Summary of Written Comments FOR Ballot Issue No. 6A:
● The Eagle Valley Library District ("EVLD") ballot measure 6A would
not raise any new taxes but simply permit the EVLD to change its
mill rate each year to retain property tax revenues, which wo uld
otherwise be lost because of the operation of the Gallagher
Amendment.
● The Gallagher Amendment lowers residential property tax rates
based on statewide residential property assessments, without any
consideration for local county needs or assessments. In recent
years, the large increases in the residential property assessments
on the Front Range have triggered the Gallagher Amendment
causing significant problems for all service providers that rely on
property taxes to operate.
● EVLD operates on a sensible and affordable revenue and expense
model with notable efficiency.
● In the past few years, the EVLD has not received all of the revenues
that would have been available to it without the operation of
Gallagher. The district has met the challenge this presented, but if
this trend continues, the EVLD will face cutting services to the
community.
● In a recent community survey, the EVLD validated that the residents
of Eagle County know about, use, and value the services provided
by the EVLD. In 2018 there were 315,995 visits to our three libraries
and 292,301 items checked out. We believe the residents of Eagle
County want to keep the library services they now enjoy.

*If the ballot issue is approved, the mill levy may be raised in the 2020
collection year and thereafter to offset reductions in the ratio used to
determine the assessed valuation of residential property. It is intended
that any increase in the mill levy will be revenue neutral to the District in
the year in which the mill levy is increased.
† Since mill levy increases may occur in more than one year in the future,
this good faith estimate is for fiscal year spending in 2020. It is difficult to
make an estimate of fiscal year spending for any future year beyond 2020

Summary of Written Comments IN FAVOR of Ballot Issue 6B:
A "YES" vote on issue 6B would allow the Eagle County Paramedic
Services to avoid looming cuts to emergency staff created by the state's
Gallagher Amendment funding formula.

It would also provide a more reliable and predictable source of funding for
emergency medical service in the Eagle County.
This is important because:
1. Approving 6B will prevent cuts to paramedics and ambulances at a
time when Eagle County is growing and the number of emergency calls
is increasing as it grows. Paramedic Services operates 24/7/365 and
handled 5,200 calls. That number will only increase as the county grows.
2. Public safety is of paramount importance to the residents of Eagle
County.
3. Voting "YES" on 6B will allow the local district to continue to
responsibly manage its own funding and remove the funding constraints
imposed by the state's Gallagher Amendment. The district has operated
within its budget, but new reductions in the amount of money the district
receives are projected to be $990,000 or around 8% of their $13 million
budget by 2022. This will require cuts to the numbers of paramedics and
ambulances, a likely decline in service levels and continued challenges
to meeting the safety needs of a growing area.
4. Voting "YES" on 6B will allow the district to keep pace with area growth
and its service demands. It will remove the unanticipated funding
constraints the Gallagher Amendment imposes on the district. It will also
have the added benefit of allowing the district to replace aging
ambulances and other equipment.
5. The district board of directors has responsibly managed its budget, but
now it needs voter approval to surmount the challenges of the Gallagher
Amendment.

SHALL EAGLE COUNTY TAXES BE INCREASED BY UP TO FOUR
MILLION FIVE HUNDRED THOUSAND DOLLARS IN 2020 AND BY
SUCH AMOUNTS AS MAY BE GENERATED ANNUALLY
THEREAFTER BY THE IMPOSITION OF NEW TAXES AS FOLLOWS:
BEGINNING JANUARY 1, 2020, THERE SHALL BE A NEW
TAX OF TWENTY CENTS PER CIGARETTE OR FOUR DOLLARS PER
PACK OF TWENTY CIGARETTES SOLD; BEGINNING JANUARY 1,
2020, THERE SHALL BE A NEW SALES TAX OF 40 PERCENT ON THE
SALES PRICE OF ALL OTHER TOBACCO AND NICOTINE
PRODUCTS;
THE TERMS "CIGARETTE," "TOBACCO PRODUCT" AND "NICOTINE
PRODUCT" HAVE THE SAME MEANINGS AS IN SECTION 18-13-121
OF THE COLORADO REVISED STATUTES;
THE TAX REVENUES SHALL BE USED FOR THE SPECIFIC
PURPOSES OF PUBLIC HEALTH PROGRAMS AND EDUCATION,

• REDUCING TEEN VAPING THROUGH EDUCATION ABOUT THE
HARMFUL CONTENTS OF FLAVORED NICOTINE PRODUCTS THAT

PRODUCTS, E-CIGARETTES AND TOBACCO PRODUCTS TO

• PROVIDING SERVICES THAT PROTECT AND IMPROVE PUBLIC
HEALTH SUCH AS SUBSTANCE ABUSE AND OTHER SERVICES;

Summary of Written Comments in SUPPORT of Ballot Issue 1A:
Issue 1A will help Eagle County support public health programs and
protect our citizens, especially youth and teenagers, from the harmful
impacts of tobacco, nicotine and vaping.
The Eagle County Commissioners placed Issue 1A on the ballot—asking
voters to approve a sales tax of $4 per cigarette pack and 40 p ercent on
other nicotine and vaping products. A new state law gives Eagle County
Commissioners the authority to take this action.
The Commissioners also increased the legal age to purchase tobacco
and nicotine products to 21 years old in Eagle County. The County will
license tobacco retailers to ensure this age restriction is enforced. Two
Eagle County communities—Avon and Basalt—have already taken both
steps on their own.
Research shows that increasing the price of these dangerous products—
combined with raising the purchasing age—are the best tools available to
Eagle County to keep cigarettes and vaping products out of the hands of
our kids.
Eagle County and the state of Colorado are learning about the perils of
vaping — the “e-cigarette” devices that inject high-nicotine vapor and
other toxins into users’ lungs — and how it has become the nicotine
product of choice for teenagers. Vaping is quickly spreading among teens
in Eagle County, and the rate of teen vaping has climbed to alarming
levels in our community.
A recent U.S. Centers for Disease Control and Prevention study found
that Colorado has the highest vaping rate among 37 states surveyed—
with Colorado teens vaping nicotine at twice the national average. Here

