andth,propertydamage,andherdamagesimposedbylwuponiepartieshereto.LesseeagreestoprovidetheCountywithaCertificateofInsuranceacceptabletotheCounty,namingEagleCountyas“additionalInsured”fourteen(14)dayspriortocommencementofthisLeaseAgreement.B.HostLiquorLiabilityInsuranceisrequiredforanyeventinwhichalcoholisbeingservedwithoutdirectorindirect(includingcovercharge,single—priceadmission,contributionsortips)charge.”HostLiquorLiabilityInsuranceshallnameEagleCountyasadditionalinsured,andshallliecarriedintheminimumamountof$150,000perinjuryand$600,000peroccurrence.C.LicmorLegalLiabulityisrequiredforanyeventinwhichalcoholisbeingsold.LiquorlegalliabilityinsuranceshallnameEagleCountyasadditionalinsured,andshallliecarriedintheminimumamountof$150,000perinjuryand$600,000peroccurrence.PleasecontacttheEagleCountyClerkandRecorder’sOfficeformoreinformation.TYPEOFINStJRNCEREQUIRED:A.GeneralLiabilityCoverageX5.HostLiquorLiabilityInsuranceC.LiquorLegalLiabilityPROOFOFINSURANCEISATTACHEDYES><NO____5.DEPOSITSTheLesseeistopayonehalfoftherequireddeposittoreservetheEagleCountyFairgrounds.Theremainderofthedepositandtheentiredailyfeeisdueandpayableaminimumofseven(7)dayspriortotheevent.Failuretopaysaiddepositandfeeseven(7)dayspriortotheeventwillresultinthelossofthelease.AcancellationfeeofTwenty—fivedollars($25.00)willbewithheldfromtheinitialdepositiftheeventiscancelled.Lesseeisresponsibleforanyandalldamagestoleasedpremises.Leasedpremisesaretobeleftinaclean,usableandundamagedcondition.IfLesseefailstocleanleasedpremissestothesatisfactionoftheCounty,oriftheleasepremisesincursanydamageduringLessee’soccupancy,excludingnormalwearandtear,allcleaninganddamageexpensesincurredbyEagleCountyshallbedeductedfromtheabovedeposit,and/oradditionalchargesshalllieassessed.(SeeCleaningandDamageChargesattachedhereto.) --Inth&rentthatthedepositdoe.notcoverthedamage,andadditionalfeewillbeassessed.Lesseeshallhavefive(5)businessdaystopayanyextrachargeduetodamage.Ifanindividualorgrouphasforfeitedanypartoftheircleaninganddamagedepositinthepast,theamountoftheirnextdepositshalllielefttothediscretionofthecounty.Depositsandfeesaredueandpayableinadvance. 6.KEYRiiIRNLeseshallobtainkeystotheleasedpremisesonlyaftsaiddepositsandfeesarepaidinfullto.theCounty.FacilitishallliecleanandkeysshallbereturnedtotheCountynolatthanthefirstbusinessdayfollowingtheendofsaidLease.Apenaltyof$5.00perdaywilllieretainedfromthedeposforfailuretoreturnthekeyafterthefirstbusinessd2followingtheendofsaidlease.7.LICENSESPriortoLessee’seventattheleasedpremises,Lesseeshal.obtainanyandalllicensesorinspectionsasmayberequiredli’law.8.SECURITYLesseeagreestoprovidesecurityfortheeventscontemplatedhereby.LesseeshallcontacttheEagleCountySheriff’sOfficeandmakesecurityarrangementsacceptabletotheEagleCountySheriff’sOffice.Lesseeshalllieresponsibleforpayinganyandallsecuritycostsassociatedwithsaidevents.Proofofsecurityistolieprovidedseven(7)dayspriortosaidevent.9.ALCOHOLCONSUMPTION_____A.Lesseeshallbeallowedtoservealcoholinthefollowingdesignatedareas______________________________B.Lesseeandparticiapantsshalllieallowedtoconsumealcoholinthefollowingdesignatedareas__________________C.LesseeintendstosellalcoholonFairground’spremises.(Aseperateliquorlicenseisrequired.PleasecontacttheEagleCountyClerkandRecorder’sofficeforinformation.)0.LesseeshallnotservealcoholonFairgrounds’spremises.E.Lesseeandparticipantsshallnotconsumealcoholonfairgroundspremises.10.RULESANDREGULATIONSLesseeagreestoabidebytheEagleCountyFairgroundsRulesandRegulationsassetforthinExhibit“A,”attachedheretoandmadeaparthereofbythisreference.LesseeisresponsibleforenforcingtheEagleCountyFairgroundsRulesandRegulationsduringitseventandwithallguestsandparticipants. 11.%tflCATON--A.LesseeagreestoholdtheCountyharmlessandassumefu.responsibilityforallclaimsassertedagainsttheCountyIthirdpartiesarisingoutofLessee’sactivitiesontheleafpremises.3.Lesseeagreestheleasedpremisesshallnotbeusedfcanypurposedwhichwouldrendertheinsurancethereonvoidctheinsuranceriskmorehazardous,orfaranypurposunauthorizedbylaw.12.LESSEE’SDUTIESLesseeagreestoleavetheleasedpremisesinthesamecleaiandusableconditionwhichexistedatthetimeofthecommencemenlofthisLeaseAgreement.PriortothecommencementandtarminatjoyoftheLeaseAgreement,LesseeandanauthorizedrepresentativeotheCountyshallinspecttheleasedpremises,andshallmaic€writtennoteofanydamagedoruncleanproperty.rzattiterminationofthisLeasetheCounty’srepresentativefindstheleasedpremisestolieUncleanordamaged,lesseeshalllieheldresponsibleforanycleaningorrepairofdamagecostsincurredbytheCountyasaresultofLessee’soccupancyoftheleasedpremises.SaidcostsshallliedeductedfromLessee’sdeposit.Ifsaidcostsexceedlessee’sdeposit,Lesseeagreestopayanyadditionalcostsimmediately.13.MISCElLANEOUSVA.LesseeshallpermittheCountytohavefreeaccesstotheleasedpremisesbefore,duringandafterthescheduledevent.5.NomodificationorwaiverofthisAgreementorofanycovenant,condition,orprovisionhereincontainedshalllievalidunlessagreedtoinwritingbyallparties.c.ThiswrittenAgreementembodiesthewholeagreementbetweenthepartiesheretoandtherearenoinducements,promises,terms,conditions,orobligationsmadeorenteredintoeitherbytheCountyorLesseeotherthanthatcontainedherein.D.Allagreementsandcovenantshereinareseverable,andintheeventthatanyofthemshallbeheldinvalidbyacourtofcompetentjurisdiction,thisAgreementshallbeinterpretedasifsuchinvalidagreementorcovenantwerenotcontainedherein. EAGLECOUNTYF’A”GROUNDSCRULESANDREG’TIONSPART1.GENALRULESANDREGULATIONSA.ItisintendedthattheEaglecountyFairgrounds(xereinaftereferredtoasthe“Fairqrounds’)lieusedtomeetasmanneedsandserveasmanyorganizationsaspossible.SchedulincofeventstobeheldattheFairgroundsshallliedoneonafirstcome,firstservebasis,atthediscretionoftheEaglecountyBoardofCountyCommissioners(hereinafterreferredtoas“theCounty”).Noindividual,organizationorcorporationshalllie.permittedtoreservetheexhibithailformorethanone(1)eventpermonthunlessotherwiseauthorizedorpermittedbytheCounty.B.SchedulinganduseoftheFairgroundsanditsfacilitiesshallbemanagedbytheEagleCountyManagerorhisdesignee.Adepositand/orfeemayberequiredforspecificfacilities.DepositsshallliereturnedUpontheapprovaloftheCountyifthefacilitiesareleftintheconditioninwhichtheywerefound.C.Intheeventthedepositdoesnotcoverthedamage,anadditionalfeewilllieassessed.Lesseeshallhavefive(5)businesSdaystopayanyextrachargeduetodamage.D.TheCountyshallnotlieresponsibleforlossesduetotheft,fireorvandalismduringactivitiesheldonthepremisesoftheFairgrounds.E.Smokingisprohibitedinallbuildings,andwithinfifty(50)feetofanybarn,hayorstrawstoragearea,oraspostedontheFairgroundsproperty.F.Theusershalllieresponsibleforparkingcontrolandforinsuringthatfirelanes(12feetminimum)andaccesslanes(12feetminimum)arekeptclearofobstructionduringalleventsoccurringattheFairgrounds.Unlessotherwiseauthorized,parkingshallbeindesignatedareasonly.G.Childrenshallnotliepermittedinanyareaswherelivestockarekeptorusedunlessparticipatinginascheduledevent,orunlesssupervisedoraccompaniedbyaparentoradultwhshallacceptcompleteresponsibilityincaseofanyinjuryaccidentordamage.H.Alldogsshalllieonaleashandunderthecontroloftheowner,unlessparticipatinginascheduledevent,andwillnotbeallowedinanybuildingsunlessthedogoranimalisaserviceanimalassistingadisabledperson.I.GlassbeveragecontainersareprohibitedonFairgroundspropertyexceptintheexhibitionhail,orasotherwise authorized.I.AUCounty—ownedequipment(1ilbeoperatedbycounEmp..yeesonly.K.Allprops,poles,portablefencepanels,barrelsandjulstandardsshallliereturnedtotheirdesignat2dstoraclocationaftereachuse.L.CampingorovernightparkingisprohibitedonFairgroundpropertyunlesspreviouslyauthorizedbytheCounty.14.AllFairgroundsusersshalllieresponsibleforcleaninguafterthemselvesandtheiranimals.N.TheCountyreservestherighttodenyanygrouporpersoraccesstotheFairgrounds.0.TheCountyreservestherighttocloseanypartoftheFairgroundstopublicaccas.P.NointoxicatedpersonshalllieallowedontheFairgrounds.Nopersonundertheageof21shallconsumealcoholicbeveragesonFairgroundsproperty.Q.AnyandallpersonsusingthearenashallsignareleaseofliabilityandagreementtoindemnifytheCountyfromanyandallclaimsagainsttheCounty,itsagents,orassigns.R.Usershallobtainall,necessarypermitsandlicensespriortoscheduleduse,andshallpromptlypayalltaxes,exciseorlicensefeesapplicabletothesueoftheFairgrounds.S.UsershalluseandoccupytheFairgrounds,oranyportionthereof,inasafeandcarefulmannerandshallcomplywithalllocal,state,andfederallaws,rulesandregulationsasmaylieinforceandeffectduringthescheduledevent,includinganyandallhealthlawsandregulations.T.If,intheudgementoftheCounty,personsattendingascheduledeventareinviolationoftheseRulesandRegulations,theCountymayterminatetheeventandrequireallpersonstoimmediatelyleavethepremises.U.TheCountyreservestherighttoenterupontheFairgroundspropertyatanytimetoinsurecompliancewiththeseRulesandRegulations.PART2.BOARDINGANIMALSA.UnlessauthorizedbytheCounty,BoardingofAnimalsisprohibitedonFairgroundsproperty.UnlessotherwiseauthorizedbytheCounty,usershallpaya$25.00depositand$5.00perdayfee,foreachstallorpenusedtoinsurethatthepremisesareleftinacleanandundamagedcondition.
