IGAc‘9Z64INTERGOVERNMENTALAGREEMENT511THISAGREEMENTismadeandenteredintoasofthis11thdayofMarch,1997,byandbetweentheBOARDOFCOUNTYCOMMISSIONERSOFTHECOUNTYOFEAGLEANDSTATEOFCOLORADO,abodypoliticandcorporate(“theCounty”)andtheTOWNOFAVON,amunicipalcorporation(“theTown”).WHEREAS,theCountyhasadopted,effectiveasofJune23,1992,theUniformBuildingCode,1991Edition,togetherwithappendicesandamendmentstheretoassetforthinCountyResolutionNo.92-44(“BuildingCode”);andWHEREAS,theCountyhasadopted,effectiveasoftheUniformFireCode,1991Edition,togetherwithamendmentstheretoassetforthinCountyResolutionNo.96-157(“FireCode”);andWHEREAS,theTownprovidesandadministersfireprotectionserviceswithintheboundariesofvariousMetropolitanDistrictsaccordingtoIngergovernmentalAgreementsbetweentheTownandtheMetropolitanDistricts;andWHEREAS,portionsoftheMetropolitanDistrictsforwhichtheTownprovidesservicesareunderthejurisdictionoftheCounty’sBuildingandFireCodes(“FireProtectionArea”);andWHEREAS,theCountyhasestablishedandfilledthepositionofCountyBuildingInspector,pursuanttoSection30-28-114,C.R.S.;andWHEREAS,theTownconductsFireCodeinspectionsandreviewsfortheMetropolitanDistrictsthroughthepositionoftheTown’sFireChief;andWHEREAS,theCountywillnametheFireChiefaCountyDeputyBuildingInspectoronlyforthepurposessetforthherein;andWHEREAS,inperformingdutiespursuantheretotheFireChiefshallremainanemployeeoftheTown,andtheTown,actingthroughtheFireChief,andFireChiefwillhavethestatusofindependentcontractorsastotheCounty;andWHEREAS,theCountyhasthepowertoissueandwithholdbuildingpermitspursuanttoSections30-28-205and32-1-1002(1)(d),C.R.S.;andWHEREAS,Section29-1-103,C.R.S.authorizesgovernmentstocooperateorcontractwithoneanothertoprovideanyfunction,serviceorfacilitylawfullyauthorizedtoeachofthecooperatingorcontractingunits;and CWHEREAS,thepurposesofthisIntergovernmentalAgreementaretoprovideplanreview,firecodeinspectionandfirecodeenforcementassetforthhereinwithintheFireProtectionArea.NOW,THEREFORE,itisherebyagreedtoasfollows:1.TheCountyshallprovidetheTownallbuildingplansforalloccupanciesexceptGroupMandGroupR-3,asdefinedbytheBuildingCode,tobeconstructedorlocatedwithintheFireProtectionArea.TheTownshall,throughtheFireChief,provideplanreview,inspectionsandcodeenforcementastothefirepreventionandsuppressionportionsoftheplansandconstructionforallsuchoccupancies.Codeenforcement(beyondstopworkorders)willbedonejointlywiththeCounty.2.TheCountyshallnotissueabuildingpermitforanystructureunlesssuchbuildingplansdemonstratecompliancewiththeCounty’sBuildingCodeandFireCodeandshallnotissueacertificateofoccupancy,whethertemporaryorfinal,foranystructure,exceptGroupMandGroupR-3occupancies,locatedwithintheFireProtectionAreauntilafterapprovedfinalinspectionandsignaturebytheFireChief.3.TheCountyshallprovidetheFireChiefallsubdivision,plannedunitdevelopmentandzoningapplicationswithintheFireProtectionArea.TheTown,actingthroughtheFireChiefshallprovideapplicationreview,inspectionsandenforcementastothefirepreventionandsuppressionportionsoftheapplicationsandsupportingplans.EnforcementwillbedonejointlywiththeCounty.4.TheTownshalltimelysubmitcommentsonsubdivision,plannedunitdevelopmentandzoningapplicationswithintheFireProtectionArea.5.TheTownshallissuepermitsfortheinstallationoffirealarmsandfiresprinklersandcollectandretainsuchfeesasstipulatedintheEagleCountyBuildingCodeResolution.6.TheFireChiefshallatalltimeshaveandmaintainalllicenses,certificates,credentialsandeducationasarerequiredunderthelawsoftheStateofColorado,theBuildingCodeandFireCodetoperformplanreviewandissuebuildingpermitsandcertificatesofoccupancy,andinspectstructuresrelativetofiresafety(includingfiresprinkler)andFireCodecompliance.7.TheTownagreestoindemnify,defendandholdharmlesstheCounty,itsrespectiveagents,officers,servants,andemployeesofandfromanyandallloss,costs,damage,injury,liability,claims,liens,demands,actionsandcausesofactionswhatsoever,arisingoutoforrelatedtotheTown’sintentionalornegligentacts,errorsoromissionsorthatofitsagents,officers,servantsandemployees,whethercontractualorotherwise.Thisindemnityprovisionspecificallyincludesallgeneralbuilding cinspectionservicesperformedby,oronbehalfoftheTownpriortotheeffectivedateofthisAgreement.8.InperforminganyactsordutiesincludedwithinthisAgreement,theFireChiefwillremainanemployeeoftheTownforallpurposes,includingbutnotlimitedtoallemploymentrelatedlawsandregulationsincludingpaymentofWorker’sCompensationandcompliancewiththeFederalFairLaborStandardsAct,andshallnotbeconsideredanemployeeoftheCounty.9.EachpartyofthisAgreementshallprovideitsownpublicliabilityandpropertydamageinsurancecoverageasitmaydeemnecessaryforanypotentialliabilityarisingfromthisAgreement.10.ThisAgreementshallautomaticallyberenewedonthefirstdayofJanuaryofeachyearhereafterunlessearlierterminatedbyeitherparty,withorwithoutcause,bygivingthirty(30)dayswrittennoticetotheotherparty.EXECUTEDasofthedatefirstwrittenabove.COUNTYOFEAGLE,STATEOFCOLORADO,ByandThroughItsBOARDOFCOUNTYCOMMISSIONERSBy:LCth(q&4,àhnettePhillips/IthairmanGeorgeatesCommissionerTOWNOFAVON-JackFa)wcettMayorATTEST:r4:1;--p’7ClerktotheBoardofCountyCommissionersATTEPattyLambert,\inClerk
