Upper Eagle Regional Water Authority and Eagle River Water &
Sanitation District
WHEREAS, Eagle River Water and Sanitation District and Upper Eagle Regional
Water Authority, (together referred to as "District/Authority") are quasi-municipal
corporations and political subdivisions of the state of Colorado; and
WHEREAS, pursuant to C.R.S. § 24-33.5-709(1) a local disaster may be declared
by the principal executive officer of a political subdivision for up to seven days, and
then must have consent from the Board of Directors; and
WHEREAS, the effect of a declaration of local disaster emergency is to activate the
response aspects of any and all applicable local and interjurisdictional disaster and
emergency plans and to authorize the furnishing of appropriate processes and
activities under such plans, pursuant to C.R.S. § 24-33.5-709(2); and
WHEREAS, the Coronavirus, a/k/a COVID-19, constitutes a public health emergency
of International concern, has been determined to be present in Eagle County, and
continues to spread significantly and quickly, requiring additional emergency
preparation and execution of procedures to minimize its impact and protect the public
health safety and welfare of District/Authority staff and Constituents; and
WHEREAS, Linn Brooks as Principal Executive Officer of District/Authority declared,
pursuant to the above, a Local Disaster Emergency on March 13, 2020, for a period
of seven days; the District and Authority boards extended the declaration on March
20, 2020; and wish to indefinitely extend the declaration; and
NOW, THEREFORE, BE IT RESOLVED that the Chairs of the Boards of the
District and Authority do declare the local disaster emergency continues and
extend the declaration indefinitely, effective March 26; and will continue with the
preparation for and execution of procedures necessary to deal with the emergency.
Unanimous Consent of the above Local Disaster Declaration was given in a formal
meeting of the Board of Directors of the Eagle River Water and Sanitation on March 26,
2020.
