WAGEDETERMINATIONNO.294-2084(Rev.3)ISSUEDATE:051d7/1996Page9of10,REQUESTFORAUTHORIZATIONOFADDITIONALCLASSIFICATIONANDWAGERATE{StandardForm1444(SF1444))ConformanceProcess:Thecontractingofficershallrequirethatanyclassofserviceemployeewhichisnotlistedhereinandwhichistobeemployedunderthecontract(i.e.,theworktobeperformedisnotperformedbyanyclassificationlistedinthewagedetermination),beclassifiedbythecontractorsoastoprovideareasonablerelationship(i.e.,appropriatelevelofskillcomparison)betweensuchunlistedclassificationsandtheclassificationslistedinthewagedetermination.Suchconformedclassesofemployeesshallbe-paidthemonetarywagesandfurnishedthefringebenefitsasaredetermined.Suchconformingprocessshallbeinitiatedbythecontractorpriortotheperformanceofcontractworkbysuchunlistedclass(es)ofemployees.Theconformedclassification,wagerate,and/orfringebenefitsshallberetroactivetothecommencementdateofthecontract.{SeeSection4.6(C)(vi))Whenmultiplewagedeterminationsareincludedinacontract,aseparateSF1444shouldbepreparedforeachwagedeterminationtowhichaclass(es)istobeconformed.Theprocessforpreparingaconformancerequestisasfollows:1)Whenpreparingthebid,thecontractoridentifiestheneedforaconformedoccupation(s)andcomputesaproposedrate(s)2)Aftercontractaward,thecontractorpreparesawrittenreportlistinginorderproposedclassificationtitle(s),aFederalgradeequivalency(FGE)foreachproposedclassification(s),jobdescription(s),andrationaleforproposedwagerate(s),includinginformationregardingtheagreementordisagreementoftheauthorizedrepresentativeoftheemployeesinvolved,orwherethereisnoauthorizedrepresentative,theemployeesthemselves.Thisreportshouldbesubmittedtothecontractingofficernolaterthan30daysaftersuchunlistedclass(es)ofemployeesperformsanycontractwork.3)Thecontractingofficerreviewstheproposedactionandpromptlysubmitsareportoftheaction,togetherwiththeagency’srecommendationsandpertinentinformationincludingthepositionofthecontractorandtheemployees,totheWageandHourDivision,EmploymentStandardsAdministration,U.S.DepartmentofLabor,forreview.(Seesection4.6(b)(2)ofRegulations29CFRPart4).4)Within30daysofreceipt,theWageandHourDivisionapproves,modifies,ordisapprovestheactionviatransmittaltotheagencycontractingofficer,ornotifiesthecontractingofficerthatadditionaltimewillberequiredtoprocesstherequest.5)ThecontractingofficertransmitstheWageandHourdecisiontothecontractor.6)Thecontractorinformstheaffectedemployees.InformationrequiredbytheRegulationsmustbesubmittedonSF1444orbondpaper.Whenpreparingaconformancerequest,the“ServiceContractActDirectoryofOccupations”(theDirectory)shouldbeusedtocomparejobdefinitionstoinsurethatdutiesrequestedarenotperformed
