4.INSURANCEFOREVEN,InsurancecoverageforfunctionsheldattheEagleCountyFairgroundsforbothpublicandprivateeventsshallbedeterminedbytheCounty.Ifinsuranceisrequiredforsaidfunctionorevent,theLesseeshallpurchaseandmaintainduringthetermofthisAgreementinsuranceasillustratedinParagraphsAandBinsuringagainstallclaims,damages,lossesorexpensesarisingoutoforresuftingfromtheuseoftheEagleCountyFairgrounds.TheLessee,inanyeventwhichinvolvesthesellingofalcohol(‘selling”includingacceptingdonations),shallpurchaseandmaintainduringthetermofthisAgreementinsuranceinthefollowingandamountsinsuringagainstallclaims,damages,lossesorexpensesarisingoutoforresukingfromtheuseoftheEagleCountyFairgrounds:AGeneralLiabilityCoveragewhichshallnameEagleCountyasadditionalinsured,andshallbecarriedintheminimumamountof$150,000perinjuryand$600,000peroccurrenceforcoverageofclaimsfordamagesarisingfromLessee’suseoftheFairgrounds,includingbutnotlimitedtopersonalinjuryanddeath,propertydamage,andotherdamagesimposedbylawuponthepartieshereto.LesseeagreestoprovidetheCountywithaCertificateofInsuranceacceptabletotheCounty,namingEagleCountyas“additionalInsured”fourteen(14)dayspriortocommencementofthisLeaseAgreement.B.HostLiquorLiabilityInsuranceisrequiredforanyeventinwhichalcoholisbeingservedwithoutdirectorindirect(includingcovercharge,single-priceadmission,contributionsortips)charge.”HostliquorLiabilityInsuranceshallnameEagleCountyasadditionalinsured,andshallbecarriedintheminimumamountof$150,000perinjuryand$600,000peroccurrence.C.liquorLegalliabilityInsuranceisrequiredforanyeventinwhichalcoholisbeingsold.LiquorlegalliabilityinsuranceshallnameEagleCountyasadditionalinsured,andshallbecarriedintheminimumamountof$150,000perinjuryand$600,000peroccurrence.PleasecontacttheEagleCountyClerkandRecorder’sOfficeformoreinformation.TYPEOFINSURANCEREQUIRED:AGeneralliabilityCoverageXB.HostliquorLiabilityInsuranceC.liquorLegalLiabilityPROOFOFINSURANCEISAHACHEDYESxNO5.DEPOSITSTheLesseeistopayonehalfoftherequireddeposittothereservetheEagleCountyFairgrounds.Theremainderofthedepositandtheentiredailyfeeisdueandpayableaminimumofseven(7)dayspriortotheevent.Failuretopaysaiddepositandfeeseven(7)dayspriortotheeventwillresukinthelossofthelease.Acancellationfeeoftwenty-fivedollars($25.00)willbewithheldfromtheinitialdepositiftheeventiscanceled.Lesseeisresponsibleforanyandalldamagestoleasedpremises.Leasedpremisesaretobeleftinaclean,usableandundamagedcondition.IfLesseefailstocleanleasedspacepremisestothesatisctionoftheCounty,oriftheleasedpremisesincursanydamageduringtheLessee’soccupancy,excludingnormalwearandtear,allcleaninganddamageexpensesincurredbyEaglecountyshallbedeductedformtheabovedeposit,and/oradditionalchargesshallbeassessed.(SeeCleaningandDamageChargesattachedhereto.)Intheeventthatthedepositdoesnotcoverthedamage,andadditionalfeewillbeassessed.Lesseeshallhavefive(5)businessdaystopayanyextrachargeduetodamage.Ifanindividualorgrouphasforfeitedanypartoftheircleaninganddamagedepositinthepast,theamountoftheirnextdepositshallbelefttothediscretionofthecounty.Depositsandfeesaredueandpayableinadvance.2
6.KRURNCLesseeshallobtainkeystotheleasedpremisesonlyaftersaiddepositsandfeesarepaidinfulltotheCounty,FacilitiesshallbecleanandkeysshallbereturnedtotheCountynolaterthanthefirstbusinessdayfollowingtheendofsaidlease.Apenaftyof$5.00perdaywillberetainedfromthedepositforfailuretoreturnthekeyafterthefirstbusinessdayfollowingtheendofsaidlease.7.LICENSESPriortoLessee’seventattheleasedpremises,Lesseeshallobtainanyandalllicensesorinspectionsasmayberequiredbylaw.8.SECURITYLesseeagreestoprovidesecurityfortheeventscontemplatedhereby.LesseeshallcontacttheEagleCountySheriff’sOffice.Lesseeshallberesponsibleforpayinganyandallsecuritycostsassociatedwithsaidevents.Proofofsecurityistobeprovidedseven(7)dayspriortosaidevent.9.ALCOHOLCONSUMPTION_____ALesseeshallbeallowedtoservealcoholinthefollowingdesignatedareas_________________________________B.Lesseeandparticipantsshallbeallowedtoconsumealcoholinthefollowingdesignatedareas______C.LesseeintendstosellalcoholonFairground’spremises.