RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF THE COUNTY OF EAGLE,STATE OFCOLORADO

VARIANCE FROM IMPROVEMENT STANDARDS
WHEREAS, Robert and Heather Bruce ("Applicants") are the owners of Lot 13, Coulter
Creek Ranches("Property");and
WHEREAS, the Owners seek to construct an Accessory Dwelling Unit("ADU") on the
Property;and
WHEREAS, The Eagle County Land Use Regulations ("ECLUR") require access roads
serving developments of more than three (3) residences to meet Eagle County Road Standards;
and
WHEREAS, the Applicants sought approval by the Eagle County Board of County
Commissioners (the "Board") for variances from five (5) ECLUR improvement standards
relating to the safety of roads, specifically, those relating to dual access, emergency vehicle
turnaround areas along the road and at the road end, intersections with other roads, and the lane
width geometric standard, as detailed in the Variance Table attached as Exhibit A, the
Application (the"Application"),and the Staff Report submitted to the Board; and
WHEREAS, at a public hearing on the Application before the Board on August 28,
2018, the Board heard the presentations from the Eagle County Engineering Department staff,
the Applicants, and their Representative; examined the Engineering Staff Report; received oral
and written comments from the public and referral agencies; and queried staff, the Applicant, and
their representative concerning the Application;and
WHEREAS, at the conclusion of the hearing on August 28, 2018, it was moved,
seconded and unanimously voted by the Board to approve the Variances from Improvement
Standards, concluding, after hearing and seeing the evidence presented in these proceedings
concerning variances from the ECLUR improvement standards relating to the safety of roads,
that the hardship to the Applicants from denial of the variances outweighed the adverse impact
on the health, safety, and welfare of the persons affected and the adverse impact on the land
affected. The Board instructed staff to prepare a Resolution formally approving the Application,
including the findings of the Board based on the above-described recorded evidence concerning
hardship to the Applicants and the safety of the public, for consideration at a meeting of the
Board.
NOW, THEREFORE, THE BOARD OF COUNTY COMMISSIONERS FINDS,
based on the above-described record evidence and applying the criteria for evaluating requests
for Variances from Improvement Standards set out in applicable ECLUR,that the hardship to the
Applicants from denying the variances outweighs the adverse impact on the health, safety and
welfare of persons affected and the adverse impact of the land affected if the variances are
granted.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
the County of Eagle, State of Colorado:
THAT the above-described Application for Variances from Improvement Standards from
five (5) ECLUR relating to the safety of roads, specifically, those relating to dual access,
emergency vehicle turnaround areas along the road and at the road end, intersections with other
roads, and the lane width geometric standard be and hereby is approved as to each and every
variance therein requested, with the following conditions:
1. Except as otherwise modified by this development permit, all material representations
made by the Applicants (in the Application and in public meeting) shall be adhered to
and considered conditions of approval.
2. Any driveway construction necessary for access to the proposed residence or ADU shall
meet the ECLUR for driveways. The Applicants shall construct an emergency vehicle
turnaround on the subject property. The turnaround will be reviewed during the Building
Permit process and shall be constructed prior to issuance of any Certificate of Occupancy.
3. The Applicants shall construct and maintain an 8,000-gallon fire suppression cistern with
a dry well and emergency vehicle turnaround as represented in this application or as
requested during the building permit review process.
THAT, the Board hereby finds, determines and declares that this Resolution is necessary
for the health, safety and welfare of the citizens of Eagle County.
