HomeMy WebLinkAboutC18-268 Colorado Department of Human Services MOU - NOT FULLY EXECUTEDCOLORADOAVDepartmentofHumanServicesMEMORANDUMOfUNDERSTANDINGTheStateofColoradoDepartmentofHumanServicesandtheBoardofCountyCommissionersorotherelectedgoverningbodyofEagleCounty,Colorado.ThisMemorandumofUnderstanding(MOU)ismadethis1stdayofJuly,2018betweentheStateofColoradoDepartmentofHumanServices (CDHS)andtheBoardoftheCountyCommissionersorotherelectedgoverningbodyofEagleCounty,Colorado(the“County”).CDHSisthe solestateagencywiththeresponsibilitytoadministerorsupervisetheadministrationofthehumanservicesprograms listedinCRS26-1-201.TheColoradoGeneralAssemblyenactedSenateBill97-120inresponsetothepassageofthefederal“PersonalResponsibilityandWorkOpportunity ReconciliationActof1996”therebyadoptingtheColoradoWorks Program(“Works Program”)andtheColoradoChild CareAssistance Program(“ChildCareProgram”);collectively referredtoasthe“Programs”fortheptirposesofthisMOU.CRS26-2-715requiresCDHSandtheCountytoenterintoanannualperformancecontractthatexplainstheCounty’sdutiesandresponsibilitiesinimplementingthe WorksProgramandtheChildCareProgram.CDHSandtheCountyunderstandandagreethattheservicesandassistance outlinedinthisMOUaresubjecttoavailableappropriationsbytheGeneralAssembly,andtheCounty,andneitherpartywillbeobligatedtoprovideservicesorassistanceifadequateappropriationshavenotbeenmade.ThefollowingtermsareagreedtobyCDHSandtheCounty:1.MOUMEETSPERFORMANCECONTRACTREQUIREMENTThepartiesagree thattheprovisionsofthisMOUconstitutecompliancewithCRS26-2-7152.TERMThetermofthisMOUwillbefromJuly1,2018throughJune30,20211575ShermanStreet,Denver,CO80203P303.866.5700www.co[orado.gov/cdhsJohnW.Hftken[ooper,GovernorReggieBicha,ExecutiveDirectorC18-268
Page2of103.REQUIREDDUTIESOFTHECOUNTYa.TheCountywilladministerandimplementtheWorksProgramandtheChildCareProgramusingfairandobjectivecriteria,andincompliancewithfederallaw.b.TheCountywillnotreducethebasicassistancegrantadministeredaccordingtoCRS26-2-709,exceptasotherwiseprovidedbylaw.c.TheCountywillnotrestricteligibilityortheprovisionsofservices,norwillitimposesanctionsthatareinconsistentwithStateorfederallaw.d.ForthetermofthisMOU,theCounty’snegotiatedWorkParticipationRate(WPR)willbeheldaccountableonlytotheadjustedWPR,afterthecaseloadreductioncreditisapplied,withtheeliminationandremovaloftheTwo-Parentrate.TheCounty’sagreementtomeetthefederallyrequiredparticipationrateisrelevanttoCDHS’santicipationthatCDHSwill,inturn,beabletomeetanyworkparticipationratesimposedbythefederalgovernment.e.ThepartiesacknowledgethattheWPRis,asofthesigningofthisMOU,theonlyfederallymandatedperfoniLancegoalidentifiedspecificallyinCRS26-2-712(4).Thepartiesalsoacknowledgethatinanefforttohelpindividualsprepareforandentertheworkforce,theyareencouragedtoadoptemploymentfocusedmeasures,asoutlinedunder“OPTIONALOUTCOMEMEASURES”below.f.TheCountywillmaintainsufficientrecords,andwillpermitCDHSoritsdulydesignatedagentsand/orrepresentativesofthefederalgovernment,toinspecttherecordsandmakesuchrecordsavailabletoCDHS,asspecifiedinCRS26-2-717.TheCountymustalsocontinuetoreporttoCDHS,ascurrentlyrequiredbyCRS26-2-716,717,andmustreporttoCDHSinthefuture,asrequiredbylaw.Inaddition,Countiesorcountydepartmentsthatarecoveredentities,orcontractingpartiestoaBusinessAssociateAgreement,pursuanttotheHealthInsurancePortability&AccountabilityActof1996(HIPAA),mustcomplywithHIPAA,asrequiredbylaw.g.Countiesshallhaveflexibilityindeterminingtheapproachesneededtoachievefederalandstaterequirements.TheCountyagreestoprovideCDHSwithitsadoptedpoliciesandanyupdatedwritteninformationwhen,orif,changestothesepoliciesaremade.TheCountyagreestoprovidetheinformationandpoliciesspecifiedinparagraph(h)herein,toCDHS,withinthirty(30)daysofadoptingaforementionedpoliciesandtoupdatetheirChildCareProgramCountyplanwhenchangesimpacttheadministrationofsuchprogram.h.ThepartiesagreethatinformationandpoliciesprovidedbytheCountytoCDHS,asdescribedinparagraph(g)herein,areforinformationalpurposesandareprovidedtoassistCDHSinmeetingitsresponsibilities,withrespecttothesePrograms.NothinginthisMOUgivesCDHStheauthoritytoapprove,denyor1575ShermanStreet,Denver,CO80203P303.866.5700www.co[orado.gov/cdhsJohnW.Hickenlooper,GovernorReggieBicha,ExecutiveDirector
Page3of10requireanyCountypoliciesbeyondwhatisrequiredbystatute.TheCountyacknowledgesCDHS’sii,littoreview,coimnentttponorrequestreasonableadditionalinformationorclarificationofanyCountypoliciesorrecords.SuchrequestswillbemadeinwritinganddirectedtotheCountyDepartmentofHuman/SocialServicesDirector.TheCountymaintainsthatitwillconsidersuchcommentsinitsimplementationofthesePrograms,butisnotobligatedtoincorporatethem.TheCountywillutilizethetechnicalassistance,trainingandreportingortrackingresourceofferedbyCDHSinordertoadministertheProgramsthatsupportthefourpurposesofTemporaryAssistancetoNeedyFamilies(TANF)andwillmeettheWPR.j.TheCountywillparticipateinformalexpeditiousvettingprocesseswithCDHStoreview,draftandrecommendpoliciesorrulechangesthatwouldhaveapositiveimpactonWPRandmeetfederalguidelines.k.InordertomaximizethecaseloadreductioncreditfortheState,theCountywillactivelyidentifyandreportthirdpartyMaintenanceofEffort(MOE)contributions,inaccordancewiththetimelinesandguidelinesestablishedbyCDMS.4.OPTIONALOUTCOMEMEASURESa.CountiesmaysubmitaproposalasanattachmenttothisMOU,describingadditionalemploymentfocusedperformancemeasures,specifictoemployment.SuchproposalsmaybesubmittedeitheratthetimeofexecutionoratanytimeduringtheperiodofthisMOU.Theproposalislimitedtoissuesregardingthepursuitofprograms,strategies,andassociatedevaluationplansthatfocusonimprovingemploymentoutcomesandcontributetotheevidencebaseforeffectiveprogratus.Inaddition,termsandconditionswillrequireeitherinterimtargetsforeachperformancemeasureoraframeworkforhowinterimgoalswillbesetafterthebaselinemeasuresareestablished.Thetermsandconditionswillestablishareviewprocessforprograms,strategiesandmetricsdesignedtoachieveoptimaloutcomes.b.UponapprovaloftheproposalbyCDHS.theCountyorregionwillbesubjecttotheperformancemeasures,interimgoals,andotherconditionssetforthintheMOUaddendum,andnegotiatedWPRthatconsideremploymentfocusedoutcomemeasuresandanticipatedstatewidecase-loadcreditreductions.5.DUTIESOFCDHSa.InconsultationwiththeCounties,CDHSwilloverseetheimplementationoftheWorksProgramandtheChildCareProgram,statewide,andwilldevelopstandardizedformsthatstreamlinetheapplicationprocess,thedeliveryof1575ShermanStreet,Denver,CO80203P303.866.5700www.cotorado.gov/cdhsJohnW.Hickenboper,GovernorIReggieBcha,ExecutiveDirector
