HomeMy WebLinkAboutC97-007 Town of Vail Intergovernmental Mutual Aid Agreement - Fire Protection PlanCC)C’970704October31,1995INTERGOVERNMENTALMUTUALAIDAGREEMENT1996—1997THISAGREEMENT,forwildfireprotectionandrelatedservices,(hereinafterreferredtoas“Agreement”),madeandenteredintohis/dayofJ,fr,)byandbetweentheCountyEagle,StateofColorado,abodycorporateandpoliticandtheTownofAvon,Minturn,RedCliff,andVail,StateofColoradorespectiveTownCouncilsandtheFireProtectionDistrictsofEagleandGypsum,byandthroughtheirrespectiveBoardofDirectors,(hereinafterreferredtoas“theParties”).WHEREAS,itisrecognizedbythePartiestothisAgreementthatthepublichealth,safety,andwelfareoftheinhabitantsoftheirrespectiveareaswouldbebestservedbyprovidingthehighestqualityofback-uporadjunctservicespossible,shouldtheneedarise,andWHEREAS,eachPartywishestohavetheabilityofsecuringtheassistanceoftheother.IntheeventofanincidentthatrendersitselfincapableofbeingcontrolledbyasingleParty,arequestforMutualAidassistancewillbetransmitted;andWHEREAS,eachPartywillingoodfaith,makeanattempttoassisttheotherbasedontheirneedsandspecificrequest;andWHEREAS,suchintergovernmentalmutualaidagreementsareauthorizedandprovidedforbytheprovisionsofSections29—5-101,etseq.,and29-1-201etseq.,respectively,C.R.S.NOWTHEREFORE,forandinconsiderationofthemutualcovenants,conditions,andpromisescontainedherein,thePartiesheretoagreeherebyasfollows:ARTICLEIDEFINITIONSForpurposesofthisAgreement,thefollowingphrasesaredefinedasfollows:1.1“RequestingParty”:ThepartytothisAgreementinneedofandrequestingfirefightingassistancewithinitsjurisdiction.
CC1.2“AssignedParty”:ThepartytothisAgreementrenderingfirefightingassistanceoutsideofitsjurisdictiontotheotherpartytothisAgreementrequestingthesame.ARTICLEIITERMANDTERMINATION2.1TERM.TheinitialtermofthisAgreementshallcommenceontheexecutionofthisagreementbyallpartiesheretoandshallendonDecember31,1997,unlesssoonerterminatedasprovidedinSection2.2below.ThisAgreementshallautomaticallyberenewedforsuccessiveone(1)yearterms,beginningonJanuary1,1998unlessnoticeofterminationisgiveninwritingbyanyPartytotheothersonananniversarydateoftheAgreement,inwhicheventthisAgreementshallterminateonthenextfollowinganniversarydate.2.2TERMINATION.AnytimeduringthetermofthisAgreement,thePartyaggrievedbyamaterialbreachmayserveonthePartyresponsibleforthebreach,awrittennoticedescribingsaidbreach.IfthebreachisnotcuredtothesatisfactionoftheotherparticipatingParties,theaggrievedpartymaythenserveontheresponsiblePartywrittennoticeoftermination.AnyPartymayterminatethisAgreementonthirty(30)daysnoticewithoutcause,orimmediatelywithcause.ARTICLEIIIOPERATIONALPLAN3.1OPERATIONALPLAN.Themutualassistancetoberenderedunderthisagreementshallbeavailableuponthedevelopmentandapprovalbythepartiesheretoofanoperationalplan,hereinafterknownastheEagleCountyAnnualFireProtectionPlan.Theplanshalloutlinetheexactproceduretobefollowedinrespondingtoarequestforassistance.Eachpartyshallthendesignateanappropriaterepresentative(s)withinitsjurisdictionwhois/areempoweredtorequestassistanceunderthisagreement.3.2ANNUALREVIEWOFOPERATIONALPLAN.Thepartiesshallmeetatleastannuallytoreviewand,ifnecessary,toproposeamendmentstotheEagleCountyAnnualFireProtectionPlan.AnyproposedamendmentsshallnotbeeffectiveuntilapprovedinwritingbythepartiestothisAgreement.ARTICLEIVEQUIPMENT4.1PURPOSE.Itisthepurposeofthisarticletoindicatetheequipmentinvolvedinaresponseastoitsparticulartype,aswellastheminimumamounttobesenttoacknowledgearequest.