(Aseparateliquorlicenseisrequired.PleasecontacttheEagleCountyClerkandRecorder’sofficeforinformation.)xD.LesseeshallnotservealcoholonFairground’spremises.______E.LesseeandparticipantsshallnotconsumealcoholonFairground’spremises.IC.RULESANDREGULATIONSLesseeagreestoabidebytheEagleCountyFairgroundsRulesandRegulationsassetforthinExhibit“A”,attachedheretoandmadeaparthereofbythisreference.LesseeisresponsibleforenforcingtheEagleCountyFairgroundsRulesandRegulationsduringitseventandwithallguestsandparticipants.I.INDEMNIFICATIONALesseeagreestoholdtheCountyharmlessandassumefullresponsibilityforallclaimsassertedagainsttheCountybythirdpartiesarisingoutofLessee’sactivitiesontheleasedpremises.B.Lesseeagreestheleasedpremisesshallnotbeusedforanypurposewhichwouldrendertheinsurancethereonvoidortheinsuranceriskmorehazardous,orforanypurposeunauthorizedbylaw.12.LESSEE’SDUTIESLesseeagreestoleavetheleasedpremisesinthesamecleanandusableconditionwhichexistedatthetimeofthecommencementofthisLeaseAgreement.PriortothecommencementandterminationoftheLeaseAgreement,LesseeandanauthorizedrepresentativeoftheCountyshallinspecttheleasedpremises,andshallmakewrittennoteofanydamagedoruncleanproperty.IfattheterminationofthisLeasetheCounty’srepresentativefindstheleasedpremisestobeuncleanordamaged,theLesseeshallbeheldresponsibleforanycleaningorrepairofdamagecostsincurredbytheCountyasaresuftofLessee’soccupancyoftheleasedpremises.SaidcostsshallbedeductedfromLessee’sdeposit.IfsaidcostsexceedLessee’sdeposit,Lesseeagreestopayanyadditionalcostsimmediately.13.MISCELLANEOUSALesseeshallpermittheCountytohavefreeaccesstotheleasedpremisesbefore,duringandafterthescheduledevent.B.NomodificationorwaiverofthisAgreementorofanycovenant,condition,orprovisionhereincontainedshallbevalidunlessagreedtoinwritingbyallparties.3

EAGLECOUNTYFAiRGROUNDSRULESANDREGULATIONSPARTI:GENERALRULESANDREGULATIONSAItisintendedthattheEagleCountyFairgrounds(hereinafterreferredtoasthe‘Fairgrounds”)beusedtomeetasmanyneedsandserveasmanyorganizationsaspossible.SchedulingofeventstobeheldattheFairgroundsshallbedoneonafirstcome,firstservebasis,atthediscretionoftheEagleCountyBoardofCountyCommissioners(hereinafterreferredtoas“theCounty”).Noindividual,organizationorcorporationshallbepermittedtoreservetheexhibithallformorethanone(I)eventpermonthunlessotherwiseauthorizedorpermittedbytheCounty.B.SchedulinganduseoftheFairgroundsanditsfacilitiesshallbemanagedbytheEagleCountyManagerorhisdesignee.Adepositand/orfeemayberequiredforspecificfacilities.DepositsshallbereturnedupontheapprovaloftheCountyifthefacilitiesareleftintheconditioninwhichtheywerefound.C.Intheeventthedoesnotcovetthedamage,anadditionalfeewillbeassessed.Lesseeshallhavefive(5)businessdaystopayanextrachargeduetodamage.D.TheCountyshallnotberesponsibleforlossesduetotheft,fireorvandalismduringactivitiesheldonthepremisesoftheFairgrounds.E.Smokingisprohibitedinallbuildings,andwithinfifty(50)feetofanybarn,hayorstrawstoragearea,oraspostedontheFairgroundsproperty.F.Theusershallberesponsibleforparkingcontrolandforinsuringthatfirelanes(12feetminimum)andaccesslanes(12feetminimum)arekeptclearofobstructionduringalleventsoccurringattheFairgrounds.Unlessotherwiseauthorized,parkingshallbeindesignatedareasonly.G.Childrenshallnotbepermittedinanyareaswherelivestockarekeptorusedunlessparticipatinginascheduledevent,orunlesssupervisedoraccompaniedbyaparentoraduftwhoshallacceptcompleteresponsibilityincaseofanyinjury,accidentordamage.H.Alldogsshallbekeptonaleashandunderthecontroloftheowner,unlessparticipatinginascheduledevent,andwillnotbeallowedinanybuildingsunlessthedogoranimalisaserviceanimalassistingadisabledperson.GlassbeveragecontainersareprohibitedonFairgroundspropertyexceptintheexhibitionhall,orasotherwiseauthorized.J.AllCounty-ownedequipmentshallbeoperatedbyCountyEmployeesonly.KAllprops,poles,portablefencepanels,barrels,jumpstandardsshallbereturnedtotheirdesignatedstoragelocationaftereachuse.L.CampingorovernightparkingisprohibitedonFairgroundspropertyunlesspreviouslyauthorizedbytheCounty.M.AllFairgroundsusersshallberesponsibleforcleaningupafterthemselvesandtheiranimals.N.TheCountyreservestherighttodenyanygrouporpersonaccesstotheFairgrounds.0.TheCountyreservestherighttocloseanypartoftheFairgroundstopublicaccess.P.NointoxicatedpersonshallbeallowedontheFairgrounds.Nopersonundertheageof21shallconsumealcoholicbeveragesonFairgroundsproperty.Q.AnyandallpersonsusingthearenashallsignareleaseofliabilityandagreementtoindemnifytheCountyfromanyandallclaimsagainsttheCounty,itsagents,orassigns.RUsershallobtainallnecessarypermitsandlicensespriortoscheduleuse,andshallpromptlypayalltaxes,exciseorlicensefeesapplicabletothesueoftheFairgrounds.S.UsershalluseandoccupytheFairgrounds,oranyportionthereof,inasafeandcarefulmannerandshallcomplywithalllocal,state,andfederallaws,rulesandregulationsasmaybeinforceandeffectduringthescheduledevent,includinganyandallheafthlawsandregulations.T.If,inthejudgementoftheCounty,personsattendingascheduledeventareinviolationoftheseRulesandRegulations,theCountymayterminatetheeventandrequireallpersonstoimmediatelyleavethepremises.U.TheCountyreservestherighttoenterupontheFairgroundspropertyatanytimetoinsurecompliancewiththeseRulesandPgulations.5
PARTII:BOARDINGANIMALSA.UnlessauthorizedbytheCounty,BoardingofAnimalsisprohibitedonfairgroundsproperty.UnlessotherwiseauthorizedbytheCounty,usershallpaya$25.00depositand$5.00perdayfee,foreachstallorpenusedtoinsurethatthepremisesareleftinacleanandundamagedcondition.Cleaninganddamageexpensesshallbedeductedfromthedepositand/oradditionalchargesshallbeassessedtotheuserineventthepremisesarenottheftinacleanandundamagedcondition.B.Auusersshallberesponsibleforthedailycleaningofstallsandholdingpens.Ifuserfailstocleananystallorpen,theCountyshallcleanthemandchargetheuser$25.00perdayperstallorpen.C.Onlyonehorseormuleshallbepermittedinanysinglestall,unlessotherwiseauthorizedbytheCounty.D.TheCountyreservestherighttoinspectanyanimalkeptontheFairgroundspropertyandshallattempttocalltheownerintheeventanyanimalappearstobesickoracarrierofanycontagiousdisease.Incominganimalsthatappearsickshallnotbeadmittedwithoutaveterinarian’scertificateofhealthstatingtheanimalishealthy.AnyanimalthatcontractsacontagiousdiseasemustbemovedimmediatelyfromtheFairgroundsattheowner’sexpense.E.OwnersofanyanimalkeptontheFairgroundspropertyshallberesponsibleforinsuringthattheanimalisproperlyfedandwateredonadailybasis.Nobulkfeedshallbepermittedinthebarnsatanytime.TheCountyshalldesignateafeedstoragearea.F.AnimalsshallnotberelocatedfromtheirassignedstallswithoutthepriorconsentoftheCounty.G.Noanimalshallbepermittedtobekeptorstalledinthearenaarea.H.AtthediscretionoftheCounty,thestallsandpensshallnotbeavailableforuseondayswhenscheduledeventsormaintenanceisplanned.Priortoboardingananimal,allownersofanimalsshallsignawaiveragreeingtoholdtheCountyharmlessandassumefullresponsibilityforallclaimsassertedagainsttheCounty.IhavereadtheforegoingEagleCountyFairgroundsP.iIesandregulationsandfullyunderstandmydutiesandobligationsasstatedintheRulesandRegulations.LESSEE:By:______________________________COMPLIANCE/SECURiTY/DAMAGECHARGESThefollowingchargeswillbeassessedagainstLessee’scleaninganddamagedepositwhenLesseehasfailedtoleaveleasedpremisescleanandfreeofdamageaspertheCounty’sRulesandRegulations.EVENTSALLOWINGALCOHOL$25.00PERMANHOURMINIMUMCHARGE:$150.00EVENTSWITHOUTALCOHOL$25.00PERMANHOURMINIMUMCHARGE:$125.00DAMAGESOTHERTHANNORMALWEARANDTEAPCHARGEWILLBEBASEDONCOSTTOREPAIRORREPLACE.LESSEE’SINITIALS6
