RESOLUTION ACKNOWLEDGING RECEIPT OF A PERMANENT PUBLIC TRAIL
EASEMENT RESULTING FROM CDOT'S RECONSTRUCTION OF THE EDWARDS
SPUR ROAD
WHEREAS, the Colorado Department of Transportation ("CDOT") is reconstructing a
portion of I-70G, Edwards Spur Road, which is Project NHPP 0702-344 (the Project"); and
WHEREAS, CDOT must realign a portion of a pedestrian and bike trail (the "Trail")
that is a component of the Project and part of that realignment is on Riverwalk at Edwards
Property Owners Association, Incorporated's (the "Property Owner") property; and
WHEREAS, CDOT has facilitated conveyance of a permanent easement from the
Property Owner to Eagle County, Colorado for the purpose of constructing and maintaining the Trail as
part of the Project (the"Trail Easement"); and
• WHEREAS, the Board of County Commissioners for Eagle County (the "Board") has
considered the terms of the conveyance of the Trail Easement from Property Owner to Eagle
County, Colorado and will accept such Trail Easement.
NOW, THEREFORE, be it resolved by the Board of County Commissioners of the
County of Eagle,State of Colorado:
THAT, the Board approves the conveyance of the Trail Easement as a result of CDOT's
Project, subject to the following:
1. State of Colorado funds under highway project NHPP 0702-344 will be used to purchase
the Trail Easement and be remitted to the Property Owner.
2. Conveyance of the Trail Easement will be accomplished by an Easement Agreement
between Eagle County Colorado and the Property Owner.
3. This Resolution and the Easement Agreement will be entered into the public record of the
Eagle County office of the Clerk and Recorder.
4. Eagle County and/or its agents, successors and assigns will be responsible for the
maintenance of the Trail located within the boundary of the Trail Easement subject to the
terms of the Easement Agreement.
THAT, the Board finds, determines and declares that this Resolution is necessary for the
4110 public health, safety and welfare of the citizens of the County of Eagle, State of Colorado.