in Eagle County, according to the November 2017 Healthy Kids Colorado
survey, both cigarette and vaping use by teens is on the rise.
• 39.3 percent of Eagle County high schoolers reported use of
vaping products within the past 30 days, compared to 27.1
percent in 2015.
• 13.1 percent of Eagle County high schoolers reported smoking
cigarettes within the past 30 days, compared to 10.5 percent in
2015.
While the dangers of cigarettes are well known, data is just starting to
emerge on the threat posed by vaping. Its impact on developing minds
and bodies is becoming clearer from research into the heavy metals,
carcinogens and high concentrations of nicotine ingested from vape
aerosol. According to the American Association of Pediatrics, vaping
products can have two times the amount of nicotine in cigarettes, making
quitting even harder.
Issue 1A and the County’s Tobacco 21 age restriction will not apply to
nicotine-replacement therapies that have been approved by the Food and
Drug Administration, including patches and chewing gums. E-cigarettes
and vaping products are not FDA-approved cessation devices. Eagle
County citizens hoping to stop smoking can still contact the Quitline at
800-QUIT-NOW for trained counseling and support.
Issue 1A will allow Eagle County to protect our children and teenagers
while making our community healthier. Let’s put a stop to the harmful and
addictive impacts of cigarettes, tobacco and vaping. Please be sure to
Vote Yes on Issue 1A.
Summary of Written Comments in OPPOSITION of Ballot Issue 1A:
In general I support this tax, but I feel the amount being proposed is
excessive. I think $4.00 per pack is too much to place on smokers who
have the right to choose to smoke, or not. I think half that would be fair
and meaningful to the important message of smoking is bad for your
health. I think this excessive amount might guarantee its defeat; thus a
loss to our health programs.
I think no vaping products should be sold to those underage and in fact,
due to the current dangers being contributed to vaping, I think they should
be banned, especially in our pharmacies, a place selling products to better
our health.

Summary of written comments FOR Ballot Issue 3A:
Voting Yes on Issue 3A will allow the Town of Basalt to maintain its
existing level of operations and move forward with a transparent and fiscal
process. By approving Issue 3A, Basalt voters will make certain that our
Town continues to provide the services that we depend on, such as police
and public safety, fire and flood prevention, street repairs, snow plowing
and park maintenance.
Issue 3A simply sets Basalt’s property-tax rate at 5.957 mills—the 2019
rate being collected by the Town to provide essential services. The Town
discovered an error in how it previously set its property-tax rate, which
likely was a violation of Colorado’s TABOR law. That has since led Basalt
Council to refund tax dollars collected, and to send this question to Town
voters to resolve this issue and move forward.
The Town of Basalt has taken many steps over the past year to build a
strong financial-oversight process within our local government. Those
actions include:
• Creating a citizen-led Finance Advisory Board to provide oversight on
the Town’s budget and to involve community members in Basalt’s fiscal
management.
• Improving the Town’s financial position through debt reduction and
other prudent fiscal-management measures.
• Creating distinct accounts within the budget to allow for greater
transparency and understandability in the reporting of funds.
Basalt followed through on its commitment to its taxpayers when the
property-tax procedural error was discovered. The Town’s manager and
finance director quickly alerted Council and the public about this situation,
hosted community meetings, conducted a community survey and
provided regular reports as the Town worked to resolve this issue. In
addition, the Town completed its annual audit this summer, including a
review of past audits and corrections that needed to be made to previous
fiscal years.
With these steps, as well as Town Council’s commitment to transparency
and accountability, Basalt taxpayers can feel very confident in the
stability, transparency and accountability of our Town’s operational and
fiscal management.
That is why we need to support Issue 3A on the November ballot. Issue
3A is not a tax increase. The Town’s current property-tax rate is 5.957,
and Issue 3A does not raise that rate. State law prescribes how this
question to voters must be worded. Currently, property tax is about 15
percent of Basalt’s General Fund; it is the most stable revenue that Basalt
receives in order to effectively provide essential services.
Without passage of 3A, Basalt would likely be required to significantly
reduce its property-tax rate. That reduction would require the Town to
reduce or eliminate several critical services to balance its budget.
Reducing services like police, street maintenance and recreation
programs will hurt our community.
Let’s work together to support Issue 3A. Voting Yes on 3A will ensure that
the Town of Basalt continues to be a great place to live, work and enjoy
a high quality of life. Please vote Yes on Issue 3A this Election Day.
Summary of written comments AGAINST Ballot Issue 3A:
We are concerned that the Town Council is not serious about controlling
expenses when we heard about all the programs they were not giving up
after all the trouble they were in with the Tabor tax. We listened in as they
approved things they could do without such as the bridge to nowhere, and
park improvements in Arbaney Park. When we received our taxes last
year, we could not believe the jump. We have always provided low cost
rent to employees in the valley, but had to ask for an additional $100
dollars a month from our renters, and we ate the rest of the taxes. We
know when $2 million properties sell in town, our mill levy – even set at
last year – will go up. We will vote against an increase. Learn to live with
what you have, council!
