HomeMy WebLinkAboutMinutes 07/09/19 PUBLIC HEARING July 9, 2019 Present: Kathy Chandler-Henry Chairman Pro-Tem Matt Scherr Commissioner Jeff Shroll County Manager Brian Treu County Attorney Beth Oliver Deputy County Attorney Kathy Scriver Deputy Clerk to the Board Absent: Jeanne McQueeney Chairman This being a scheduled Public Hearing, the following items were presented to the Board of County Commissioners for their consideration: Commissioner Update Commissioner Scherr stated that Senator Michael Bennet's Mountain Representative, Matt Ricker would be in the Avon Library from 2:30 to 7:30 pm if anyone had a pressing issue. He encouraged anyone going to the river to be careful as the water was still very high. Chairman Pro-Tern Chandler-Henry reminded everyone to use caution when driving through construction zones. She also gave a shout out to all the emergency folks in the county that worked during the high water season to get sand bags out and the county Road and Bridge department for keeping the water in the rivers and off the roads. County Manager Updates • Kelly Collier, Deputy County Manager echoed her thanks to the Fleet Department and to Road &Bridge for filling sandbags and helping the community afterhours. She recognized the Fleet Department for looking at innovative ways to save money and decrease emissions. They were currently working on an electric vehicle plan for the fleet. She reminded everyone of the 80th anniversary of the Fair and Rodeo, July 24-27;tickets were • available online. Constituent Input Chairman Pro-Tem Chandler Henry opened and closed constituent input, as there was none. Commissioner Scherr moved to adjourn as the Eagle County Board of County Commissioners and re- convene as the Eagle County Housing and Development Authority. Chairman Pro-Tem Chandler-Henry seconded the motion. The vote was declared unanimous. 1 07/09/2019 Eagle County Housing and Development Authority 1. Property Management Agreement Between Eagle-Vail Metropolitan District and Eagle County Housing and Development Authority for Housing Services at the Eagle-Vail Fire Station Daniel Murray, Housing Executive Summary: ECHDA has partnered with the Eagle Vail Metro District since January of 2016 on the management of 5 units within their old fire house. This is a great partnership that has worked for over 3 years. We are formally renewing the management agreement. This agreement will be for five additional years as was agreed to by the EV MD District Manager. Commissioner Scherr moved to approve the property management agreement between Eagle Vail Metropolitan District and Eagle County Housing and Development Authority for Housing Services at the Eagle Vail Fire Station. Chairman Pro-Tem McQueeney seconded the motion. Of the two voting Commissioners,the vote was declared unanimous. 2. Agreement for Procurement and Installation Services between Lake Creek Village LLC and Recreation Plus do Recreation Plus Ltd. Daniel Murray, Housing Executive Summary: Lake Creek Village, in partnership with Norris Design, Eagle Valley Outdoor Movement, RA Nelson and Recreation Plus, is looking to complete Phase 2 of the landscape redesign project at Lake Creek Village. In 2015, Lake Creek Village added a large playground area, a turf field and a volley ball court to the grounds at LCV. In 2019, management is looking to expand on that project by adding six stationary exercise stations around the playground, a large play structure for children and a shelter structure with picnic tables so families can picnic together. This project is part of a long term plan to fully overhaul the grounds at Lake Creek Village making it a great place for families to live and recreate. The overall project including installation comes to approximately $216,000, but $40,000 of that cost is being funded through the Eagle Valley Outdoor Movement and Walking Mountain Science Center's Go Outdoors Colorado Grant. Commissioner Scherr moved to approve the agreement for procurement and installation services between Lake Creek Village LLC and Recreation Plus c/o/Recreation Plus Ltd. Chairman Pro-Tem McQueeney seconded the motion. Of the two voting Commissioners,the vote was declared unanimous. Commissioner Scherr moved to adjourn as the Eagle County Housing Authority and re-convene as the Eagle County Liquor Licensing Authority. Chairman Pro-Tem Chandler-Henry seconded the motion. Of the two voting Commissioners,the vote was declared unanimous. Business Items 1. Resolution 2019-043 Concerning Appointment to the Eagle Cemetery District Board of Directors Rhea Silverkorn,Administration Executive Summary: This resolution is to appoint Shirley Zupancic to a six year term on the Eagle Cemetery District Board of Directors. 2 07/09/2019 Nancy Powell spoke on behalf of the Cemetery District Board to appoint Shirley Zupancic. There were three members on the board, and the board was set up by state statutes. Commissioner Scherr moved to approve the resolution concerning appointment to the Eagle Cemetery District Board of Directors. Chairman Pro-Tem Chandler-Henry seconded the motion. Of the two voting Commissioners, the vote was declared unanimous. 2. Resolution 2019-044 Approving and Authorizing the Use of Open Space Funds to Purchase 3785 Lupine Drive, Town Of Vail, Eagle County and Authorizing Any of the Eagle County Commissioners to Execute Any and All Documents Associated With Said Purchase Diane Mauriello, Open Space Executive Summary: Resolution authorizing the expenditure of$300,000 from the Open Space Fund toward the purchase of the Lupine Property in Vail and authorizing any commissioner to sign documents. Diane Mauriello presented the proposal. The matter was brought before the Open Space Advisory Committee, and the committee voted unanimously to purchase the property. The property had been identified as part of Vail"s Open Land Plan. The parcel was small with a poird'dominatirig the parcel, hut the property met the criteria. The purchase price was .$600,000.The Town of Vail could fund $300.000. and the land would he ov'ned and managed by the Town of Vail. The Town of Vail had future plans to enhance the wetlands on the property and improve the storm water filtration to support the health of Goret,Creek. .M . Mauriello reviewed the criteria. A closing was planned for July, but there was one final deadline related to'an intake valve that crossed an adjacent property that filled the pond. The town was working on the issue. The property was small but staff believed that this was a unique opportunity to protect sensitive land on the Valley floor. Kristen Bertuglia, Environmental Sustainability Manager with the Town of Vail stated that the zone district was applied by the Town Council and could only be undone by the registered voters. Ms. Mauriello stated that the intergovernmental agreement outlined the restrictive covenant and management plan. Commissioner Scherr asked if there were any water rights associated with the property. Ms. Bertuglia stated that the Town of Vail was not aware of any water rights. There was an issue with a ground water discharge, and these details were still being worked out. Ms. Mauriello stated that staff would oversee all the obligations set forth in the intergovernmental agreement. In addition, when the town moved forward with its plans for a restrictive covenant,they agreed to share the plan in advance for review. Commissioner Scherr moved to approve the resolution approving and authorizing the use of Open Space Funds to purchase 3785 Lupine Drive, Town of Vail, Eagle County and authorizing any of the Eagle County Commissioners to execute any and all documents associated with said purchase. With this following condition: That funding is conditioned upon County Attorney's approval of a formal document or other resolution by the Town of Vail resolving the issue regarding water intake and access. Chairman Pro-Tern Chandler-Henry seconded the motion. Of the two voting Commissioners, the vote was declared unanimous. 3. Intergovernmental Agreement Between Eagle County and Town of Vail for Acquisition and Management of 3785 Lupine Drive Diane Mauriello, Open Space 3 07/09/2019 Executive Summary: Intergovernmental Agreement sets forth details for the purchase and partial funding of the purchase of the Lupine Drive property using open space funds. Commissioner Scherr moved to approve the intergovernmental agreement between Eagle County and Town of Vail for acquisition and Management of 3785 Lupine Drive. Chairman Pro-Tern Chandler-Henry seconded the motion.
