HomeMy WebLinkAboutC18-234 Colorado Department of Human Services Title IV-E Waiver - NOT FULLY EXECUTEDMEMORANDUMOFUNDERSTANDINGTheStateofColoradoDepartmentofHumanServicesAndTheBoardofCountyCommissionersorotherelectedgoverningbody ofEagleCounty(ies),ColoradoThisMemorandumofUnderstanding(or“MOU”)ismadethis__________________betweentheStateofColoradoDepartmentofHumanServices(the“CDHS”)andtheBoardofCountyCommissionersorotherelected governingbodyofEagleCounty(ies), Colorado(the“County”).CDHSisthesolestateagencywiththeresponsibilitytoadministerorsupervisetheadministrationofthehumanservicesprogramslistedinCRS26-1-201.TheColoradoGeneralAssemblyenactedSB13-231inresponsetotheCDHS beinggrantedwaiverauthoritybythe UnitedStatesDepartmentofHealthandHumanServices,AdministrationforChildrenandFamilies, under Section1130oftheSocialSecurityAct,whichauthorizesstatestoconductdemonstrationprojectswhicharedeterminedtopromotetheobjectivesofpartsBorEofTitleIVoftheSocialSecurityAct.Acopyofthewaivertermsandconditionsareattachedtothis MOUasExhibitA.CRS26-5-105.4requiresCDHSandtheCountytoenterintoaMemorandumofUnderstandingthatexplainstheCounty’sduties andresponsibilitiesinimplementingthe TitleW-EWaiverDemonstrationProjects.CDHSandtheCounty understandand agreethattheservicesoutlinedinthisMOUaresubjecttoavailableappropriationsbytheGeneralAssembly,andneitherpartywillbeobligatedtoprovideservicesorassistanceifadequateappropriationshavenotbeenmade.1C18-234
ThefollowingtermsareagreedtobyCDHSandtheCounty:1.MOUMEETSPERFORMANCEAGREEMENTREQUIREMENTThepartiesagreethattheprovisionsofthisMOUconstitutecompliancewithCRS26-5-105.4.2.TERMThetermofthisMOUwillbefromJuly1,2018toandincludingJune30,2019.3.DEFINITIONSThepartiesagreetoprovidethefollowingminimumservicestotheidentifiedpopulationsasdenotedbelow(checkallthatapply):1FamilyEngagement—Meetingswillbeprovidedtofamilieswithanewlyopenedchildwelfarecaseduringthedemonstrationperiod:•Withinsevenbusinessdaysofcaseopening;o(inFARcases,withinseven businessdaysafterthe60thday(69daysbyincludingweekends);•Withinsevenbusinessdaysofinitialplacement;•Every90dayswheninout-of-homecare(DHS/DSScustody);•Everysixmonthsinin-home(case open).I1PermanencyRoundtables—Meetingwillbeheldquarterlyfor:All opencasesinvolvingachild/youthwithagoalofOtherPlannedPermanentLivingArrangement;and/or1Allopencasesinvolvingachild/youthwhohasbeeninoutofhomecarefor12+months;and/orDOther:KinshipSupports—Supportservicesand goodswillbeprovidedtokinshipfamilieswhoare:E1Licensedkinshipfostercaregivers;Non-licensedkinshipfostercaregivers.2
1X1TraumaInformedScreening,Assessment,andTreatmenttothefollowingtargetpopulation:Allchildrenwithanopenchildwelfarecase.4.REQUIREDDUTIESOFTHECOUNTYa)Duringthetermoftheagreement,theCountyagreestoimplementtheintervention(s)inaccordancewiththerulesadoptedbytheStateBoardofHumanServices,modifiedasnecessaryinaccordancewithSection6ofthisMemorandumofUnderstanding.b)TheCountywillmaintainsufficientrecords,willsubmitreports,andwillaccuratelyrecordColoradoTrails(Trails)andCFMSactionsasmayberequiredtodocumentallcostandcaseactivitiessupportingtheimplementationoftheWaiver,andwillpermitCDHS,itsevaluators,dulydesignatedagentsand/orrepresentativesofthefederalgovernment,toinspecttherecordsandwillmakesuchrecordsavailabletoCDH$asspecifiedinCRS26-1-122.IftheCountycomplieswithcurrentrecordkeepingrequirementsasoutlinedbycurrentrules,suchshallbeconsideredtobe“sufficientrecords.”c)Countiesshallreportcoststoprovideaninterventionservicetoanindividual,asauthorizedthroughthisMOU.Thecostshallincludethetypeofinterventionserviceprovided,thevolumeofsuchservicesprovided,andcostsoftheinterventionservice,whereapplicable.Thecostsincludeinterventionfunds,staffandvendorcostsasidentifiedinTrails,CountyfinancialManagementSystem(CFMS)and/or100%timereportingbyindividualsperformingawaiveractivity.ThereisapresumptionthatacostisnotawaivercostunlessaffirmativelydocumentedinCFMS,Trails,and/oravendor’stimedetailreportfor100%timereporting.d)TheCountyagreestoparticipateintheevaluationoftheTitleIV-EWaiverDemonstrationProject,asdescribedunderSection3ofExhibitA,andasestablishedunderCRS26-5-105.4.e)InaccordancewithCRS26-5-105.4,theCountyagreestotheStateretaining50%oftheChildWelfaresavingsresultingfromtheIV-EWaiveractivities.Theremaining50%savingswillberetainedbytheCountyforadditionalChildWelfareservices,asdefinedinCRS26-5-101.3.Costsavingsaredeterminedasfollows:3
1)Thedifferencebetween1)theamountofTitleIV-Efundsthatwereclaimedforfostercaremaintenance,caseplanningandadministrationandeligibilitydeterminationinStateFiscalYear(“SFY”)2012-13,andii)theamountofTitleIV-Efundsthatwouldhavebeenclaimedforfostercaremaintenance,caseplanningandadministrationandeligibilitydeterminationinSFY2018-19,hadtheStateofColoradonotbeengrantedwaiverauthoritybytheUnitedStatesDepartmentofHealthandHumanServicesunderSection1130oftheSocialSecurityAct.2)Forthetencountieswiththelargestcaseloadsize,themethodologyfordistributingcostsavingsbetweencountiesthathaveenteredintoaTitleIV-EWaiverDemonstrationProjectMOUshallbebasedonthereductioninthenumberoffostercarebeddaysbetweenSFY2012-13andSFY2018-19;3)ForallothercountiesthathaveenteredintoaTitleIV-EWaiverDemonstrationMOUwithCDHS,themethodologyfordistributingcostsavingsbetweencountiesthathaveenteredintoaTitleIV-EWaiverDemonstrationProjectMOUshallbebasedonthereductioninthenumberoffostercarebeddaysbetweeneitherSFY2011-12orSFY2012-13,andSFY2018-19,asselectedbytheCounty.4)“Costsavings”shallnotincludeunspentTitleW-EWaiverDemonstrationProjectfundsprovidedtocountiesthroughtheMOUforpurposesofimplementingWaiverInterventions.AnysuchunspentfundsremainingattheendofSFY2018-19shallreverttotheTitleW-EWaivercashfund.5)TheCountyinsuresanycountyemployeefundedwithTitleW-EWaiverInterventionfundsparticipatesin100%timereporting.Countyemployeeswith100%oftimedevotedtoTitleW-EWaiverintervention(s)mayutilizethesixMonthCertificationforminlieuof100%timereporting.f)NolaterthanJune30,2019,theCountyagreestouse50%oftheunderspentcountyTitleW-EWaiverfundsforchildwelfareservicesthatcaninclude:1)IV-EWaiverinterventionservicestoeligibleandnon-eligibleTitleIV-Echildren2)ConventionaltitleW-EprogramservicesthataremaintainedforthoseTitleW-Eeligiblechildreninoutofhomeplacement3)Otherchildwelfareservicestoeligibleandnon-eligibleTitleW-Echildrenandtheirfamilies4
4)TheCountyplantoexpendeitherallocatedTitleIV-EWaiverfunds,orunderspentcountyTitleIV-EWaiverfundsasoutlinedinExhibitB.5.DUTIESOFCDHSa)CDHSwilloverseetheimplementationoftheTitleIV-EWaiverDemonstrationProject,andwilldevelopstandardizedformsandreportingprocessesforthetrackingofparticipants,inconsultationwiththeCounties.b)CDHSwillmonitortheCounty’sprovisionofTitleW-EWaiverinterventionservicesasoutlinedintheExhibitBandExhibitC.CDHSwillpullanynecessaryrecordsordataformonitoringpurposesfromexistingTRAILSandothercurrentrecording/datakeepingsystems.CDHSwillnotrequesttheCountytocompilerecords/datathatCDHSmaycompileoraccessthroughtheuseofTRAILSorotherrecord/datakeepingsystems.c)CDHSwillexerciseoversightofandresponsibilityforthedevelopment,implementation,maintenance,andenhancementofTrailsanditsapplicationrelativetoChildWelfareServices.d)CDHSagreestoallocatetocountiesanyTitleIV-EfundstransmittedtotheTitleIV-EWaivercashfundandappropriatedbythegeneralassemblytoeitherimplementtheTitleIV-EWaiverDemonstrationProject,ortofundoutofhomeplacementandcaseplanningforTitleIV-Eeligiblechildren,inaccordancewithCRS26-5-105.4.6.BUDGETInthepreparingofExhibitC,“TitleW-EWaiverDemonstrationProjectYear6(SFY2O18-19)Budget,”theCountyshalldevelopadetailedbudgetthatidentifiesalldirectcostsassociatedwiththeimplementationoftheWaiverinterventions,asdefinedinSection3ofthisMemorandum,forwhichtheCountyhasbeenawardedIV-EWaiverDemonstrationfunds,a)UponreceiptofExhibitB,“CountyIV-EWaiverDemonstrationProjectYear6($fY2018-19)AwardLetter”,TheCountyshallprepareandsubmitarevisedBudget.Thebudget,onceacceptedbyCDHS,shallconstitutetheExhibitC,andshallbecomepartofthisMOU.b)WiththewrittenapprovalofCDHS,theCountymayrequestarevisiontoitsacceptedbudgetduringthetermoftheagreement:5
1)TheCountymaytransferbudgetedfundsbetweenexpenditurelineitemswithinaspecificintervention,providedthatthetransferredamountsdonotconstituteasignificantmodificationtotheservicesasdescribedwithintheApplication.2)AwrittenstatementofimpacttotheservicesasdescribedintheApplicationshallbepreparedbytheCountyandaccompanyanyrequestedbudgetrevisionsthatexceedthethresholdsasidentifiedinSections6.B.1above,andmayberequiredbyCDHSforanyrequestedbudgetrevisionfallingwithinthethresholdsidentifiedinSections6.B.1above.7.SEVERABILITYTotheextentthatthisMOUisexecuted,andperformanceoftheobligationsofthepartiesmaybeaccomplished,thetermsoftheMOUareseverable.ShouldanysingularterminthisMOUbedeclaredinvalidorbecomeinoperativeforanyreason,itwillnotinvalidatetheMOUitself,oranyofthetermsincludedtherein.8INTEGRATIONOFUNDERSTANDINGThepartiesrecognizethenatureoftherelationshipbetweentheCountyandtheState.ThisrelationshipisgovernedmorebroadlybypertinentprovisionsoftheColoradoConstitutionandofstatestatutesandrules,includinglawfulrulespromulgatedbytheStateBoardofHumanServices.ThepartiesfurtherrecognizethatthisMOUisnotintendedtosupersedeorchangetherelationshipbetweentheCountyandtheStateasestablishedbyanylegalauthority.9.NOTHIRDPARTYBENEFICIARYThisMOUisbindingtoCDHSandtheCounty,aswellastheirrespectivesuccessorsandassigns.ItisagreedthattheenforcementofthetermsandconditionsofthisMOUarereservedforCDHSandtheCounty,totheextentpermittedbylaw.NothingcontainedinthisMOUallowsaclaimorrightofactionbyathirdparty.AnythirdpartyreceivingservicesorbenefitsundertheprovisionsofthisMOUisdeemedanincidentalbeneficiary.10.DISPUTERESOLUTION6
Priortotheexecutionofthisdocument,ifthepartiesareunabletoreachagreementconcerningtheinclusionof,orwordingof,provisionsoftheMOU,eitherpartymayreferthedisputetotheTitleW-EWaiverDemonstrationProjectOversightCommittee.TheCommittee’sdecisionwillbemadebyamajorityvoteofitsmembers,andisnon-binding.Ifdissatisfiedwiththedecisionoftheoversightcommittee,eitherpartymayseekreviewbytheOfficeDirectorofChildrenYouthandFamiliesordesignee.Nothingintheseprovisionslimitsaparty’sabilitytopursueotherremediesavailableunderthelaw.11.TERMINATIONThepartiesacknowledgethatwithdrawalfromthisMOUwillresultintheterminationofthisAgreementandterminationoffundingandservicesassociatedwiththisAgreement.TheCountyshallassureaslittledisruptionaspossibleinthedeliveryofservicesprovidedtoRecipients.a)WithdrawallTermination.AnypartymaywithdrawfromthisAgreementatanytimebyproviding30dayswrittennoticetoallotherParties.b)ForLossofFunds.AnypartymaywithdrawfromthisAgreement,intheeventoflossorreductionofresourcesfromitsfundingsourcesadsliallprovidenoticeofwithdrawal,inwritingwithin30days.c)LackofCompliance.CDHSmayterminatetheagreementifitisfoundtheCountyisnotcomplyingwiththetermsofthismemorandum.ththeeventthememorandumisterminatedforfailuretoperform,interventionsfundsmaybereducedatthediscretionofCDHS.7

1.4AltprovisionsoftheActnottvaivedremainineffect.Thedemonstrntionpro-visionsv.IIIbeimplementednocarticf4hnApril1,2013,andcio4eier4huwOctobcr1,2013.TheState’sprojectdemonstrationperiodmaynotexceedamaximumoffivetotalyears(20quarters)undertheprovisionsoftheAct,unlessinthejudgmentoftheSecretary,thedemonstrationprojectshallbeaIIowedtocontinue.Theimplementationdateofthedemonstrationhn!1bewasthefirstdayonwhichtheStateoffersservices,subsidies,orothersupportsundertheprovisionsoftheseDemonstrationProjectTermsandConditionstoparticipatingchildren,caregivers,orothertargetedindividuals.Forcost-neutralitypurposes,thedemonstrationshaHbewasdeemedtohavebegunbeginonJuly1,2013thefirstdayofthecalendarquarter(hereinafter“quarter”),whichincludestheimplementationdateT.hatfei-Forthepurposeofcalculatingcostsfortheinitialquarterofthedemonstration,onlycostsincurredbeginningwiththemonththatincludestheimplementationdatewillbecounted.The-enioiatliaN-eut1a+erthnnthe1a5Ldayof4he-2Oquarterendingafterthedeemedbeginningdate.ThedemonstrationprovisionsshallbeasspecifiedinSections2and3.WaiversnecessaryforthedemonstrationareapproveduponacceptancebytheDepartmentandtheStateoftheseDemonstrationProjectTermsandConditions.They%ill-becomebecameeffectiveasoftheimplementationdateandwillremainineffectforthedurationoftheproject,untilthelastday-of4he2Oquarterendingafterthe-4ee+e4beinningdate,unless—tklenlo+lslffil4onisterminatedca4ir.—flStt&-projectdemonstrationpct4#maynotexceedamximi1-ie-totu-1yearsundertheiii-t-ftheAct.unte;in-thejudmeitf-theSecretary.thedemonsEroio+-projecrshallheallowedtocoMrn*ITheStatesubmittedarequesttoextendtheprojectbeyondtheoriginallyapprovedfic-year(20quarter)termandthatrequesthasbeenapprovedbytheSecretary.ThedemonstrationshallendnolaterthanSeptember30,20191.6FederalapprovaloftheseDemonstrationProjectTermsandConditionsshallnotbeconstruedtoestablishanyprecedentthattheDepartmentwillfollowintheapprovalofanysubsequentrequestforTermsandConditions.1.7NothingintheseTermsandConditionsshallcreateeligibilityforanychildorfamilyforanyFederalprogramorentitlementforwhichthatchildorfamilywouldnototherwisebeentitled,exceptthattitlelV-Efundsmaybeexpended,accordingtotheprovisionsoftheseTermsandConditions,forpersonswhowouldnotbeeligiblefortitleIV-Efundsintheabsenceofthedemonstration.ReceiptofservicesreimbursableundertitleXIXbutprovidedundertheseTermsandConditionsforchildrenandfamilieswhoarenoteligibleundertitlelV-EdoesnotconstituteeligibilityforMedicaid.ChildrenunderthisdemonstrationwhoaredeterminedtobeeligibleundertitlelV-Ewillretainthateligibilitythroughthedurationofthedemonstrationproject,sothatsuchchildrenwillremaineligibleforMedicaid,titleIV-EAdoptionAssistance,titleIV-EFosterCare,andtitletV-EGuardianshipAssistanceProgram,ifapplicable.otoradoTernisandConditionsFINALAmenclediitne,201831.5EXHIBITA
