Home My WebLink AboutC97-110 Nova GuidesCCC‘97ii047RAFTINGAGREEMENTThisAgreementisbetweentheCountyofEagle(hereinafterknownas“theCounty”)andallindividualsorcompanieswhocommerciallyoperateand/orownforthepurposesofcommercialuserivetboatsandrafts(hereinafterknownas“theOperator”)andusetheFairgrounds,locatedintheCountyofEagle.WHEREAStheCountyownsandoperatestheFairgrounds;andWHEREAStheFairgroundsservesasapointforloadingand/ordisembarkmentforraftsandotherriverboats,commerciallyandprivatelyowned;andWHEREAStheCountymaintainstheparkingareas,bathrooms,picnickingfacilitiesandotherrecreationamenitiesattheFairgrounds;andWHEREASthepartiesofthisagreementagreetothescheduleofservices,fees,andresponsibilitiesimpartedtothepartiesassetforthbelow:ITISAGREEDTHAI:1.TheCountyshallallowOperatortodisembarkattheFairgroundsduringtheraftingseasonof1997(thepartiesagreethatthetermoftheseasoniswaterdependentandthatthetermofthisagreementshallbeforaslongasbothpartiesagree);2.TheCountyagreesthatitwillmaintainparkingareas,bathroomsandpicnicfacilitiesandtrashreceptaclesfortheuseandenjoymentoftheOperators;3.TheCountyagreesthatOperatormayusetheFairgroundsasapointtoloadand/ordisembarkthepassengersoftheirraftsandriverboats;4.TheOperatoragreesthatthelargervehicles(usuallydefinedasavehiclewhichhasthecapacitytocarrymorethan16peopleincludingvehiclesattachedtotrailers,trailersandbuses)maybeparkedintheFairgroundsparkinglotaswellassmallervehicles(usuallydefinedasavehiclewithacapacityof16orlesspersons)butallparkingissubjecttoavailabilityasdeterminedbytheCounty; C,)C5.TheOperatoragreesthatitanditspassengerswillkeeptheFairgroundsinacleanmanner,disposingoftrashinthereceptaclesprovided;6.TheOperatoragreesthatitunderstandsthattheFairgroundswillbeusedforavarietyoffunctionsseparateanddistinctfromtheOperator’suseandthatitsuseisnotexclusive;norshalltheOperatorinhibittheusageoftheFairgroundsbyothers;7.BothpartiesagreethattheCountymaycloseofftheuseoftheFairgroundstotheOperatorforspecificeventsiftheCountysodeemsnecessaryandthattheCountymustgivenoticeof14daysinadvanceofsaidclosingdatetotheOperator;TheCountywillclosetheFairgroundsonAugust2,andAugust3,1997.8.TheOperatorshallpayafeetotheCountyfortheuseoftheFairgrounds.EachOperatorshallpaytheCountyapaymentof$225.00onorbeforeMay22nd,1997(Thisdateofdepositisflexibleifagreeduponbybothparties.);9.TheOperatoragreesthatitwilltruthfullyandaccuratelysendayearendreporttotheCountyregardingthenumberofitspayingcustomersandacknowledgesthattheCountymayauditthereportingoftheOperatorattheendoftheseasonwiththeamountrecordedattheBureauofLandManagement.TheOperatorwillberesponsiblefortheyearendreporttotheCountyorlosetheprivilegeofusingtheFairgroundsandfaceanymonetarypenaltiesassociatedwiththeCountyResolutionNo.93-58;10.ThepartiesfurtheragreethattheOperatoranditscustomers,throughtheOperator,waiveanyliabilityonthepartoftheCountyforanyinjuriesthatmayoccurduringtherafttriporuseoftheFairgrounds.TheOperatoragreesthatitissolelyresponsibleforthewelfareofitscustomerstotheextentthatthosepartiesagreeandthatnoliabilityisimputedtotheCounty;11.TheOperatorshallobtaingeneralliabilityinsurancenamingEagleCountyasaddlitonalinsured,andshallbecarriedintheminimumamountof$150,000perinjuryand$600,000peroccurrenceforcoverageofclaimsfordamagesarisingfromLessee’suseoftheFairgrounds,includingbutnotlimitedtopersonalinjuryanddeath,propertydamage,andotherdamagesimposedbylawuponthepartieshereto.LesseeagreestoprovidetheCountywithaCertificateofInsuranceacceptabletotheCounty,namingEagleCountyas“AdditionalInsured”withinatimeframeagreedtobytheparties.2 C12.TheOperatoragreesthatlackofperformancewiththetermsofthisagreementshallresultinimmediateterminationofusageoftheFairgrounds.INWITNESSWHEREOF,signedthisdayofrr\‘1,1997COUNTYOFEAGLE,STATEOFATTEST:COLORADO,ByandThroughItsBOARDOFCOUNTYCOMMISSIONRSVBy______By_______ClerktotheBoardofeBradleyCountyCommissionersBuildingandGroundsManagerC,iJtziBy:BusinessnameTheOperatorSTATEOFCOLORADO)3 o(__)ss.COUNTYOFEAGLESubscribedandswornbeforemethisdayofA11997,byas_________________ofov&to(sHc.Withessmyhandandofficialseal.MyCommissionExpiresMycommissionexpires:_________________i.c)J0.NotaryPublic4
