HomeMy WebLinkAboutR17-082 VIS-6836 Taylor Hill Variance Commissioner e NVUUi--- moved adoption of the following Resolution: RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE,STATE OF COLORADO RESOLUTION NO. 2017 - h(j v FILE NO.VIS-6836 VARIANCE FROM IMPROVEMENT STANDARDS WHEREAS, IRA Services Trust Company CFBO Jason Provalenko owns two parcels numbered 2479-023-00-059 and 2479-023-00-060,Michael and Shannon Moller own parcel number 2479-023-00-015, and Brandon McGehee owns parcel number 2479-022-00-047 (each an "Applicant"and collectively the"Applicants") in the Taylor Hill Area("Taylor Hill")accessed by National Forest System Road 731 located on the east side of US Highway 24 at mile marker 164.3 in Eagle County,Colorado, as indicated by the records of the Eagle County Clerk and Recorder; and WHEREAS, The Eagle County Land Use Regulations ("LUR') require access serving developments of more than three residences to meet Eagle County Road Standards; and WHEREAS, there are a total of thirty-six (36) lots in the Taylor Hill neighborhood and structures have been constructed on approximately fifteen(15) of the thirty-six (36)lots; and WHEREAS,the Applicants desire to construct a residence on each of their respective lots; and WHEREAS, Applicants seek approval by the Eagle County Board of County Commissioners(the`Board")for variances from three LUR improvement standards relating to the safety of roads, specifically, those relating to Dual Access,Emergency Vehicle Turnaround Areas, and Road Improvement Standards,as detailed in their application(the"Application')and the Staff Report submitted to the Board; and WHEREAS,at a public hearing on the Application before the Board on October 3,2017,the Board heard the presentations from the Eagle County Engineering Department staff and the Applicants;examined the Engineering Staff Report;received comments from the public;and queried staff and the Applicants concerning the Application; and WHEREAS, at the conclusion of the hearing on October 3, 2017,it was moved, seconded and unanimously voted by the Board to approve the variances,concluding,after hearing and seeing the evidence presented in these proceedings concerning variances from the LUR improvement standards relating to the safety of roads, that the hardship to the Applicants from denial of the variances outweighed the adverse impact on the health,safety,and welfare of persons affected and the adverse impact on the land affected. The Board instructed staff to prepare a Resolution formally Eagle County, CO 201723194 Regina O'Brien 12/07/2017 Pgs: 7 11:37:24 AM REC: $0.00 DOC: $0.00 approving the Application,including the findings of the Board based on the above-described record evidence concerning hardship to the Applicants and the safety of the public,for consideration at a meeting of the Board. NOW,THEREFORE,THE BOARD OF COUNTY COMMISSIONERS FINDS,based on the above-described record evidence and applying the criteria for evaluating requests for variances from improvement standards set out in applicable LUR,that the hardship to the Applicants from denying the variances outweighs the adverse impact on the health, safety and welfare of persons affected and the adverse impact of the land affected if the variances are granted. NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of the County of Eagle, State of Colorado: THAT the above-described Application for variances from three LUR improvement standards relating to the safety of roads, specifically, those relating to Dual Access, Emergency Vehicle Turnaround Areas,and Road Improvement Standards be and hereby is approved as to each and every variance therein requested, with the following conditions: 1. Except as otherwise modified by this Variance, all material representations made by the Applicants in this application and in public meeting shall be adhered to and considered conditions of approval. 2. A CDOT access permit shall be successfully obtained for the road access onto US Highway 24 prior to issuance of any building permits. 3. The Applicants shall demonstrate lawful access to their property through the National Forest System Road prior to issuance of any building permits. 4. Wildfire mitigation strategies associated with new construction shall be implemented in accordance with the referral recommendations of the Eagle County Wildfire Mitigation Program Manager and Eagle County Building Resolution. This will be addressed during the building permit process. 5. Applicants shall install all-metal, reflective, address signage at the entrance of their respective driveways consisting of four inch(4")white lettering on a green background. The address signs shall be placed three feet(3') to five feet(5')above the ground. 6. The Applicants shall construct emergency vehicle turn-arounds on or near the subject properties that are satisfactory to the Engineering Department and Eagle River Fire Protection District.The turnarounds will be reviewed during the Building Permit process and shall be constructed prior to issuance of any Certificate of Occupancy.