CC4.2RESPONSEFORFIRE.BasedonaMutualAidrequestforassistanceasitappliestowildfiresuppression,thefollowingPartiesagreetoattempttomakeavailablewhateverisrequested,andonlybasedonavailability(see4.4).4.3SPECIALIZEDEQUIPMENT.ForthebenefitofeachParty,allPartiesshallacknowledgespecialequipmentthatmaybemadeavailableintheeventofanoutoftheordinaryincident,andonlybasedonavailability(see4.4).4.4PRIMARYRESPONSIBILITY.EachPartyunderstandsthattheirprimaryresponsibilitywillcontinuetoliewithintheirnormaljurisdiction,andinthatcapacitytheyretaintherighttoevaluatecircumstanceswithintheirownareapriortoansweringaMutualAidrequest.ThisAgreementisnotintendedtohamperthenormaloperationsofanyoftheParties.4.5EQUIPMENTANDPERSONNELUSERATES.Reimbursablemanpowerandequipmentuseshouldberecordedontheappropriateformswithinsevendaysofsaidfire.Rateswillbecomputedhourlyaftertheinitialnochargeperiod.Timesofusewillbedeterminedbyshiftrecords.AllbillsandreportsforuseofequipmentandmanpowerwillbesenttoEagleCountySheriff’sOffice,P.O.Box359,Eagle,CO81631.Equipmentandpersonnelratesareasfollowsfor:PumperorEngine:$150.00anhourwithOperatorTanker:$125.00anhourwithOperatorBrush:$40.00anhourwithOperatorPickup:$20.00anhourTrainedFirefighter:$10.00anhourRescue:$125.00anhourCommandOfficerRate:$25.00anhourARTICLEVRESPECTFORJURISDICTION5.1CONSIDERATION.ItisunderstoodthatrespondingPartiesleavingtheirrespectivedistrictstoassistwithaMutualAidrequestareultimatelyinchargeoftheirmenandequipment.Itisthepurposeofthisconsiderationtoindicatetheneedforanunderstandingofrespectforjurisdiction.AllrespondingPartiestoanareaoutsidetheirjurisdictionshallgivetotalconsiderationfortherules,regulations,standardoperatingprocedures,andproperguidancebeingadministeredbytheauthorityhavingjurisdiction.
CCThePartiesshallnotifyeachotherofthename,addressandtelephonenumberoftherepresentative(s)authorizedtodirectmutualaidactivitieswithintheirrespectivejurisdictions.ARTICLEVIRESPONSIBILITYFORPERSONNELANDCOMPENSATION46.1PERSONNEL.EverypersonemployedinorprovidingservicesfortheperformanceofservicesandfunctionspursuanttothisAgreementisthesoleresponsibilityofthepartybywhomthatpersonisemployedonafull—timebasis,orvolunteeringservices,andnopersonprovidingserviceshereunderandemployedbyeitherPartyhereundershallhaveanyrightassociatedwithemploymentbyorprovisionofservicestoanotherParty.NopartyshallbecalledupontoassumeanyliabilityforthepersonnelperformingserviceshereunderasaresultoftheemploymentorprovisionofsuchpersonnelbyanotherParty,oranyliabilityotherthanthatprovidedforintheAgreement.NoPartyshallbeliableforcompensationorindemnitytoanyemployeeorvolunteerofanotherPartyforinjuryorsicknessarisingoutofhisorheremploymentorservicesrenderedunderthisagreement.6.2COMPENSATION.PursuanttoSections29—5-109and25—5-110,respectively,C.R.S.,allcompensationandotherbenefitsenjoyedbyeverypersonemployedintheirownjurisdictionshallextendtotheservicestheyperformunderthisAgreementincluding,withoutlimitation,workmen’scompensationcoverageandpensionfundpayments.ARTICLEVIIINDEMNIFICATION7.1INDEMNIFICATION.Allfirefighters,whethertherequestingortheassignedparty,shallbeprotectedfromliabilityforanyactionstakenduringthecourseofdutyoffirefighting,pursuanttotheprovisionsassetforthinC.R.S.Sections24—10-102.ShouldanyliabilityaccrueundertheprovisionofC.R.S.Sections24-10-102q.,orotherwise,duetothenegligentorotherwisetortuousactofthefirefightingofficer,whileperformingsaidfirefightingassistance,orduetothedirectionoftherequestingparty,saidliabilityshallbeimposedupontherequestingpartyandnotupontheassignedparty.7.2EachPartytothisAgreementshallwaiveanyandallclaimsagainsttheotherpartyheretowhichmayariseoutofitsactivitiesoutsideofitsrespectivejurisdictionwhilerenderingaidunderthisAgreement.
j7.3EachPartyshallindemnifyandsaveharmlesstheotherpartytothisAgreementfromallclaimsbythirdpartiesforpropertydamageorpersonalinjurywhichmayariseoutoftheactivitiesoftheotherpartytothisAgreementoutsideitsrespectivejurisdictionwhilerenderingaidunderthisAgreement.Inthisrespect,allimmunitiesfromliabilityenjoyedbyapartytotheAgreementwithinitsjurisdictionshallextendtoitsparticipationinrenderingmutualaidunderthisAgreementoutsideitsjurisdiction.ARTICLEVIIISTATUTORYAUTHORITY8.1STATUTORYAUTHORIZATION.TheprovisionsofSections29-5—101through29—5-111,inclusive,C.R.S.,arefullyapplicableandtherebymadeapartofthisAgreementfully.8.2GOVERNMENTALPURPOSES.TheservicesperformedandexpendituresmadunderthisAgreementshallbedeemedforpublicandgovernmentalpurposes.ARTICLEIXMISCELLANEOUS9.1ThiswrittenAgreementembodiesthewholeagreementbetweenthepartiesheretoandtherearenoinducements,promises,terms,conditions,orobligationsmadeorenteredintoeitherbyPartiesotherthancontainedherein.9.2AllAgreementsandcovenantshereinareseverable,andintheeventthatanyofthemshallbeheldinvalidbyaCourtofcompetentjurisdiction,thisAgreementshallbeinterpretedasifsuchinvalidagreementorcovenantwerenotcontainedherein.9.3EachPartyhasrepresentedtoeachotherPartytothisAgreementthatitpossessedthelegalabilitytoenterintothisAgreement.IntheeventthataCourtofcompetentjurisdictiondeterminesthatanyofthepartiesheretodidnotpossessthelegalabilitytoenterthisAgreement,thisAgreementshallbeconsiderednullandvoidbetweensuchpartyandallotherPartiesasofthedateofsuchCourtdetermination.9.4ThisAgreementmaybeexecutedbythepartiesinmultiplecopies,eachcopyofwhichshallhavethesameforceandeffectasanoriginal.

C0EAGLECOUNTYANNUALFIREPROTECTIONPLAN1996—1997PURPOSEThepurposeofthisplanistosetforththemeansofimplementingtheEagleCountyAgreementfrco2perativeFireProteqtion,executedbytheCountyand/4f2)tf”this/ofl9.Q,asperMutualAidAgeement.Thisplanoutlinespoliciesandresponsibilitiesofthecooperatingagenciesinordertorespondtofiresinasafe,prompt,andeffectivemanner.A.GENERALRESPONSIBILITIESResponsibilityforfiresuppressioninanareaoutofafireprotectiondistrictissharedjointlybythecountyandthevariousfireprotectiondistrictsorfiredepartments,andreimbursablecostsshallbecoveredasmutuallyagreeduponbythecountyanddistrictordepartmentinvolvedpertheIntergovernmentalAgreement.Mapsappendedtothisoperatingplanshowboundariesdelineatingfederal,state,county(privateland)andfiredistrict/departmentareasofmutualresponsibility.(SeeAppendixI.)B.MOBILIZATIONPLAN1.InitialAttack/UnifiedCommand/ICSTheIncidentCommandSystem(ICS)willbeutilizedonallfires.ICSisastandardizedmethodofmanagingemergencyincidents.Itisbasedon:AcommonorganizationalstructureCommonterminology(AppendixII)CommonoperatingproceduresKnownqualificationsofemergencypersonnelICSdoesnotinfringeonthedailyroutine,responsibilitiesorauthoritygiveneachagencybystatute.But,ifatransferofauthorityisnecessaryasconditionschange,ICSsmoothsoutthetransitionsinceorganizationalstructureandlinesofauthorityareclearlyidentified.1
00INITIALACTIONonanyfireoccurringontheareascoveredbythisagreementshallbetakenbythefireorganizationthatfirstarrivesatthesceneofthefire,irrespectiveofjurisdictionalboundaries,buttheagencytakinginitialactionshallreportthefireimmediatelytothejurisdictionalagency.Intheeventtheassistingagencyarrivesfirst,theofficerinchargeofitsforcesshallserveasActingIncidentCommanderuntilthearrivalofthesuppressionforces,orappropriateofficer,ofthejurisdictionalagency,whoshallthentakechargeofthefireasIncidentCommander.Theagencytakinginitialactiononanyfireshallremainonthefireuntilthefireiscompletelycontrolledandout,oruntilrelievedbyanassistingagencyorthejurisdictionalagency.Thisincludesthereleaseoftheagency’smanpowerandequipmentinsofarastherelievingagency’smanpowerandtoolsareavailabletoreplacethem.Ifafirecrossesjurisdictionalboundariesandbecomesamulti-agencyfire,aUNIFIEDCOMMANDwillbeformed.ThepurposeoftheUnifiedCommandwillbetomeetasagroupandidentifypoliciesanddirectionresultinginonecommonsetofobjectivesforimplementationbythesuppressionforces.TheUnifiedCommandwillconsistofrepresentativesofthefollowingagenciesthathaverespondedtothatincident:-EagleCounty-Sherifforhisdesignee—ColoradoStateForestService—DistrictForesterorhisdesignee—FederalLandAgencyinvolved—ForestSupervisor(USFS)ordesignee,DistrictManager(BLM)ordesignee-FireDistrict/DepartmentChiefordesigneeIfthefirecontinuestoescalatetheUnifiedCommandGroupwillconsiderenactingtheEOC.2.ResourcesAvailableEachagencywillkeepallothersinformed,throughoutthefireseason,offiredanger(calculatedbyUSFS),suppressionactivities,andchangesinlocationofmanpowerandequipment.2
0C)3.AdditionalSuppressionResourcesAllrequestsfornon—federalagencyfireforceswillbemadethroughtheapplicableagencyrepresentative.Allrequestsforstateorfederalagencyfireforceswillbemadethroughtheapplicableagencyrepresentative.4.StateEmergencyFireFund(EFF)EagleCountyisamemberoftheStateEFFAgreement.ThepurposeofthisfundistoprovidefundstocovercostsassociatedwithalargefireonprivateorstatelandsthattheresourcesoftheCOUNTYcannothandle.ImplementationoftheEmergencyFireFundcanonlybedonebytheStateForesterofColoradoupontherecommendationofthelocalCSFSDistrictForesterfollowingarequestfromtheCounty.Forthisreason,itisimportantthattheCSFSDistrictForesterorhisdesigneebenotifiedimmediatelyofmajorfiresonprivateorstatelandswithintheCounty.Shouldthefiresurpass,orthreatentosurpass,theabilityofCountyresourcestocontainit,EFFimplementationcanonlyoccurwithaCSFSrepresentativeonthesceneofthefire.Whenafire“goesEFF”CSFSassumesfullresponsibilityandauthorityforallsuppressionactivityuntilthefireisreturnedtoCountyresponsibility.TheStateForesterwilldesignateaLineOfficerwhowillassumetheCSFSpositionontheUnifiedCommandGroup.C.AIROPERATIONS1.UseandOrderingofAirSupportRequestsforairattackwillbemadeonlybyaresponsibleofficialofthejurisdictionalagency.AirattackwillbehandledbyqualifiedpersonnelofeithertheBLNorUSFSinaccordancewiththeagency’sregulations.2.CostsandPaymentResponsibilitiesSeeAirAgreement,County,1992.3
CCD.REIMBURSEMENTS1.CostsReimbursableREIMBURSABLEMANPOWERANDEQUIPMENT-Reimbursablemanpowerandequipmentuseshouldberecordedontheappropriateformswithinsevendaysofsaidfire.2.RatesEQUIPMENTUSERATES.Currentratesareestablishedinsection4.5oftheIntergovernmentalAgreement.FIREEQUIPMENTRENTALnotcoveredintheAppendixwillnotreceivereimbursementexpensesfromjurisdictionalagenciesrequiringthemunlessratesaremutuallyagreedto,inwriting,andsaidequipmentisrequestedbythejurisdictionalagency.PERSONNEL-Thewagesofpersonnelshallbeattherateasestablishedbythecooperatingagencyasoutlinedinsection4.5oftheIntergovernmentalagreement.NOCHARGEPERIOD.Rateswillbecomputedhourlyaftertheinitial(3)hourmutualaidburnperiodasestablishedin4.5oftheIntergovernmentalAgreement.E.OTHERPROCEDURES1.BurningPermitsStandardoperatingproceduresforBURNINGPERMITSFORPRESCRIBEDBURNSwillbeadheredto.ThejurisdictionalagencywillfollowagencyprescribedburningpolicyandproceduresandNOTIFYCOOPERATINGAGENCIESOFBURNINGEROJECTS.Suchnotificationshouldincludethelocation,timing,andnatureofprescribedburnsandshouldbegivenwellinadvanceoftheburnandpriortoignitiononthedayoftheburn.2.BurningRestrictionsREQUESTSFORCLOSURESPROHIBITINGOPENFIRESduringhazardousperiodswillbemadetoincludeprivate,state,ELMandUSFSlands.Theserequestswillbemadebyjurisdictionalagencywithnotificationgiventocooperatingagencies.Requestsshouldbesubmittedinwritingtotherespectivegrantingauthority.-4