.4Pace4of10servicesandthetrackingofparticipants.b.CDHSwillmonitortheCounty’sprovisionofbasicassistancegrantsand,ifnecessary,performthedutiesoutlinedinCRS26-2-712(5).c.CDHSexercisesoversightofandresponsibilityforthedevelopment.implementation,maintenance,andenhancementoftheStateBenefitSystemanditsapplicationrelativetotheWorksProgram.BecausetheStateBenefitSystemisasystemthatutilizesdecisiontablesrunbyarulesenginefordeterminingeligibilityandamountofbenefitstotheextentallowedbylaw,theCountywillnotbesanctionedorrequiredtofollowaremediationplanforerroneousdecisionsmadebytheStateBenefitSystem.Withoutlimitation,thisappliestoerroneouseligibilitydecisions,erroneousdeterminationofamountofbenefits,erroneousdecisionsresultinginovetpaymentsandsubsequentclaims,anderroneousdecisionsresultinginunderpayrnentsandsubsequentsupplementalpaymentsofrestorativebenefits.TheStateacknowledgesthatliabilitytothirdpartiesresultingfromerroneous,inaccurateorinadequateStateBenefitsSystemnoticestoWorksProgramhouseholds,isproperlytheState’sliability.CDHSwillnottakerecove;yactionagainsttheCountyforanyclaim,includingalegalclaim,thatisdefinedinthisparagraphasaStateBenelitSystemcausederror.Thisprovisiondoesnotapplytoanyerrors,claimsorissuescausedbytheCounty’sinaccuratedataentryinthesystem,theCounty’sfailuretofollowclear,reasonable,andlawfulinstruction,orfailuretofollowprogramrulesformallyadoptedbytheStateBoardofHumanServices.ThisprovisiondoesapplytotheStateBenefitSystemtraininganddataentryrulesand/oranyrulesthatarepartoftheStateBenelitSystemruleengine.d.CDHSwilldevelopandprovidetrainingforWorksProgramstaff,asrequiredbyCRS26-2-712(7).e.CDHSwillholdContractedAgencieswithcooperativeagreementswiththeStateDepartmentresponsibleforprovidingreceptionandplacementservicesforrefugees,accountabletoitsownWPRandmustnotincluderefugeesreceivingContractedAgency’sservicesiiitheCotrnty’scalculationoftheWPR.TheContractedAgency’snegotiatedWPRwillbeheldaccountableonlytotireadjustedWPRafterthecase-loadredttctioncreditisappliedwiththeeliminationandremovaloftheTwo-Parentrate.f.CDI-ISwillusevaliddatafromtheStateBenefitSystemandothersources,asnecessary,toaccuratelycalculatetireCoruity’sWPR.Priortosubmittingitscalculationtothefederalgovernment,CDHStvillprovidetheCountytheindividualdatavariablesandsupportinginformationusedinthecalculations,sothattheCountymayreviewthedatatoensuretheaccuracy,validityandpropercalculationoftheWPR.1575ShermanStreet.Denver,CO80203P303.866.5700www.cotorado,ov/cdhsJohnWH1ckenoperGovernorIReggleBichaExecutiveDirector*
Page5of10g.CDHSwillprovidetechnicalassistanceandavailableresourcestotheCountiestohelpCountiesmeetWPRandPaymentAccuracyGoals.h.CDHSwillprovideongoingtechnicalassistance,training,andreportingfortrackingresourcestohelptheCountyadministertheprogram.insupportofthefourpurposesofTANFandtomeetWPR.CDHSwillconductformalexpeditiouscollaborativeprocesseswiththeCountytoreview,draftandrecommendpoliciesorrulechangesthatwouldhaveapositiveimpactonworkparticipationrateandmeetfederalguidelines.j.InordertomaximizethecaseloadreductioncreditfortheState.CDHSagreestoactivelyidentifyandreportthirdpartyMaintenanceofEffort(MOE)contributions.k.CDHSexercisestheoversightofandtheresponsibilityfor,thedevelopment,implementation,maintenance,andenhancementoftheChildCareStateBenefitSystemanditsapplicationrelativetotheChildCareProgram.TheStateBenefitSystemisasystemthatutilizesdecisiontablesrunbyarulesenginefordeterminingeligibility,totheextentallowedbylaw.Countieswillnotbesanctionedorrequiredtofollowaremediationplant’orerroneousdecisionsmadebytheStateBenefitSystem.Withoutlimitation,thisappliestoerroneouseligibilitydecisions,erroneousdecisionsresultinginoverpaymentsandsubsequentclaims,orerroneousdecisionsresultinginunderpaymentsandsubsequentsupplementalpayments.TheStateacknowledgesthatliabilitytothirdpartiesresultingfromerroneous,inaccurate,orinadequateStateBenefitsSystemnoticestoChildCareProgramlioriselioldsisproperlytheState’sliability.TheStatewillnottakerecoveiyactionagainsttheCountyforanyclaim,includingalegalclaim,thatisdefinedinthisparagraph,asaStateBenefitSystemcausederror.ThisprovisiondoesnotapplytoanyerrorscausedbytheCounty’sinaccuratedataentryintothesystem,theCounty’sfaihuetofollowclear,reasonable,andlawfulinstructions,orfailuretofollowprogramrulesformallyadoptedbytheStateBoardofHumanServices.ThisprovisiondoesapplytotheStateBenefitSystemtraininganddataentryrulesand/oranyrulesthatarepartoftheStateBenefitSystemrulesengine.CDHSwilldevelopandprovidetrainingforChildCareProgramstaffandprovidetimelyandaccuratereportsonCountyperformance.m.ThearnotuitidentifiedforaCounty’slevelofspendingshallbeidenUfieclannuallyintheAllocationAgencyLetterasrequiredbyCRS26-2-712,etseq.1575ShermanStreet.Denver,CO80203P303.866.5700www.cotorado.gov/cdhsJohnW.Fhckenboper,GovernorReggieBicha,ExecutiveDirector
Page6of106.JOINTSTATEANDCOUNTYDUTIESa.TheStateandCountieswillworktogetherinpartnershiptocommunicateperformanceexpectationsandresultstojointlyachievefederallyrequiredperformanceoutcomemeasuresrelatedtotheWPRandtëderalimproperPaymentErrofRate.b.Asneeded,theStateandCountieswillconvenemeetinrs,workshops.focusgroups,orotherfonimstoshareinformation,bestprocess,ortargetedstrategiestoachievethespiritandintentofthisMOUdocumentandrelatedfederallyrequiredperformancerequirements.7.REMEDIATIONPLANSa.TheCounty,inconsultationwithCDHS,maydeveloparernecliationplanif,duringthetermofthisMOU,theCountyengagesinanyofthefollowingactions:i.SpendingfederalorstateWorksProgramorChildCareProgramfundsinamannerdisallowedbyfederalorStatelaw,whichcouldincludereceiptsorrecoveriesthatarenotreported;ii.FailingtomeettheWPR,afterthecaseloadreductioncreditisapplied,ascontainedinthisMOUand/orfailingtomeetthenegotiatedperformancemeasures;iii.Reducingthebasicassistancegrant,restrictingeligibilityortheprovisionofservices,orimposingsanctionsinamannerinconsistentwithafederallycompliantstatelawandstatepian;iv.FailingtomeetChildCareProgramfederalimproperpaymenterrorrateguidelines,inaccordancewiththefederalfiscalyear.8.SANCTIONSa.Subjecttothelimitationssetforthherein,ifCDHSissubjecttoafederalsanction,andtheCounty’sreniediahonplantvasinsufficient,CDHSmayimposesanctionsontheCountypursuanttothisMOUonlyifduringthetermofthisMOU,theCountyengagesinanyofthef’ollowingactions:i.FailingtomeettheWPR,afterthecase-loadreductioncreditisapplied,ascontainedinthisMOUand/ornotmeetingnegotiatedperformancemeasures;ii.Reducingthebasicassistancegrant.restrictingeligibilityortheprovisionofservices,orimposingsanctionsinamannerinconsistentwithafederallycompliantstatelawandstateplan;::t’.1575ShermanStreetDenverCO80203P303866D700wwwcoLoradoov/cdhsJohnWFlickenLooperGovernorReggieBichaExecutiveDirector*1*)
Page7of10iii.failingtomeetChildCareProgramfederalimproperpaymenterrorrateguidelines,inaccordancewiththefederalfiscalyear.b.AsanctionshouldnotbeimposedontheCountyforfailingtoadheretoastateregulationthatcontlictswithfederallaw.c.Thecountywillnotbesanctionedorrequiredtofollowarernediationplanif:i.theCountycandemonstratebyapreponderanceofevidencethatCDHSprovidedinaccurateguidance,trainingordatawithregardstoperformanceunderthisMOU;and,ii.thattireCotuity’srelianceonthisinfonnationistheproximatecausefortheimposedsanctions.IftheCountycanonlydemonstratethatitistheproximatecauseforpartofthesanction,theCountywillnotbeliableforthatportionof’thesanction.9.PROCEDURESFORIMPOSINGREMEDIATIONPLANORSANCTIONSa.TheprocessforasanctionorremediationplanagainsttheCotmtybyCDHSwillbeasfollows:i.CDHSwillprovidetheCountywrittennoticeoftireCotrnty’sfailuretomeettheperformancemeasuresoutlinedinthisMOU.ThisnotificationwiltincludeallassociateddocumentationthatsupportsCDHSdeterminationoftheperformancefailure.Uponreceivingsuchnotice,theCountyhassixty(60)daystocontest,explain,offerevidenceofmitigatingt’actors,and/orsubmitaremediationplantocorrecttheallegedperformanceproblem.ii.IftheCounty’sremethatioiiplandoesnotrectifytireperfonuanceproblem,CDHSmaydeterminetheappropriatelevelof’sanction.CDHSshalltakeintoconsiderationasamitigatingfactoranyviolationofastateregulationthatexceedsorconflictstherequirementsofthefederallaw.CDHSwillprovidetheCountyonehundredeighty(180)dayswrittennoticeoftheproposedsanctionbeforeimposinganysanction.Thisnotificationwillincludetherationaleofimposingthesanction,aswellas,allassociateddocumentation,acalculationoftheproposedsanction.andanindicationofwhatconstitutesaremedyorcorrectionthatwillallowtheCountytoavertthesanction,ifanyremedyorcorrectionispossible.Uponreceivingsuchnotice,theCountyhassixty(60)daystocontest,explainoroilerevidenceofmitigatingfactors,beforeCDHSimposesthesanction.iii.ifasanctionisimposed,theamountcannotbegreaterthanthatimposedbythefederalgovernment.IfCDHShasincurredasanctionduetothefailureofmorethanoneCountytomeetitsobligationsundertheterms1575ShermanStreetDenverCO60203P3038665700wwwcoLoradogov/cdhsJohnWHickenboperGovernorIReggieBichaExecutiveDirector*
Page8of10ofthisMOU.theCountywilloniybesanctionedforitsshareofthesanction.b.CDHSwillprovidetheCountywithalldocumentsreceivedfromthefederalgovernmentrelatedtoanyproposedorimposedtëderalsanctionwithin(went20)daysof’receipt,togetherwithallCDHSdocumentsrelatedtotheactionsgivingrisetothatfederalsanction,orthatreLatedtothesanctionprocess.IfCDHSfailstoprovidetherequireddocumentationwithinthetwenty(20)days,CDHSmaynotholdtheCountyliableforthatsanction.10.CIRCUMSTANCESFORCDHSASSUMINGADTIINISTRAT1ONa.It’theCountycontinuestoknowinglyorconsistentlyfailtomeetitsobligationspecifiectinthisMOU,CDH$,atitssolediscretion.mayassiunetheCounty’sadministrationandimplementationoftheWorksProgramand/orChildCareProgram.Inthatevent,CDHSwillprovidetheCountyninety(90)dayswrittennoticebeforeassumingtheseduties.Uponreceiptofsuchnotice,theCountyshallhavetheopportunitytocontest,explain,offerevidenceofmitigatingfactors,ortocorrectthefailurebeforeCDHSassumestheduties.b.IftheCountycontinuestoconsistentlyfailtomeeitsobligationspeci[ledinthisMOU,theCountyatitssolediscretion,mayaskCDHStoassumetheCounty’sadministrationandimplementationof’theWorksProgramand/orChildCareProgram.CDHSisundernoobligationtoacceptorassumetheadministrationoftheWorksProgramand/orChildCareProgram.IfCDHSassiunes[lieCounty’sadministrationmidimplementationoftheWorksorChildCareProgram,itmayretaintheunusedportionoftheallocationthatwasprovidedtotheCotuity,aspaitoftheCounty’sblockgrantforitsadministrationandimplementationofthePrograms,inaccordancewiththeformulasdescribedinCRS26-2-714.CDKSwilt,inconsultationandinconjunctionwiththeCounty,developormodifyautomatedsystemstomeetthereportingrequirementsofCRS26-2-717.11.DISCRETIONARYMATTERSThepartiesagreethatallportionsofPart7ofArticle2ofTitle26,C.R.S.,andPart$ofArticle2ofTitle26,C.R.S.thatgrantdiscretiontoeitherpartyregardingtheadministrationoftheWorksorChildCareProgratusintheCounty,willnotbeaffectedbytheexecutionofthisMOUexceptasexplicitlystatedherein.12.SEVERABILITYTotheextentthatthisMOUisexecuted.andtheperfonnanceoftheobligationsofthepartiesmaybeaccottiplishedwithintheintentoftheMOU,thetermsoftheMOUare1575ShermanStreetDenverCO80203P3038665700wwwcoloradogovicdhsi&JohnWHicenlooperGovernorIPeggieBichaExecutiveDirector*;j
Page9of10severable.Thus,shouldanytermorprovisionhereinbedeclaredinvalidorbecomeinoperativeforanyreason,suchinvalidityorfailureshallnotaffectthevalidityofanyothertermorprovisionhereiti.Thewaiverofanybreachofterm,hereinshallnotbeconstniedasawaiverofanyotherterm,orofthesametermuponsubsequentbreach.13.INTEGRATIONOfUNDERSTANDINGThisMOUisintendedasthecompleteintegrationoftheunderstandingbetweenthepartiesconcerningthemattersnegotiatedbetweenthemandincorporatedinthisMOU.Nopriororcontemporaneousaddition,deletion,orotheramendmentheretoshallhaveanyforceoreffectwhatsoever,unlessembodiedinwriting.Nosubseciuentnotation,renewal,addition,deletion,orotheramendmentheretoshallhaveanyforceoreffectunlessembodiedinawrittenamendmentexecutedbytheparties.ThepartiesrecognizethenatureoftherelationshipbetweentheCountyandState.ThisrelationshipisgovernedmorebroadlybypertinentprovisionsoftheColoradoConstitutionandofStatestatutesandrules.incitidinglawfulrulespromulgatedbytheStateBoardofHumanServices.ThepartiesfurtherrecognizethatthisMOUisnotintendedtosupersedeorchangetherelationshipbetweentheCountyandtheStateasestablishedbyanylegalauthority.14.NOTHiRD-PARTYBENEFICIARYThisMOUisbindingonCDHSandtheCounty,aswellastheirrespectivesuccessorsandassigns.Itisagreedthattheent’oreementofthetermsandconditionsof’theMOUarereservedforCDHSandtheCounty,totheextentpermittedbylaw.NothingcontainedinthisMOUallowsaclaimorrightofactionbyathirdparty.AnythirdpartyreceivingservicesorbenefitsundertheprovisionsofthisMOUisdeemedanincidentalbeneficiary.15.DISPUTERESOLUTIONa.Priortotheexecutionofthisdocument,ifthepartiesareunabletoreachagreementconcerningtheinclusionolorwordingof,provisionsoftheMOU,eitherpartymayreferthedisputetotheStateBoardofHumanServicesforresolutionpursuanttotheprovisionsofCRS26-2-715(3).b.Subsequenttotheexecutionofthisdocument,bothpartiesvillworkingoodfaithtoresolveadisputearisingfromanyprovisionofthisexecutedMOU.Ifthepartiesareunabletoresolvesuchdispute,anyof’thefollowingnon-bindingmediationoptionsareavailablebyagreementoftheparties;i.MediationbytheGovernororathirdpartyoftheGovernor’schoosing.SuchreviewmustbeinitiatedbynoticeprovidedtotheGovernorandotherparty,bycertitiedmail.DecisionbytheGovernor,orhisappointedthird-party.isnon-binding.1575ShermanStreet,Denver,CO80203P303.866.5700www.cotorado.gov/cdhsJohnW.1-lickenkioper,GovernorIReggieBicha.ExecutiveDirector
