CCD.ItisAgreed:ThattheCountyisactivelyengagedinanoxiousweedmanagementprograminEagleCountyandisdesirousofcooperatingwiththeBureauofLandManagementinthecontrolofnoxiousweedsonadjacentBureauofLandManagement-controlledlands.ThattheCountycanmoreadvantageouslyandefficientlyusepersonnelandweedcontrolequipmentbyincorporatinginitsprogramthetreatmentofBureauofLandManagement-controlledlands.Thatthepartieshaveagreedthatnoxiousweedsofpriorityconcern,includebutarenotstrictlylimitedtothefollowingspecies:a.CanadaThistled.RussianKnapweedg.Houndstongueb.MuskThistlee.LeafySpurgeh.PlumelessThistlec.BullThistlef.Burdocki.SpottedKnapweedThatonorbeforeApril1ofeachyear,thedesignatedrepresentativesofthepartieswillmeetforthepurposeofpreparinganoperatingplanforareastobetreatedduringtheensuingseason;theplanwilladdressfunding,timing,methodofapplication,areastobetreated,andpayments.E.ResponsibilitiesoftheBureauofLandManagement;GrandJunctionDistrict1.ELMwillreimbursetheCountyforthepurchaseandapplicationofherbicidenottoexceedtheamountspecifiedintheoperatingplan.2ELMisresponsibleforassistinginobtainingaccesstooracrossBLM-administeredlandstotreatproperties(intheimmediatecooperativeeffort)thatareinfestedwithnoxiousweeds.3.ELMwillassistinmappingcurrentinfestationsandadvisingtheCountyofanynewinfestationsofnoxiousweedsonELM-administeredlands.4.ELMwillassistincarryingouttheCountyweedmanagementprogramasitappliestoBLM-administeredlandsincooperationwiththeCounty.5.ELMandtheCountyagreetojointlyidentifyandprioritizenoxiousweedprojectsareasandapplyforfundingofapprovedprojects.6.ELMisresponsibleforacquiringELMapprovalofallherbicidesthatwillbeusedonELM-administeredlandsbytheCounty.7.ELMwillmanagethepubliclandsinamannerthatwouldreduceoreliminatethecauseofnoxiousweedinfestations.F.ResponsibilitiesofEagleCounty1.CountyisresponsibleforcarryingoutthetermsoftheColoradoWeedManagementActinaccordancewiththeEagleCountyWeedManagementPlan..2.CountywillassistinmappinginfestationswhenpossibleandwilladvisetheELMrepresentativeofanynewinfestationsonELM-administeredlandswithinEagleCounty.3.CountywillcooperatewithBLMtojointlyidentifyandprioritizenoxiousweedprojectareas.4.CountywilldothefollowingonELMadministeredlands:a.ProvideandapplyherbicideusingELMapprovedmethods.
CCb.ApplyherbicidesaccordingtolabelinstructionsandELMguidelines,andfurnishELMacopyofthelabel.c.Herbicideapplicationequipmentwillbeproperlycalibrated.d.ApplicatormustbeacertifiedpesticideapplicatorwiththeColoradoDepartmentofAgricultureandmusthaveacurrentColoradoPesticideApplicator’slicenseintheappropriatecategoryorbeunderthedirectsupervisionofsuchanindividual.e.Safetyequipmentwillbeutilizedasappropriate.f.Herbicideapplicationequipmentshallbecleanedonlyinspecific,designatedareas.Emptyherbicidecontainerswillbedisposedofinamannerconsistentwiththelabelandaccordingtofederal,stateandcountylaws.g.Applicationsofherbicideusingvehiclesequippedwithboomsprayersshallnotoccurwithin25feetofanywater.Spottreatmentswithvehiclemountedhandgunsorwithbackpackswillnotbeappliedwithin10feetofwater.Herbicidesmaybewipedonindividualplantsuptothecurrentwaterline.Noherbicideapplicationshallbedonewhenwindsexceed8MPH.Whenapplyinginriparianareasornearwater,windshallnotexceed5MPH.h.TheCountyisresponsiblefornotifyingBLMinatimelymannerofproposeduseofherbicidesonELM-administeredlandssothatdocumentsneededforapprovalcanbecompletedbeforeherbicideapplicationcommences.Notificationneedstoincludetimeframesandlocationofsprayingandtheherbicidetobeused.5.Inclementweathershutdown:TheGovernmentreservestherighttodirectthecontractortosuspendworkonthisprojectiftheCORdeterminesthatwind,rain,orotherweatherconditionswillprohibiteffectiveapplicationofherbicidesorifthegrowthstageofthenoxiousweedwillprohibiteffectiveuseofthechemical.6.TheCountyisresponsibleforbillingtheELMforELM-approvednoxiousweedcontrolprojectsperformedonELM-administeredlandsbasedonthisagreement.Thisbillingshallshowthetype,amountofherbicidesused,rateofapplication,areaandacrestreated,datesoftreatmentandamountoflaborcharges.7.TheCountyshallsubmitstatementsofcostincurredtotheContractingOfficerandacopytotheCOR.Thisstatementshallidentifytheareaandnumberofacrestreated,andcostsarenottoexceedatotalidentifiedintheannualoperatingplanandbudget.8.TheCountyshallkeepsuchpurchaseorders,receipts,invoices,andotherrecordstodocumentcostincurredundertheagreement.9.TheCountyisresponsibleforadheringtoanyspecialstipulationsdefinedandagreedtointhestatementofwork.
CC,G.Administration1.TheBureauofLandManagement’sobligationshereunderarecontingentupontheavailabilityofappropriatedfunds.NolegalliabilityonthepartoftheBureaushallariseunlessanduntilfundsareappropriatedbyCongressforthepurposeofthisagreement.TheCORdoesnothavetheauthoritytonotifyorauthorizechangeLithetermsorscopeofthisAgreement;however,theBLMmaygivedirectionswithinthescopeofthisAgreementifspecifiedintheplanofwork.2.TheCounty’sobligationshereunderarecontingentupontheavailabilityofappropriatedfunds.NolegalliabilityonthepartoftheCountyshallariseunlessanduntilfundsareappropriatedbyTheBoardofCountyCommissionersforthepurposeofthisagreement.3.PaymentwillbemadeuponsubmissionofinvoicesfromtheCounty.InvoicesshallbemailedtotheContractingOfficer,withacopytotheCOR.Theamounttobepaidwillbebasedonthetotalallowablecostsincurred.4.TheBureauofLandManagementwillnotbeliableforanydamagestopersons,animals,orstructuresasresultofactionsbytheCounty.5.NomemberofordelegatetoCongressnorresidentcommissionershallbeadmittedtoanyshareorpartofthisagreementortoanybenefitsthatmayarisethereofunlessitbemadewithacorporationforitsgeneralbenefit.6.TheprovisionsofOfficeofManagementandBudget(0MB)CircularQ-l02,‘UniformAdministrativeRequirementsforGrants-and-AidtoStateandLocalGovernmentsand0MBCircularA-87,“CostPrinciplesforStateandLocalGovernments”areincorporatedintothisagreementbyreference.Thisagreementshallbecomeeffectiveuponthesigningbyallpartiesandshallremainineffectuntilotherwiseterminat.edwith,orwithout,causebyeitherpartygiving30days’writtennotice,nottoexceedfiveyears.Anymodificationsaresubjecttoagreementandsignaturebyallparties.EAGLECOBUREAUOFLANDMANAGEMENTBy:____________By:>t%hairman,EagleCountyAreaManagerCommissionersDate:_________________Date:____________By:___________________CoiltractingOfficerDate:
