This being a scheduled Public Hearing,the following items were presented to the Board of County
Commissioners for their consideration:
Commissioner Updates
Commissioner Chandler-Henry gave a shout out to Eagle River Water& Sanitation Department, Colorado
River District, and Eagle River Water Shed Council for the 2019 State of the River event. There was a presentation
of the health of the river and basin levels. There was also a presentation about drought management because the
reservoirs were still nearly empty after last year. If anyone was interested in these conversations,the Water Shed
Council was heading up a community water plan; signup to attend the meetings could be done online.
Commissioner Scherr stated that it was National Emergency Management Services -EMS week. He
encouraged everyone to hug an EMT or paramedic.
Chairman McQueeney stated that she attended the"Evening of the Stars"with her husband and spoke
about the Eagle County employees that attended with their families. County Manager Jeff Scroll was there and was
nominated as a"friend of education". It highlighted for her that it was the people of Eagle County that made this
such a great place to live.
County Manager Updates
Jeff Shroll spoke about all the great athletes in the valley. He also congratulated the Housing Department
for receiving an award for their Down Payment Assistance Program. He reminded everyone that the county would
be closed on Monday for the Memorial Day holiday.
Constituent Input
Chairman McQueeney opened and closed constituent input as there was none.
Commissioner Scherr moved to adjourn as the Eagle County Board of County Commissioners and re-
convene as the Eagle County Housing and Development Authority.
Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous.
Eagle County Housing and Development Authority
1. Agreement for Procurement and Installation Services between Lake Creek Village LLC and 360 Civil, Inc.

Executive Summary: Per our 2nd mortgage agreement, Lake Creek Village was required to remove a portion of
the bike path that crossed into the 100-year flood plain. Per the surveyor, we have removed that portion outside of
the floodplain. In order to enhance the lives of our residents, we are going to reinstall the bike path outside of the
flood plain. This agreement will allow us to rebuild it prior to the summer so the residents can enjoy the bike path
during the warmer months.
Mr. Murray stated that the path near the 100-year flood plain needed to be removed last year in order to
satisfy loan requirements. The agreement would allow the bike path to be rebuilt. He hoped to have the path
rebuilt by the end of June.
Commissioner Chandler-Henry moved to approve the agreement for procurement and installation services
between Lake Creek Village LLC and 360 Civil, Inc.
Commissioner Scherr seconded the motion. The vote was declared unanimous.
Commissioner Scherr moved to adjourn as the Eagle County Housing Authority and re-convene as the
Eagle County Board of County Commissioners.
Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous.
Business Items
1. Intergovernmental Agreement Between Eagle County, the Eagle County Sheriff and the Eagle County
School District RE5OJ for Cooperative School Resource Officer Services

Executive Summary: The County and Eagle County School District recognize a need to revise and update the
terms of the 2008 agreement in order to increase the funding for and number of SROs in Eagle County Schools to
act as a liaison between the Eagle County Sheriff's Office and the Eagle County Schools and to address juvenile
crime and safety concerns in the District's educational institutions located within Eagle County
Sheriff Van Beek stated that this had been an ongoing process. Currently there were two SROs, one at the
east end and one on the west end of the valley; the officers were primarily housed out of the high schools. He
hoped to get back up to four officers.
Commissioner Chandler-Henry moved to approve the intergovernmental agreement between Eagle
County, the Eagle County Sheriff and the Eagle County School District RE50J for Cooperative School Resource
Officer Services.
Commissioner Scherr seconded the motion. The vote was declared unanimous.
2. Agreement For The 2019 Overlay Project Between Eagle County and Grand River Construction Co

Executive Summary: Each year, Eagle County performs asphalt overlay on various county roads that meet the
requirements of repair. A pavement overlay is the application of hot bituminous asphalt to an existing paved road
that has deteriorated because of wear from traffic and weather. The road meeting requirements for 2019 is the first
4.9 miles of the Frying Pan River Road located in our SW District.
John Harris, Road & Bridge Director, requested of the approval of the overlay project with Grand River
Construction. The project consisted of 63,000 square yards of reinforced fabric which was placed under the
overlay. They budgeted $1.1 million for the project. The project would begin the second week of June and last a
couple weeks depending on the weather with some restraints to traffic.
Commissioner Scherr moved to approve the agreement for the 2019 Overlay Project between Eagle
County and Grand River Construction Co.

3. Agreement Between Eagle County and the Town of Eagle for Use, Operation and Maintenance of the Eagle
River Park at the Eagle County Fairgrounds Property

Executive Summary: The Use Agreement allows the Town to program and maintain the newly constructed Eagle
River Park, which is on County property.
Mr. Sharkey, ECO Trails Program Manager, explained the details of the project. The agreement details the
operations of the park and the use of the parking area during the fair and rodeo. He believed the Eagle River Park
had been a great collaboration between the Town of Eagle and Eagle County.
Commissioner Chandler-Henry moved to approve the agreement between Eagle County and the Town of
Eagle for use, operation and maintenance of the Eagle River Park and the Eagle County Fairgrounds Property.
Commissioner Scherr seconded the motion. The vote was declared unanimous.
4. Ordinance Repealing Ordinance No. 07-02 and Authorizing the Sheriff to Declare Fire Restrictions Within
Unincorporated Eagle County

Executive Summary: The proposed Fire Restrictions Ordinance authorizes the Eagle County Sheriff to declare fire
restrictions during times of high fire danger. The new ordinance allows the Sheriff flexibility in designing
restrictions to fit the circumstances. It also provides automatic fire restrictions during Red Flag Warnings, which
are fleeting in duration, and therefore, difficult to address by declaring restrictions on a case-by-case basis.
Sheriff Van Beek spoke about the work involved in the ordinance. He believed the new ordinance would
offset some of the differences and was cleaner to implement.
Chairman McQueeney expressed her appreciation and believed it was helpful that the document was easier
to understand.
Sheriff Van Beek stated that there would be an interactive map so the community and visitors could search
for fire restrictions in areas they wish to visit.
Chairman McQueeney opened and closed public comment as there was none.
Commissioner Scherr moved to approve the ordinance repealing Ordinance No. 07-02 and authorize the
Sheriff to declare fire restrictions within unincorporated Eagle County and ordering that Ordinance No. 19-01 be
published in the newspaper.
Commissioner Chandler-Henry seconded the motion. The vote was declared unanimous.
