RESOLUTION NO.2018 - U 3 1
RESOLUTION APPROVING THE FIELDS SKETCH PLAN FOR SUBDIVISION
FILE NO.SUS-5557
WHEREAS,on or about June 3, 2016, the County of Eagle, State of Colorado, accepted
for filing an application (Eagle County File No. SUS-5557) submitted by The Fields
Development Group, LLC. (hereinafter the "Applicant") for approval of a Sketch Plan for
Subdivision for the Fields Subdivision (hereinafter the"Sketch Plan"); and,
WHEREAS, the Applicant requested approval of a Sketch Plan for a proposed
development consisting of 97-100 single-family, duplex and multi-family residential units,
inclusive of 24-27 affordable housing units, open space, public trails, and access easements on
certain real property located in the Rural Residential (RR) Zone District in the unincorporated
area of Eagle County more particularly described as follows:
Lot 5, Arlian Ranch Subdivision, a 19.39 acre parcel of land situated in portions of
Sections 33 and 34, Township 7 South, Range 87 West of the P.M., County of Eagle,
State of Colorado(the"Property"), and;
WHEREAS, the Property is situated within the Urban/Suburban Residential (USR)
Future Land Use designation according to the 2013 Mid-Valley Area Community Plan; and,
WHEREAS, the USR land use designation prescribes a residential density range of 3-7
units per acre; and,
WHEREAS, the proposed Sketch Plan proposes a range of 5 units per acre (97 units) to
5.6 units per acre(110 units) on the Property; and,
WHEREAS, notice of the proposed Sketch Plan was mailed to all owners of property
located within and adjacent to the subject Property and was duly published in a newspaper of
general circulation throughout the County concerning the subject matter of the application and
setting forth the dates and times of hearings for consideration of the application by the Roaring
Fork Valley Regional Planning Commission (hereinafter the "Planning Commission") and the
Board of County Commissioners of the County of Eagle(hereinafter the "Board") as required by
Section 5-210.E, Eagle County Land Use Regulations (hereinafter "ECLURs") — Notice of
Public Hearings; and,
WHEREAS, at a public hearing held on December 17, 2015, the Planning Commission
considered the proposed Sketch Plan; associated plans; and the statements and concerns of the
Applicant, Eagle County Community Development and Engineering staff, and other interested
persons; and,
WHEREAS, on December 17, 2015, the Planning Commission, based upon its findings,
voted to recommend denial of the proposed Sketch Plan; and,
WHEREAS, at its regular meetings held on December 1, 2016, the Board considered the
proposed Sketch Plan, associated plans, the statements and concerns of the Applicant, Eagle
County Community Development and Engineering staff, and other interested persons; and the
recommendation of the Planning Commission; and,
WHEREAS, at a regular meeting held on December 1, 2016, the Board voted 3-0 to
approve the proposed Sketch Plan with the conditions listed herein
WHEREAS, based on the evidence, testimony,exhibits, and study of the Comprehensive
Plan for the unincorporated areas of Eagle County, the 2013 Mid-Valley Area Community Plan,
as well as comments of the Eagle County Community Development Department, comments of
public officials and agencies, the recommendation of the Planning Commission, and comments
from all interested parties, the Board finds as follows:
1. That proper publication and public notice was provided as required by law for the
hearings before the Planning Commission and the Board.
2. That pursuant to ECLURs Section 5-280 B.3.e - Standards, all standards required for
the Sketch Plan have been met.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
the County of Eagle, State of Colorado:
THAT the Sketch Plan described herein and in Eagle County File No. No. SUS-5557 be
and is hereby approved , subject to the following conditions:
1. Except as otherwise modified by this development permit, all material representations
made by the Applicant in this application and in public meeting shall be adhered to
and considered conditions of approval.
2. The Applicant shall meet the Eagle County Affordable Housing Guidelines and
provide affordable housing units as recommended by the Guidelines within the
subdivision.
3. Applicant shall continue to work with staff to incorporate a diversity of housing
types, clustering of uses, and a transition to lower density rural character properties to
the west.
4. A site specific geotechnical assessment shall be completed for each building site at
the time of building permit application.
5. All street, sidewalk and trail improvements within the subdivision shall be
constructed to County standards and in accordance with the Subdivision Improvement
Agreement and shall be dedicated to the public. The Applicant or its successor or
assigns are responsible for construction, maintenance, repair and improvement of all
streets, sidewalks and trails within the subdivision.
6. Applicant shall provide an updated traffic study congruent with the Applicant's
revised layout#2, depicting the subdivision's accesses onto Valley Road.
7. The Applicant or its successor or assigns shall,,,po t and maintain a ten (10') foot

THAT, the Board directs the Planning Depart . } cle a copy of this Resolution

THAT, the Board hereby finds, determines and declares that this Resolution is necessary
for the health, safety and welfare of the citizens of Eagle County.
