Home My WebLink AboutC18-002 Scott Grover, Pro Rodeo AnnouncerSECOND AMENDMENT TO AGREEMENT BETWEEN EAGLE COUNTY, COLORADO AND SCOTT GROVER, PRO RODEO ANNOUNCER THIS SECOND AMENDMENT ("Second Amendment") is effective as of 01/03/2018 by and between Scott Grover, Pro Rodeo Announcer (hereinafter "Contractor") and Eagle County, Colorado, a body corporate and politic (hereinafter "County"). RECITALS WHEREAS, County and Contractor entered into an agreement dated the 23rd day of February, 2016, for certain Services (the "Original Agreement"); and WHEREAS, the Original Agreement contemplated that the Contractor would perform certain Services for the 2016 Eagle County Fair and Rodeo; and WHEREAS, by a First Amendment dated the P day of January, 2017, the parties amended the Original Agreement to include Services for the 2017 Eagle County Fair and Rodeo and extended the term to February 23, 2018; and WHEREAS, County desires to have Contractor perform the same Services for the 2018 Eagle County Fair and Rodeo; and WHEREAS, the term of the Original Agreement expires on the 23rd day of February, 2018, and the parties desire to extend the term for an additional year. SECOND AMENDMENT NOW THEREFORE, in consideration of the foregoing and the mutual rights and obligations as set forth below, the parties agree as follows: 1. The Original Agreement shall be amended to include the same Services as described in Exhibit A of the Original Agreement to be performed at the 2018 Eagle County Fair and Rodeo on the following dates: July 25, July 26, July 27 and July 28, 2018. 2. The compensation for the Services to be performed at the 2018 Eagle County Fair and Rodeo shall not exceed $6,800.00 as established in Exhibit A of the Original Agreement. County will additionally provide Contractor with one (1) hotel room of County's choice for use by Contractor from July 25, 2018 through July 28, 2018. Check-in/check-out times and use of the rooms will be subject to the hotel's policies and procedures. County will provide one horse stall and three bales of hay. 3. The term of the Original Agreement is hereby extended to the 23rd day of February, 2019. C18-002 4. Capitalized terms in the Second Amendment will have the same meaning as in the Original Agreement. To the extent that the terms and provisions of the Second Amendment conflict with modify or supplement portions of the original Agreement, the terms and provisions contained in this Second Amendment shall govern and control the rights and obligations of the parties. 5. Except as expressly altered, modified and changed in this Second Amendment, all terms and provisions of the Original Agreement shall remain in full force and effort, and are hereby ratified and confirmed in all respects as of the date hereof. 6. This Second Amendment shall be binding on the parties hereto, their heirs, executors, successors, and assigns.
