RESOLUTION OF THE PLANNING COMr1ISSI0N COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION N0. 81- EAGLE COUNTY MASTER PLAN 4 -['7-~l WHEREAS, pursuant to § 30-28-106, C.R.S. 1973, as amended, it is the duty of the Planning Commission of the County of Eagle, Colorado, to make and adopt a Master Plan for the physical development of the unincorporated territory of the County; said Master Plan, with the accompanying maps, plats, charts, and descriptive and explanatory matter, shall show the County Planning Commission's recommendations for the development of the territory covered by the plan and may include: The general location, character, and extent of streets or roads, viaducts, bridges, parkways, playgrounds, forests, reservations, parks, airports, and other public ways, grounds, places, and spaces; the general location and extent of public utilities and terminals, whether publicly or privately owned, for water, Light, power, sanitation, transportation, communication, heat, and other purposes; the acceptance, widening, removal, extension, relocation, narrowing, vacation, abandonment, or change of use of any of the foregoing public ways, grounds, places, spaces, buildings, properties, utilities, or terminals; methods for assuring access to sunlight for solar energy devices; the general character, location, and extent of comr_iunity centers, townsites, housing developments, whether public or private, and urban conservation or redevelopment areas; the general location and extent of forests, agricultural areas, flood control areas, and open development areas for purposes of conservation, food and water supply, sanitary and drainage facilities, flood control, or the protection of urban devel- opment; and a land classification and utilization program; and ___._:~' WHEREAS, the Eagle County Planning Commission, on October 3, 1973, duly adopted a Master Plan for the physical development of the unincorporated terriroty of the County; and WHEREAS, the Eagle County Planning Commission desires to revise and amend the Master Plan adopted in 1973 due to the changes that have occurred in Eagle County during the last seven years, i.e. enactment of zoning and other land use regulations, strong development pressures, etc.; and WHEREAS, the Eagle County Planning Commission, by and through a Master Plan Steering Committee consisting of forty citizens representing various areas of the County and the County's Department of Community Development, has made careful and comprehensive surveys and studies of the existing conditions and probable future growth of the territory within the County's jurisdiction; and WHEREAS, as a result of such surveys and studies, the °Eagle County Planning Commission, with assistance from the Master Plan Steering Committee and the County's Department of Community Development, has prepared a revised County Master Plan with the general purpose of guiding and accomplishing a coordinated, adjusted, and harmonious development of the county which, in accordance with present and future needs and resources, will best promote the health, safety, morals, ~~ order, convenience, prosperity, or general welfare of the inhabitants, as well as efficiency and economy in the process of development, including such distribution of population and of the uses of land for urbanization, trade, industry, hab- itation, recreation, agriculture, forestry, and other purposes as will tend to create conditions favorable to health, safety, energy conservation, transportation, prosperity, civic activities, and recreational, educational, and cultural opportunities; will tend to reduce the wastes of physical, financial, or human resources which result from either excessive congestion or excessive scattering of population; and will tend toward an efficient and economic utilization, conservation, and production -2- s of the supply of food and water and of draina;e, sanitary, and other facilities and resources; and WHEREAS, said revised Master Plan has been considered at numerous public meetings before the Master Plan Steering Committee and the Eagle County Planning Commission, and at open houses held throughout the County by the County's Department of Community Development. NOW, THEREFORE, be it resolved by the Planning Com- mission of the County of Eagle, Colorado: A. That the Eagle County Master Plan as set forth in Exhibit "A" attached hereto and incorporated ~' herein by this reference, be and the same is hereby adopted for the physical development of the unincorporated territory of Eagle County. B. That this Resolution and said Master Plan shall be known and referred to as the "Eagle County Master Plan". C. That the Open Space Plan for Eagle County adopted February 6, 1980, by the Eagle County Planning Commission, is hereby adopted by this reference as part of the Eagle County Master Plan and incorporated herein as if set forth in full herein. Said Open Space Plan shall be available in the Department of the Community Development, County of Eagle, McDonald Building, 550 Broadway, Eagle, Colorado, 81631. D. That this Resolution and said Master Plan shall take effect and be in force immediately upon its adoption by the Eagle County Planning Commission. E. That the Eagle County Master Plan adopted in 1973 and the provisions thereof in conflict herewith are hereby repealed and superceded by this Resolution and the Master Plan attached hereto. -3- y F. That if any provision of this Resolution and the Master Plan attached hereto shall be held invalid, its invalidity shall not affect any other provisions of this Resolution and said Master Plan that can be given effect without the invalid provision, and for this purpose the provisions of this Resolution and said Master Plan are hereby declared to be severable. G. That pursuant to § 30-28-109, C.R.S. 1973, as amended, an original copy of this Resolution together with said Master Plan shall forthwith be certified and transmitted to the Board of County Commissioners, County of Eagle, Colorado. H. That the Eagle County Planning Commission hereby determines and finds that this Resolution and said Master Plan are necessary for the health, safety and welfare of the citizens of Eagle County, Colorado. MOVED, READ AND UNANIMOUSLY adopted at a regular meeting of the Planning Commission of the County of Eagle, Colorado, held this lst day of April, 1981.
