Home My WebLink AboutC97-018 US Department of the InteriorForm9-1366U.S.DepartmentoftheInteriorcgr?imeniI%.5d97°80(May1996)U:S.GeologicalSurveyCustomerNo.C0045JointFundingAgreementWaterResourFclnvestigationsTHISAGREEMENTisenteredintoasofthe1stdayofOctober1996bytheU.S.GEOLOGICALSURVEY,UNITEDSTATESDEPARTMENTOFTHEINTERIOR,partyofthefirstpart,andtheEagleCounty,partyofthesecondpart.1.ThepartiesheretoagreethatsubjecttotheavailabilityofappropriationsandinaccordancewiththeirrespectiveauthoritiesthereshallbemaintainedincooperationoperationandmaintenanceofstreamflowgagingstationEagleRivernearMinturn,CO(09064600),hereinaftercalledtheprogram.2.Thefollowingamountsshallbecontributedtocoverallofthecostofthenecessaryfieldandanalyticalworkdirectlyrelatedtothisprogram.(a)$4,120.00bythepartyofthefirstpartduringtheperiodOctober1,1996toSeptember30,1997(b)$4,120.0t)bythepartyofthesecondpartduringtheperiodOctober1,1996toSeptember30,1997(c)Additionalorreducedamountsbyeachpartyduringtheaboveperiodorsucceedingperiodsasmaybedeterminedbymutualagreementandsetforthinanexchangeoflettersbetweentheparties.3.Thecostsofthisprogrammaybepaidbyeitherpartyinconformitywiththelawsandregulationsrespectivelygoverningeachparty.4.Thefieldandanalyticalworkpertainingtothisprogramshallbeunderthedirectionoforsubjecttoperiodicreviewbyanauthorizedrepresentativeofthepartyofthefirstpart.5.Theareastobeincludedintheprogramshallbedeterminedbymutualagreementbetweenthepartiesheretoortheirauthorizedrepresentatives.Themethodsemployedinthefieldandofficeshallbethoseadoptedbythepartyofthefirstparttoinsuretherequiredstandardsofaccuracysubjecttomodificationbymutualagreement.6.Duringthecourseofthisprogram,allfieldandanalyticalworkofeitherpartypertainingtothisprogramshallbeopentotheinspectionoftheotherparty,andittheworkisnotbeingcarriedoninamutuallysatisfactorymanner,eitherpartymayterminatethisagreementupon60dayswrittennoticetotheotherparty.7.Theoriginalrecordsresultingfromthisprogramwillbedepositedintheofficeoforiginofthoserecords.Uponrequest,copiesoftheoriginalrecordswillbeprovidedtotheofficeoftheotherparty.8.Themaps,recordsorreportsresultingfromthisprogramshallbemadeavailabletothepublicaspromptlyaspossible.Themaps,recordsorreportsnormallywillbepublishedbythepartyofthefirstpart.However,thepartyofthesecondpartreservestherighttopublishtheresultsofthisprogramand,ifalreadypublishedbythepartyofthefirstpartshall,uponrequest,befurnishedbythepartyofthefirstpart,atcost,impressionssuitableforpurposesofreproductionsimilartothatforwhichtheoriginalcopywasprepared.Themaps,recordsorreportspublishedbyeitherpartyshallcontainastatementofthecooperativerelationsbetweentheparties.9.Billingforthisagreementwillberenderedannually.Paymentsofbillsareduewithin60daysafterthebillingdate.Ifnotpaidbytheduedate,interestwillbechargedatthecurrentTreasuryrateforeach30dayperiod,orportionthereof,thatthepaymentisdelayedbeyondtheduedate.(31USC3717;ComptrollerGeneralFileB-212222,August23,1983.).U.S.GEOLOGICALSURVEYUNITEDSTATESDEPARTMENTOFTHEINTERIORBy_________(SIGNATURE&TITLE)ActingDistrictChief,ColoradoDistrictBy(USEREVERSESIDEIFADDITIONALSIGNATURESAREREQUIRED)
