damagedordestroyedduetoanactofGodorotherconditionorcircumstancebeyondthecontrolofthesponsor.b.ftwillsuitablyoperateandmaintainnoisecompatibilityprogramitemsthatitownsorcontrolsuponwhichfederalfundshavebeenexpended.20.HazardRemovalandMitigation.Itwilltakeappropriateactiontoassurethatsuchterminalairspaceasisrequiredtoprotectinstrumentandvisualoperationstotheairport(includingestablishedminimumflightaltitudes)willbeadequatelyclearedandprotectedbyremoving,lowering,relocating,marking,orlightingorotherwisemitigatingexistingairporthazardsandbypreventingtheestablishmentorcreationoffutureairporthazards.21.CompatibleLandUse.Itwilltakeappropriateaction,includingtheadoptionofzoninglaws,totheextentreasonable,torestricttheuseoflandadjacenttoorintheimmediatevicinityoftheairporttoactivitiesandpurposescompatiblewithnormalairportoperations,includinglandingandtakeoffofaircra.Inaddition,iftheprojectisfornoisecompatibilityprogramimplementation,itwillnotcauseorpermitanychangeinlanduse,withinitsjurisdiction,thatwillreduceitscompatibility,withrespecttotheairport,ofthenoisecompatibilityprogrammeasuresuponwhichfederalfundshavebeenexpended.22.EconomicNondiscrimination.a.Itwillmakeitsairportavailableasanairportforpublicuseonfairandreasonabletermsandwithoutunjustdiscrimination,toalltypes,kindsandclassesofaeronauticaluse.b.Inanyagreement,contract,lease,orotherarrangementunderwhicharightorprivilegeattheairportisgrantedtoanyperson,firm,orcorporationtoconductorengageinanyaeronauticalactivityforfimilshingservicestothepublicattheairport,thesponsorwillinsertandenforceprovisionsrequiringthecontractorto-(1)furnishsaidservicesonafair,reasonable,andnotunjustlydiscriminatorybasistoallusersthereof,and(2)chargefair,reasonable,andnotunjustlydiscriminatorypricesforeachunitorservice,providedthatthecontractormaybeallowedtomakereasonableandnondiscriminatorydiscounts,rebates,orothersimilartypesofpricereductionstovolumepurchasers.c.-Eachfixed-basedoperatoratanyairportownedbythesponsorshallbesubjecttothesamerates,fees,rentals,andotherchargesasareuniformlyapplicabletoallotherfixed-basedoperatorsmakingthesameorsimilarusesofsuchairportandutilizingthesameorsimilarfacilities.d.Eachaircarrierusingsuchairportshallhavetherighttoserviceitselfortouseanyfixed-basedoperatorthatisauthorizedorpermittedbytheairporttoserveanyaircarrieratsuchairport.AirportAssurances(1-95)Page9of14 cmaeronauticalactivity,repairandmaintenanceofaircraft,saleofaircraftparts,andanyotheractivitieswhichbecauseoftheirdirectrelationshiptotheOperationofaircraftcanberegardedasanaeronauticalactivity,andthatitwillterminateanyexclusiverighttoconductanaeronauticalactivitynowexistingatsuchanairportbeforethegrantofanyassistanceundertheAirportandAirwayImprovementActof1982.24.FeeandRentalStructure.ItwillmaintainafeeandrentalstructureconsistentwithAssurance22and23forthefacilitiesandservicesbeingprovidedtheairportuserswhichwillmaketheairportasself-sustainingaspossibleunderthecircumstancesexistingattheparticularairport,takingintoaccountsuchfactorsasthevolumeoftrafficandeconomyofcollection.Nopartofthefederalshareofanairportdevelopment,airportplanningornoisecompatibilityprojectforwhichagrantismadeundertheAirportandAirwayImprovementActof1982,thefederalAirportActortheAirportandAirwayDevelopmentActof1970shallbeincludedintheratebasisinestablishingfees,rates,andchargesforusersofthatairport.25.AirportRevenues,iftheairportisunderthecontrolofapublicagency,allrevenuesgeneratedbytheairportandanylocaltaxesonaviationfuelestablishedafterDecember30,1987,willbeexpendedbyitforthecapitaloroperatingcostsoftheairport;thelocalairportsystemorotherlocalfacilitieswhichareownedoroperatedbytheowneroroperatoroftheairportanddirectlyandsubstantiallyrelatedtotheactualairtransportationofpassengersorproperty;orfornoisemitigationpurposesonorofftheairport.Provided,however,thatifcovenantsorassurancesindebtobligationsissuedbeforeSeptember3,1982,bytheowneroroperatoroftheairport,orprovisionsenactedbeforeSeptember3,1982,ingoverningstatutescontroLlingtheowneroroperator’sfinancing,providefortheuseoftherevenuesfromanyoftheairportowneroroperator’sfacilities,includingtheairport,tosupportnotonlytheairportbutalsotheairportowneroroperator’sgeneraldebtobligationsorotherfacilities,thenthislimitationontheuseofallrevenuesgeneratedbytheairport(and,inthecaseofapublicairport,localtaxesonaviationfuel)shallnotapply.26.ReportsandInspections.Itwill:(a)submittotheSecretarysuchannualorspecialfinancialandoperationsreportsastheSecretarymayreasonablyrequestandmakesuchreportsavailabletothepublic;(b)makeavailabletothepublicatreasonabletimesandplacesareportoftheairportbudgetinaformatprescribedbytheSecretary;(c)forairportdevelopmentprojects,maketheairportandallairportrecordsanddocumentsaffectingtheairport,includingdeeds,leases,operationanduseagreements,tegulationsandotherinstruments,availableforinspectionbyanydulyauthorizedagentoftheSecretaryuponreasonablerequest;(d)fornoisecompatibilityprogramprojects,makerecordsanddocumentsrelatingtotheprojectandcontinuedcompliancewiththeterms,conditions,andassurancesofthegrantagreementincludingdeeds,leases,agreements,regulations,andotherinstruments,availableforinspectionbyanydulyauthorizedagentoftheSecretaryuponreasonablerequest;andAirportMirances(1-95)PageIiof14
