RESOLUTION
OF THE
BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION N0. 81- g
RELEASE OF COLLATERAL - FINAL PLAT OF SOUTH SCOTTSVILLE
SUBDIVISTON
WHEREAS, the Board of County Commissioners, County
of Eagle, Colorado, hereinafter referred to as the "Board", at
a regular meeting held on the 30th day of July, 1980, approved
the final plat of South Scottsville Subdivision; said final
plat being recorded in Book 306 at Page 421 of the property
records of the County of Eagle, Colorado; and
WHEREAS, as a condition of final plat approval, the
subdividers of South Scottsville Subdivision entered into a
Subdivision Improvements Agreement dated July 30, 1980, and
recorded in Book 311 at Page 876 of the property records of the
County of Eagle, Colorado; and
WfiEREAS, as a condition of final plat approval of
South Scottsville Subdivision, a plat restriction was placed
on said final plat which stated:
"No lots within said subdivision shall be sold and/or
conveyed until all public improvements referred
to in the Subdivision Improvements Agreement dated
7/30/80 are approved and accepted by the Board of
County Commissioners"; and
WHEREAS, on the 7th day of November, 1980, the Board,
upon the request of the subdividers, deleted said plat restriction
from the final plat of South Scottsville Subdivision and substi-
tuted thereto, a cash deposit in the name of the County of Eagle,

Colorado, in the amount of eight thousand dollars ($ 8,000.00)
to guarantee the satisfactory completion of those certain public
improvements set forth in the Subdivision Improvements Agreement
referred to herein; and
WHEREAS, the Subdividers have fulfilled the terms of
said Subdivision Improvements Agreement and desires the release
of said cash deposit in the amount of eight thousand dollars
($ 8,000.00).
NOW, THEREFORE, be it resolved by the Board of County
Commissioners, County of Eagle, State of Colorado:
THAT, the Board hereby releases that certain cash
deposit in the amount of eight thousand dollars ($ 8,000.00)
submitted to the Board by Land Title Guarantee on November 13,
1980, on behalf of the Subdividers, pursuant to Resolution No.
80-61 duly executed by the Board on November 7, 1980.
THAT, the release of said cash deposit is pursuant
to the satisfactory completion of those certain public improve-
ments as set forth in that certain Subdivision Improvements
Agreement dated July 30, 1980.
THAT, the Board hereby finds, determines and declares
that this Resolution is necessary for the public health, welfare
and safety in the County of Eagle, State of Colorado.
MOVED, READ AND UNANIMOUSLY ADOPTED at a regular meeting
of the Board of County Commissioners, County of Eagle, Colorado,
