This being a scheduled Public Hearing, the following items were presented to the Board of County
Commissioners for their consideration:
Commissioner Updates
Commissioner Chandler-Henry reminded everyone that it was Fair and Rodeo week. Judging for 4-H and
open class projects begins today. She encouraged everyone to take part in the festivities.
Chairman McQueeney reflected on the past week and the goals of civility, collaboration, and innovation.
She recently attended a Community Integration Collaborative meeting which brought people together from law
enforcement, non-profits, and the school district to talk about how to best serve the community. She also
commented on the help from the community during the recent flooding in Red Cliff.
County Manager Updates
Angelo Fernandez highlighted the 80th Annual Fair and Rodeo event schedule.
Constituent Input
Chairman McQueeney opened and closed constituent input, as there was none.
Commissioner Scherr moved to adjourn as the Eagle County Board of County Commissioners and re-
convene as the Eagle County Board of Equalization
Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous.
Eagle County Board of Equalization
1. Resolution 2019-048 Regarding Petitions to the Eagle County Board of Equalization 7-23-19
Executive Summary: Taxpayers who chose to appeal Eagle County Assessor's 2019 valuation(identified on the
list of CBOE appeals attached hereto as Exhibit"A") were set for hearing before the Board of County
Commissioners of Eagle County, organized and convened as the County Board of Equalization for the purposes of
adjusting, equalizing, raising or lowering the valuation for assessment of real and personal property within this

county, fixed and made by the County Assessor for the year 2019.The Board appointed independent Referees to
conduct hearings and to make findings and submit recommendations to the County Board of Equalization for its
final action, based upon testimony and evidence presented by the Petitioners and the Assessor's representatives with
regard to said petitions.The Referees have recommended adjustments of value or no adjustment of value or the
parties have stipulated to a value with respect to those petitions identified. The signatures of the Board are
requested upon consideration and approval of the recommendations of the referees.
Mr.Treu stated that this was the second round of appeals. He expected three or four more.
Commissioner Chandler-Henry added her thanks to everyone working on them.
Commissioner Chandler-Henry moved to approve the resolution regarding partitions to the Eagle County
Board of Equalization 7-23-19.
Commissioner Scherr seconded the motion. The vote was declared unanimous.
Commissioner Scherr moved to adjourn as the Eagle County Board of Equalization and re-convene as the
Eagle County Board of County Commissioners. .

Business Item
1. AFP-7392Brush Creek Valley Ranch Open Space

Executive Summary:
The Conservation Fund,working with Eagle County, successfully completed the purchase of the 1,540-acre Brush
Creek Valley(the"Property") in July 2017. On December 14, 2017,the Conservation Fund conveyed the Property
to Eagle County and a conservation easement was granted to the Eagle Valley Land Trust. The completion of this
conservation easement permanently protects the Property and adds the Property to Eagle County's Open Space
Program.
The Property will be managed for agricultural and ranching qualities, protection of water rights, critical wildlife
habitat and preservation of scenic vistas. Public recreation will be added in the coming years,which may include
trail connections to adjacent BLM land, a paved path connection between Salt Creek and the Town of Eagle, and
fishing access to Brush Creek. The Property is comprised of the approximately 1029 acre Adam's Rib Ranch and
520 acres of adjacent land situated within the Frost and Salt Creek Planned Unit Development(the"PUD"), known
as the Salt Creek Development Area. The Salt Creek Development area, also referred to as Parcel 1 in this staff
report, is the focus of the Amended Final Plat. The PUD Amendment and Zone Change were approved on July 2,
2019, by the Board of County Commissioners.
An Amended Final Plat(AFP) file is necessary to define Parcel 1 as a new independent parcel and to remove
various plat notes relevant to the PUD which will no longer apply.
Diane Mauriello stated that this was the final piece of the process to remove the Salt Creek portion of the
Brush Creek Valley Ranch Open Space and re-plat it so the zoning would be consistent.
Dominic Mauriello, Mauriello Planning Group, stated that some irrelevant plat notes would be removed,
and the amendment would not change anything with respect to adjoining property owners. He indicated that the
amendment complied with all the criteria and was consistent with the open space plan and staff recommended
approval.
Commissioner Chandler-Henry asked how many different parcels were included in the Brush Creek Valley
Ranch.
Ms. Mauriello stated that staff looked at it as three separate parcels.

