COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION N0. 81-a~
RESOLUTION SETTING A HEARING TO CONSIDER THE SUSPENSION OR
REVOCATION OF THAT CERTAIN HOTEL AND RESTAURANT LICENSE HELD
BY ROWDY'S PLACE, INC. RELATIVE TO AN ESTABLISHMENT LOCATED
AT 1423 STATE HIGHWAY 82, EL JEBEL, COLORADO
WHEREAS, on February 24, 1981, the Board of County
Commissioners, County of Eagle, Colorado, in its capacity as
the Local Liquor Licensing Authority, County of Eagle, Colorado,
hereinafter referred to as the "Board", approved the application
of Rowdy's Place, Inc. for a hotel and restaurant license
relative to an establishment known as Rowdy`s Place located
at 1423 State Highway 82, E1 Jebel, Colorado, hereinafter
referred to as the "licensed premises"; and
WHEREAS, on June 24, 1981, the Board received information
in the form of a complaint from Mr. Gary Bates, State Liquor
Enforcement Officer of the Liquor Enforcement Division,
Department of Revenue, State of Colorado, relative to the
licensed premises, upon which the Board could conduct a
hearing pursuant to § 12-47-110, C.R.S. 1973, as amended;
and
WHEREAS, such information received from Mr. Bates
pertained to the following activities conducted at the licensed
premises:
-April 19, 1981: disturbance at Rowdy's Place
reported to the Eagle County Sheriff's Department at 0120
hours. No arrests were made.
-April 19, 1981: disturbance at Rowdy's Place
reported to the Eagle County Sheriff's Department at 0140
hours. Disturbance regarded an individual's statements and
actions that he was going to break-up the bar. No arrests
were made.
-June 12, 1981: Colorado State Patrol assisted
in an incident at Rowdy's Place wherein an individual attempted
to push the bartender's vehicle into the river. Individual
was subsequently arrested for DUI.
-June 6, 1981: individual who had been consuming
intoxicating liquor only at Rowdy's Place arrested for DUI
by the Eagle County Sheriff's Department. Breathalizer test
indicated 1.48% alcohol content.
-March 20, 1981: individual who had been consuming
intoxicating liquor only at Rowdy's Place arrested for DUI
by the Eagle County Sheriff's Department. Refused sobriety
test.
-June 12, 1981: Eagle County Sheriff's Department
at 0350 hours reported that Rowdy's Place was serving intoxi-
Gating liquor after operating hours.
-June 6, 1981: report by Eagle County Sheriff's
Department that in the early evening hours, consumption of
intoxicating liquor off the licensed premises at Rowdy's
Place was observed; and
WHEREAS, based upon the above information, the Board
finds that there is probable cause to believe that the licensee,
Rowdy's Place Inc., has violated Regulation 12-47-105.1
(conduct of establishment) of the "Colorado Liquor Code Rules
and Regulations", and § 12-47-128(1)(a), C.R.S. 1973, as
amended, (sale of malt, vinous, or spiritous liquor to a
visibly intoxicated person), § 12-47-128(1)(h), C.R.S.
1973, as amended, (sale or consumption of malt, vinous or
spiritous liquor during prohibited hours and the consumption
of malt, vinous or spiritous liquor off the boundaries of
the licensed premises), and § 12-47-111(1)(a)(VI), C.R.S.
1973, as amended, (employing persons who are not of good
character and reputation satisfactory to the respective
licensing authorities).
NOW, THEREFORE, be it resolved by the Board of
County Commissioners, County of Eagle, Colorado:

THAT, the Board shall hold a hearing on July 7, 1981,
at 1:30 P.M. in the Board of County Commissioners' meeting
room, McDonald Building, 550 Broadway, Eagle, Colorado,
pursuant to § 12-47-110, C.R.S. 1973, as amended, and
Regulation 47-110.1 of the "Colorado Liquor Code Rules and
Regulations" to determine whether the hotel and restaurant
license held by Rowdy's Place, Inc. for the subject licensed
premises should be revoked or suspended pursuant to the laws
and regulations cited above.
THAT, the Board hereby orders Rowdy's Place, Inc.
to show cause at said hearing why the above referenced
license should not be suspended or revoked.
THAT, a certified copy of this Resolution shall be
mailed to Rowdy's Place, Inc. at the address contained in its
license, which shall constitute notice to the licensee of the
above-referenced hearing.
MOVED, READ AND UNAMIOUSLY ADOPTED by the Board of
County Commissioners, County of Eagle, Colorado, at its
regular meeting held the 24th day of June, 1981.
