HomeMy WebLinkAboutR17-087 ECHDA Contract to Buy Miller Ranch Unit 69 Marble F129 Commissioner OMV QuU'L - IJ.t.%/YL-`'' moved adoption of the following resolution: EAGLE COUNTY HOUSING AND DEVELOPMENT AUTHORITY RESOLUTION NO.2017b�U� RESOLUTION RATIFYING THE CONTRACT TO BUY MILLER RANCH UNIT 69 MARBLE F129,EDWARDS, COLORADO; AUTHORIZING ANY COMMISSIONER TO SIGN CLOSING DOCUMENTS ASSOCIATED WITH ACQUISITION OF THE SAME; AND AUTHORIZING RESALE OF THE UNIT SUBJECT TO THE DEED RESTRICTION FOR MILLER RANCH WHEREAS,on October 7, 2013,Miller Ranch Unit 69 Marble F129,Edwards,Eagle County, Colorado (the"Unit")was acquired by third parties (the "Sellers") after foreclosure by the holder of a first deed of trust encumbering the Unit; and WHEREAS,on November 22, 2017,the Eagle County Housing and Development Authority(ECHDA)submitted an offer to purchase the Unit from the Sellers;and WHEREAS,on December 4,2017, the ECHDA signed a counteroffer submitted by the Sellers,subject to approval and ratification by the ECHDA Board at a regularly scheduled and public meeting(the"Contract"); and WHEREAS,a copy of the Contract is attached hereto and incorporated herein as Exhibit A; and WHEREAS,the ECHDA desires to ratify the Contract and to authorize any commissioner of the ECHDA to execute documents that may be required at closing to complete the acquisition of the Unit, subject to review and approval by the Eagle County Attorney's Office; and WHEREAS,upon acquisition of the Unit,ECHDA desires to reinstate the deed restriction and list the Unit for re-sale through The Valley Home Store;and NOW,THEREFORE,BE IT RESOLVED BY THE COMMISSIONERS OF THE EAGLE COUNTY HOUSING AND DEVELOPMENT AUTHORITY: THAT,the Contract is hereby approved and ratified. THAT,any commissioner of the ECHDA is hereby authorized to execute documents that may be required to close and complete the acquisition of the Unit, subject to review and approval of said documents by the Eagle County Attorney's Office. THAT,upon acquisition of the Unit, the Eagle County Housing Director is hereby authorized to sign the listing agreement on behalf of the ECHDA,subject to review and approval by the Eagle County Attorney's Office, in order to officially list the Unit for resale through the Valley Home Store. THAT,any commissioner of the ECHDA is hereby authorized to execute any documents associated with the resale of the Unit as a deed restricted unit under the Deed Restriction Agreement for the Occupancy and Resale of Miller Ranch Housing,subject to ratification of the same by the ECHDA at a regularly scheduled and public meeting. THAT this Resolution is necessary for the health, safety and welfare of the people of Eagle County, Colorado.
