with the Board relative to the subject licensed premises
and, based thereon, agreed to a resolution of the subject
matter as set forth in that certain letter dated July 29, 1981,
from B. Lee Schumacher, attorney for the licensee, to Beth A.
Whittier, Eagle County Attorney; and
WHEREAS, pursuant to the recommendations of Mr. Gary
Bates, the Board desires at this time, to dismiss without
prejudice the charges alleged in Resolution No. 81-21 subject
to the fulfillment of those certain conditions agreed to by
the licensee as set forth hereinbelow.
NOW, THEREFORE, be it resolved by the Board of County
Commissioners, County of Eagle, Colorado:
THAT, the Board hereby determines that at this time it
would be in the best interests of all parties involved not to
suspend or revoke that certain hotel and restaurant liquor
license held by Rowdy's Place, Inc. for that certain establish-
ment referred to as Rowdy's Place located at 1423 State Highway
82, El Jebel, Colorado.
THAT, the Board hereby further determines that at this
time those certain charges set forth in Resolution No. 81-21
be dismissed without prejudice subject to the fulfillment of
those certain conditions agreed to by the licensee as follows,
to wit:
1) That the licensee shall keep persons consuming
alcoholic beverages off the porch area of the
subject licensed premises until such time as such
porch area is approved by the Board as part of
the licensed premises;
2) That the licensee shall schedule an appointment
with the Eagle County Sheriff's office to discuss
expectations and guidelines with respect to all
interested parties;
3) That the licensee shall file charges with the
Eagle County Sheriff's office for those offenders
in the subject licensed premises;
4) That the licensee shall keep a closer watch on
those persons which it, in its judgment, feels
have consumed an excess amount of alcohol and
prevent them from imbibing any further;
5) That the licensee shall contact Mr. Glen Curtis,
the local fire marshall, in order to obtain an
occupancy card; and

6) That the licensee shall insure that its doorman
enforces all rules with respect to minor s., inebriated
persons and any disturbances.
MOVED, READ AND UNANIMOUSLY ADOPTED by the Board of
County Commissioners, County of Eagle, Colorado, at its regular
