Home My WebLink AboutC97-106 Fly Fishing Outfitters IncCCC’9710641FISHINGAGREEMENTThisAgreementisbetweentheCountyofEagle(hereinafterknownas“theCounty”)andallindividualsorcompanieswhocommerciallyoperateand/orownforthepurposesofcommercialfishingusingriverboatsandrafts(hereinafterknownas“theOperator”)anduseoftheFairgrounds,locatedintheCountyofEagle.WHEREAStheCountyownsandoperatestheFairgrounds;andWHEREAStheFairgroundsservesasapointforloadingand/ordisembarkmentforraftsandotherriverboats,commerciallyandprivatelyowned;andWHEREAStheCountymaintainstheparkingareas,bathrooms,picnickingfacilitiesandotherrecreationamenitiesattheFairgrounds;andWHEREASthepartiesofthisagreementagreetothescheduleofservices,fees,andresponsibilitiesimpartedtothepartiesassetforthbelow:ITISAGREEDTHAT:1.TheCountyshallallowOperatortodisembarkattheFairgroundsduringthefishingseasonof1997(thepartiesagreethatthetermoftheseasoniswaterdependentandthatthetermofthisagreementshallbeforaslongasbothpartiesagree);2.TheCountyagreesthatitwillmaintainparkingareas,bathroomsandpicnicfacilitiesandtrashreceptaclesfortheuseandenjoymentoftheOperators;3.TheCountyagreesthatOperatormayusetheFairgroundsasapointtoloadand/ordisembarkthepassengersoftheirraftsandriverboats;4.TheOperatoragreesthatthelargervehicles(usuallydefinedasavehiclewhichhasthecapacitytocarrymorethan16peopleincludingvehiclesattachedtotrailers,trailersandbuses)maybeparkedintheFairgroundsparkinglotaswellassmallervehicles(usuallydefinedasavehiclewithacapacity0116orlesspersons)butallparkingissubjecttoavailabilityasdeterminedbytheCounty; CC5.TheOperatoragreesthatitanditspassengerswillkeeptheFairgroundsinacleanmanner,disposingoftrashinthereceptaclesprovided;6.TheOperatoragreesthatitunderstandsthattheFairgroundswillbeusedforavarietyoffunctionsseparateanddistinctfromtheOperatorsuseandthatitsuseisnotexclusive;notshalltheOperatorinhibittheusageoftheFairgroundsbyothers;7.BothpartiesagreethattheCountymaycloseofftheuseoftheFairgroundstotheOperatorforspecificeventsiftheCountysodeemsnecessaryandthattheCountymustgivenoticeof14daysinadvanceofsaidclosingdatetotheOperator;TheCountywillclosetheFairgroundsonAugust2,andAugust3,1997.8.TheOperatorshallpayafeetotheCountyfortheuseoftheFairgrounds.EachOperatorshallpaytheCountyapaymentof$75.00onorbeforeMay22nd,1997(Thisdateofpaymentisflexibleifagreeduponbybothparties.)9.TheOperatoragreesthatitwilltruthfullyandaccuratelyreporttotheCountyayearendreportregardingthenumberofitspayingcustomersandacknowledgesthattheCountymayauditthereportingoftheOperatorattheendoftheseasonwiththeamountrecordedattheBureauofLandManagement.TheOperatorwillberesponsiblefortheyearendreporttotheCountyorlosetheprivilegeofusingtheFairgroundsandfaceanymonetarypenaltiesassociatedwiththeCountyResolutionNo.93-58;10.ThepartiesfurtheragreethattheOperatoranditscustomers,throughtheOperator,waiveanyliabilityonthepartoftheCountyforanyinjuriesthatmayoccurduringtherafttriporuseoftheFairgrounds.TheOperatoragreesthatitissolelyresponsibleforthewelfareofitscustomerstotheextentthatthosepartiesagreeandthatnoliabilityisimputedtotheCounty;11.TheOperatorshallobtaingeneralliabilityinsurancenamingEagleCountyasadditionalinsured,andshallbecarriedintheminimumamountof$150,000perinjuryand$600,000peroccurrenceforcoverageofclaimsfordamagesarisingfromLessee’suseoftheFairgrounds,includingbutnotlimitedtopersonalinjuryanddeath,propertydamage,andotherdamagesimposedbylawuponthepartieshereto.LesseeagreestoprovidetheCountywithaCertificateofInsuranceacceptabletotheCounty,namingEagleCountyas“AdditionalInsured”withinatimeframeagreedtobytheparties.2 C12.TheOperatoragreesthatlackofperformancewiththetermsofthisagreementshallnsuItinimmediateterminationofusageoftheFairgrounds.INWITNESSWHEREOF,signedthisdayof,1997.COUNTYOFEAGLE,STATEOFATTEST:COLORADO,ByandThroughItsBOARDOFCOUNTYCOMMISSIONERSBy:________________________ClerktotheBoardofCountyCommissioners_____________SBy:____________________Businessnam3 STATEOFCOLOADO))ss.COUNTYOFEAGLE)Subscribedandsworntobeforemethis.i.dayof___________,1-99byasWitnessmyhandandofficialseal.Mycommissionexpires:LJgrNotaryPublicC\eagle.fis93-if64
