A —Basalt CO 81621 District Facsimile Number: (970) 927-1017 District Email: mvmd(c�sopris.net Division of Local Government —Department of Local Affairs — 2020 Election Revised/Updated 9/90/2019 ' �: 1 1 � � � !� • • • WHEREAS, the Mid Valley Metropolitan District (the "District") is a Colorado special district formed and functioning by authority of C.R.S. § 32-1-101 et seq., providing water and sanitary sewer services to the area in and around El Jebel, in Eagle and Garfield Counties, Colorado; and WHEREAS, the terms of office of two seats and appointment to fill vacancy in one seat on the Board of Directors of the District will expire upon the regular District election to be held on May 5, 2020 (the "Election"); and WHEREAS, in accordance with the provisions of the Special District Act, C.R.S. § 32-1-101, et seq. (the "Act"), and the Colorado Local Government Election Code, C.R.S. § 1-13.5-101, et seq. (the "Code"), the Election must be conducted to elect three directors to serve a term of three years on the Board of Directors of the District; and WHEREAS, pursuant to C.R.S. § 32-1-804(2), the Board of Directors of the District is authorized to designate a Designated Election Official to exercise the authority of the Board of Directors in conducting the Election; and WHEREAS, pursuant to C.R.S. § 1-13.5-513, the Board of Directors can authorize the Designated Election Official to cancel the election upon certain conditions. 1. The regular election of the eligible electors of the District shall be held on May 5, 2020, between the hours of 7:00 a.m. and 7:00 p.m., pursuant to and in accordance with the Act, the Code, and other applicable laws. At that time, three directors will be elected to serve athree-year term on the Board of Directors of the District. Pursuant to C.R.S. � 1-13.5-111, the date of regular special district elections will change to May of each odd - numbered year commencing in May 2023. In connection therewith, C.R.S. § 32-1-305.5(3)(b) adjusts the length of terms served by directors elected in 2020 and 2022 to three years in order to implement the new election schedule. 0 2. The Election shall be a polling place election. There shall be one election precinct for the convenience of the District's eligible electors, the boundaries of which shall be identical to the boundaries of the District. There shall be one polling place at the following location and address: Eagle County Community Center 0020 Eagle County Drive El Jebel, Colorado 81623 situate in the County of Eagle, State of Colorado. 3. The Board of Directors hereby designates Debra Krueger as the Designated Election Official of the District for the Election, and hereby authorizes and directs her to proceed with any action necessary or appropriate to effectuate the provisions of this Resolution and of the Act, Code, or other applicable laws. The Election shall be conducted in accordance with the Act, the Code, and other applicable laws. 4. The Board of Directors hereby authorizes and directs the Designated Election ®fficial to cancel the Election and declare the candidates elected if at the close of business on March 3, 2020 (the sixty-third day before the Election) there are not more candidates for director than offices to be filled at the Election, including candidates timely filing affidavits of intent to be a write-in candidate. 5. If the Election is cancelled as provided in paragraph 4 above, the Board of Directors further authorizes and directs the Designated Election ®fficial to publish a Notice of Cancellation of Election and to post a copy of the Notice at the polling place location, in the office of the Designated Election ®fficial, and in the ®ffices of the County Clerk and Recorder of Eagle and Garfield Counties. The Notice and a copy of this Resolution shall also be filed with the Division of Local Government. 6. Any and all actions previously taken with respect to the 2020 Regular District Election by the Designated Election ®fficial, the Secretary of the Board of Directors, or any other person acting on their behalf pursuant to the Act, Code, or other applicable laws are hereby ratified and confirmed. 7. If any paragraph, section, or provision of this Resolution is adjudged to be unenforceable or invalid, such judgment shall not affect, impair, or invalidate the remaining provisions of this Resolution, it being the Board of Directors' intention that the various provisions hereof are severable. 8.