0C3.MaintenanceandAccessRoads—UseofroadsonForestServiceandBLMlandspresentlyclosedtovehiculartravel(outsideofwildernessareas)isherebyauthorizedtoallpartiestothisAnnualOperatingPlan.Suppressionwithindesignatedwildernessand/or“roadless”areaswillnotbeconductedthroughexpressordersfromUSFS.4.WildfirePreventionActivitiesDISTRIBUTIONOFFIREPREVENTIONMATERIALSwillbehandledbythejurisdictionalagenciesinEagleCounty.DistributionshouldcoverschoolsandcommercialestablishmentswithintheCounty.TheCSFSwillsupplytheCountySheriffandfiredistrictswithCFFP(SmokeyBear)materialsfordistributiononrequestbythedepartment.EachagencywillprepareandreleaseFIREPREVENTIONMATERIALANDRADIO/TVPRESENTATIONSaccordingtotheirownpreventionplans.Coordinationwithcooperatingagenciesshouldbefollowedinordertopreventaconflictinreleasedmaterial.Wherepertinent,allnewreleasesforfirepreventionwillcarryUSFS,CSFS,firedistrictorCountySheriffby-line.5.LawEnforcementActionsForthepurposeoffirelawenforcement,thejurisdictionalfireagenciesandEagleCountywillfollowappropriateLAWENFORCEMENTREGULATIONS.Trafficcontrolwillbeprovidedbytheresponsiblelawenforcement,uponrequest,toexpeditetheroutingofvehiclesandpersonneltoandfrommajorfiresandtoexcludeunauthorizedpersonnelfromthefirearea.Itwillbetheresponsibilityoftheagencyuponwhoselandthefireoriginatestotakelawenforcementaction.Wheninitialattackismadebyotherthanthejurisdictionalagency,theassistingagencywillimmediatelygatherandpreserveinformationandevidencepertainingtothecauseofthefireforthejurisdictionalagency.Inthecaseofanyrestrictionsonburningorpublicmovementsbecauseofextremefiredanger,eitherbyGovernor’sproclamationorbylocalissue,theCountywillberesponsibleforenforcementonalllands.5
CC6.FireInvestigationandIncidentFinalReportsThecooperatingagencieswilltakewhatstepsnecessarytogatherEVIDENCEOFFIRECAUSEasoutlinedinthejurisdictionalagency’sfirecontrolprocedures.CIVILANDCRIMINALFOLLOW-UPACTIONwillbetakenbythejurisdictionalagency.FiredistrictswillfileincidentreportswithEagleCountySheriff’sOfficeonformsprovidedforreportingtoNFIRSfollowingconclusionofeachincident.F.WILDFIREDETECTIONCooperatingagencieswillkeepeachotherinformedthroughoutthefireseasonoflightningactivityandwillforwardanyreportsofwildfirereceivedtotheColoradoStatePatrolDispatcherwhowillnotifyallagenciesthroughroutineprocedures.G.FIREDANGERMONITORING&INFORMATIONThelocalofficesoftheUSFSwillmonitorlocalfiredangerlevelsandwillnotifytheECSOofanysignificantchangesinlevel.NationalWeatherServiceinDenverperiodicallyissues“RED-FLAG”watchesandwarningbulletinstoUSFSRegionalOfficeandtoCSFSStateOffice.Theseofficesnotifyrespectivelocalcontactswho,inturn,willensurealllocalagenciesareinformed.H.DISPUTERESOLUTIONPROCEDURESTheprimarypurposeofthisoperatingplanistoensurepromptsuppressionoffires.Anyinter-agencydisputearisingfromtheseprocedureswillberesolvedon—sitebytheUnifiedCommandGroup.Whennecessary,followingtheconclusionofthefireincident,apanelofagencyrepresentatives,otherthantheparticipantsintheincident,willreviewandresolvethedispute.Thisplanwillremainineffectuntilsuperseded.ParticipatingagencieswillmeetpriortoApril1steachyeartoreviewandupdatetheplanforofficialapproval.6