Commissioner Chandler-Henry moved to approve Eagle County File No.AFP-7392, Amended Final Plat
for Brush Creek Valley Ranch and Open Space, authorizing the Chair to sign the plat as presented, based upon
staffs reported findings and recommendations.
Commissioner Scherr seconded the motion. The vote was declared unanimous.
Eagle County Housing and Development Authority— Recorded Work Session
1. Semiannual joint meeting with the Eagle County Housing and Development Authority and the Advisory
Committee
Executive Summary: The Eagle County Housing and Development Authority meets twice per year with the Eagle
County Housing and Development Authority to discuss updates across the county in regards to housing efforts.
The discussion will include updates on Two 10 @ Castle Peak, 6 West Apartments, Spring Creek Apartments and
more.

Planning Files
1. LUR-009043-2019 ECLUR Process Improvement Amendment
Morgan Beryl, Community Development Director, and Kris Valdez, Senior Planner
Executive Summary: The focus of this Eagle County Land Use Regulation (ECLUR) amendment is improving
internal and external processes as well as to include certain new provisions to coincide with amendments to
Colorado Revised Statutes and Federal Law. The primary goals of this amendment include:
• Improve Transparency for Pubic Processes
• Clarify Expectations and Process Predictability
• Time Savings for Staff and Applicants
• Improve Project Outcomes
• Improve Customer Service Quality
• Reduce Unnecessary Burden on Applicants
Ms. Beryl explained the reasoning behind the amendment process. She provided some background behind
the process overview. She talked about the responses received and how staff responded accordingly. An Eagle
County Planning Commission was held on July 10, 2019, and the amendments to the Land Use Regulations
received a unanimous recommendation of approval. The Roaring Fork Valley Regional Planning Commission
reviewed the amendments on July 11, 2019 and unanimously recommended approval. Staff recommended
approval of the proposed changes.
Chairman McQueeney opened public comment.
Laura Smith resident of the Roaring Fork Valley expresses some concerns for the process. The Planning
Commission meeting was helpful. She offered suggestions related to the efficiency of the process, public notice,
expanding the radius for notices, and the time frame being extended to allow more time for the public to respond to
the material being provided by staff.
Mr. Mauriello, Mauriello Planning Group, understood that the code was at times difficult to understand. He
supported the review. He understood the importance of public notices but found it difficult to provide notices early

due to the inability to determine the hearing date early. He expressed some concern with the idea of an application
being withdrawn within a certain period of time.
Chairman McQueeney closed public comment.
Commissioner Scherr wondered if additional language could be added.
Beth Oliver, Deputy County Attorney, stated that if the board wanted to include any proposed language,
they could include it in the motion.
Commissioner Chandler-Henry supported the revised version.
Chairman McQueeney supported the amendments and believed they allowed staff to provide a complete
file.
Ms. Oliver referred to the section related to interpretations and stated that there was a minor change
needing to be made related to "methodology".
Chairman McQueeney thanked Ms. Smith for her comments but stated that at this point her comments
would not be incorporated at this time.
Commissioner Chandler-Henry appreciated the checklist and believed it was helpful.
Commissioner Scherr thanked Ms. Smith for taking the time to attend the meeting. The county would be
doing a lot more of this type of work and understood that the nature of the process could be cumbersome.
Chairman McQueeney thanked Ms. Beryl and her staff for their work on the Land Use Regulations.
Commissioner Chandler-Henry moved to approve file no. l.I1R-009043-2019, ECLUR Process
Improvement Amendment with subsection G amendment.
Commissioner Scherr seconded the motion. The vote was declared unanimous.
