HomeMy WebLinkAboutC97-095 Eagle River Water and Sanitation DistrictC:?9%OCClPETITIONFOREXCLUSIONOfLANDINTHEMATTEROfEAGLERIVERWATERANDSANITATIONDISTRICTTOTHEBOARDOfDIRECTORSOfTHEDISTRICT:TheundersignedPetitioner,beingafeeownerofaportionoftherealpropertyhereinafterdescribed(“Property”),andcommonlyknownastheEagleCountyAirportproperty,herebyrequeststhatsuchPropertybeexcludedfromtheEagleRiverWaterandSanitationDistrict,asprovidedbylaw,andforcause,statesthat:1.AssenttotheexclusionofsuchPropertyfromtheDistrictisherebygivenbytheundersigned,whoisafeeownerofaportionofsuchProperty.2.PetitionerunderstandsthatthereshallbenowithdrawalfromthisPetitionafterpublicationofnoticebytheBoard,withouttheconsentoftheBoard.3.TheexclusionofsuchPropertyfromtheDistrictshallbesubjecttoanystatutoryconditionofexclusion,aswellasalltermsandconditionsestablishedbytheBoardandacceptedbyPetitioner.4.ThePropertysoughttobeexcludedfromtheDistrictisaccuratelydescribedasfollows:SeeExhibitAattachedheretoandincorporatedhereinbythisreference.5.ThePropertywasoriginallyincludedintoDistrictforthepurposeofassistingEagleCounty,Colorado,inobtainingareliablewatersourcetotheProperty,andsubjecttothetermsandconditionsofanInclusionAgreementdatedAugust28,1990.PursuanttotheInclusionAgreement,ifanadjacentTowniscapableofprovidingthenecessarywaterservicetotheProperty,thePropertyshallbeexcluded..fromtheboundariesoftheDistrictandDistrictshallceaseprovidingthewaterservicetotheProperty.TheTownofGypsum,Colorado,hasacquiredfromDistrictthewaterservicefacilitiesprovidingthewaterservicetotheProperty.6.ItisinthebestinterestsofthePropertyseekingexclusionthatthePropertybeexcludedfromtheDistrict.7.ItisinthebestinterestsoftheDistrictthatthePropertybeexcludedfromtheDistrict. C.C8.ItisinthebestinterestsofthecountywithinwhichtheDistrictislocatedthatthePropertybeexcludedfromtheDistrict.9.Therelativecosts.andbenefitstothePropertyseekingexclusionjustifytheexclusion.10.DistrictwillstillbeabletoprovideeconomicalandsufficientservicetoallofthepropertieswithintheDistrict’sboundariesfollowingexclusionoftheProperty.11.Districtisabletoprovideservicesatareasonablecost,buttheTownofGypsumcanprovidesimilarservicesatareasonablecost.12.NeithergrantingnordenyingthePetitionwillhaveanyeffectonemploymentandothereconomicconditionsintheDistrictandsurroundingarea.13.NeithergrantingnordenyingthePetitionwillnothaveanyeconomicimpactontheregion,theDistrict,thesurroundingarea,orthestateasawhole.14.ThereiseconomicallyfeasiblealternativeserviceavailablefromtheTownofGypsum.15.TheadditionalcosttobeleviedonotherpropertywithintheDistrictifexclusionisgrantedwillbenegligible.WHEREFORE,PetitionerrequeststhattheBoardofDirectorsoftheDistrict:A.SetapublicmeetingforhearingonthisPetitionandpublishnoticethereofinaccordancewithSection32-1-501(2),C.R.S.B.OrderthisPetitionbegrantedinaccordancewithSection32-1-501(4)(a)(D,C.R.S.COUNTYOFEAGLE,STATEOFCOLORADO,byandthroughitsBOARDOFCOUNTYCOMMISSIONERSN1eç/2,,TitleC
