HomeMy WebLinkAboutR20-035 Third Extension of the COVID-19 Local Disaster Emergency DocuSign Envelope ID:8E547E58-B79F-435B-807D-5C49EC269C04 McQueeney Commissioner moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO.2020-035 THIRD EXTENSION OF THE EAGLE COUNTY COVID-19 LOCAL DISASTER EMERGENCY WHEREAS, on March 6, 2020, Eagle County Public Health and Environment confirmed its first case of COVID-19 within the county. Over the following weeks, Eagle County has seen significant numbers of cases of the illness, as well as seven fatalities to date. Federal, state, and local authorities continue to take action to address the emergency; and WHEREAS,on March 6, 2020,the Eagle County Manager declared a local disaster emergency; and on March 10, 2020 and by Resolution 2020-21,the Board extended the local disaster emergency because the conditions that spurred the declaration had not abated; and WHEREAS, on March 14, 2020, the Eagle County Public Health Director issued an order directing that the Board take action to preserve essential county functions and, therefore, on March 16,the Board issued Resolution 2020-22 closing county buildings until April 9, 2020; and WHEREAS, on April 6, 2020, the Director extended the public health order related to preserving essential county functions to April 30, 2020, and on April 7, 2020 and by Resolution 20-29,the Board extended the local disaster emergency and the terms and conditions of Resolutions 20-21 and 20-22 to April 30, 2020; and WHEREAS, on April 27,2020 the Director issued a public health order providing authority and direction to individuals and businesses as to the first phase of reopening the community under the Eagle County Plan for Sustaining Social Distancing (the"Phase I Order"); and WHEREAS, on April 27, 2020,the Director issued a public health order superseding the previous order as to preserving essential county functions, directing the Board to continue preserving essential county functions and providing that the Board may develop and implement a plan for reopening county buildings that is compatible with the Phase I Order; and WHEREAS, pursuant to C.R.S. § 24-33.5-709(1)"A local disaster may be declared only by the principal executive officer of a political subdivision. It shall not be Page 1 DocuSign Envelope ID:8E547E58-B79F-435B-807D-5C49EC269C04 continued or renewed in excess seven days except by or with the consent of the governing board of the political subdivision;"and WHEREAS,the conditions that spurred the County Manager to declare and the Board to ratify and twice extend the local disaster emergency still continue to pose a serious threat to the health and safety of the citizens of Eagle County; and WHEREAS, "The effect of a declaration of local disaster emergency is to activate the response and recovery aspects of any and all applicable local and interjurisdictional disaster and emergency plans and to authorize the furnishing of aid and assistance under such plans."C.R.S. § 24-33.5-709(2); and WHEREAS, extending the local disaster emergency and continuing to operate under Eagle County's emergency operations plan will allow a more effective response; and WHEREAS, continuing to preserve essential county functions while developing and implementing a plan for the phased reopening will protect the health, safety, and welfare of the citizens of Eagle County. NOW,THEREFORE, BE IT RESOLVED by the Board of Commissioners of Eagle County, Colorado: THAT, the Eagle County Board of County Commissioners confirms, determines, and declares that the presence and likelihood of additional cases of the COVID-19 virus within Eagle County and the State or Colorado constitute a local disaster emergency that warrants continuing the emergency response and furnishing aid and assistance to affected portions of the community. THAT,the local disaster emergency related to COVID-19, and all terms and conditions in Resolution 2020-21,will continue until May 31, 2020, unless sooner amended, extended, or rescinded by the Board. THAT, this Resolution supersedes Resolution 2020-22 and appropriate Eagle County staff should work with all relevant departments and stakeholders to develop and implement plans to safely and incrementally open county buildings to non-essential staff and the public in accordance with the directives in the Phase I Order. THAT, until such time as the plans to reopen county buildings are implemented: 1. All Eagle County buildings, excepting Eagle County courthouses,the Eagle County Sheriff's Office, and any Sheriffs substations continue to be closed to the public. 2. All elected officials occupying Eagle County buildings and all department heads in Eagle County should continue taking the actions necessary to provide essential public services to the public via the internet or by telephone. For Eagle County courthouses,the Eagle County Sheriffs Office, and any Sheriffs substations, the Board continues to delegate the authority necessary for the 5th Judicial District and the Sheriffs Office to each adopt policies and restrictions for their offices or the buildings that house their offices to ensure the public is provided access to their essential services. THAT,this Resolution and Declaration shall be promptly filed with the Eagle County Clerk and Recorder and with the Office of Emergency Management. THAT,this Resolution and Declaration is necessary for the public health, safety and welfare of the citizens of the County of Eagle, State of Colorado.
