HomeMy WebLinkAboutC97-098 Gypsum Airpark LLC dba Gypsum Commercial ParkCcD’979870DEEDOfAVIATIONAGREEMENTTHISINDENTURE,madebetweenGypsumAirpark,LLC.,aColoradoLimitedLiabilityCompany,d\b\aGypsumCommercialPark,(“Grantor”)andtheCountyofEagle,apoliticalsubdivisionoftheStateofColorado(the“County”),andtheTownofGypsum,apoliticalsubdivisionoftheStateofColorado,(the“Town”).GRANTORS,forandinconsiderationofTenDollars($10.00)andothergoodandvaluableconsideration,paidbytheCountyandtoGrantors,thereceiptandsufficiencyofwhichareherebyacknowledged,doherebygrantuntotheCounty,itssuccessors,andassigns,aperpetualandassignableAviationEasementinandovertherealpropertywhosedescriptionisattachedheretoasExhibit“A”andmadeaparthereof,andaright-of-wayforthefreeandunrestrictedpassageofaircraftofanyandallkindsnoworhereafterknown,in,through,across,andabouttheairspaceabovethesurfaceofsaidrealpropertyatalltimesoftheday.Theaforesaideasementandright-of-wayincludes,andislimitedto,thefollowing:1Fortheuseandbenefitofthepublic,theeasementandcontinuingrighttofly,orcauseorpermittheflight,byanyandallpersons,ofanyaircraftofanyandallkindsnoworhereafterknown,in,through,across,oraboutanyportionoftheairspacewhosedescriptionisattachedheretoandmadeaparthereof.TotheextenttheCountyhascontroloverflightpatterns,anychangetheretoshallrequiretheconsentoftheTown,whichconsentshallnotbeunreasonablywithheld.2Fortheuseandbenefitofthepublic,theeasementandcontinuingrighttocauseorcreate,orpermittoallowtobecausedorcreated,withinallairspaceabovetheexistingsurfaceofthesaidrealproperty,whetherornotwhiledirectlyoversaidland,suchnoise(includinganynoisegeneratedoutsidetheboundariesofsaidrealproperty)vibration,current,orothereffectsofair,illumination,andfuelconsumptionasmaybeinherentinormayariseoroccurfromtheoperationofaircraftofanyandallkinds,eithernowexistingortobedevelopedinthefuture,fornavigationof,orflightinair,orfromlandingatortakingofffromsaidairport,includinggroundrun-upsandtestingofaircraftengines.Therightscreatedbythiseasementdonotincludetherighttocauseaircraftorpartsofaircraft,debrisorotherphysicalobjects,similarordissimilar,tobeputorcastontotheservientestate.3Therighttoreasonablyregulateorprohibitthereleaseintotheairofanysubstancewhichwouldmateriallyimpairthevisibilityoforotherwiseinterferewiththeoperationsofaircraftsuchas,butnotlimitedto,steam,dust,orsmoke.4Therighttoreasonablyregulateorprohibitlightemissions,eitherdirectorindirect(reflective)whichwouldmateriallyinterferewithpilotvision.
