Home My WebLink AboutC97-084 Colorado Department of Public Safety•GW84O4AGREEMENTTHISAGREEMENT,madethis15thdayofMarch1997,byandbetweentheStateofColoradofortheuseandbenefitoftheDepartmentofPublicSafety,ColoradoStatePatrolhereinafterreferredtoastheState,andtheEagleCounty911AuthorityBoardhereinafterreferredtoastheAuthorityBoard,WHEREAS,authorityexistsintheLawandFundshavebeenbudgeted,appropriatedandotherwisemadeavailableandasufficientuncommittedbalancethereofremainsavailableforencumberingandsubsequentpaymentofthiscontractunderEncumbrancesNumber______inFundNumber100,AppropriationAccount150andOrganizationSP4C.WHEREAS,requireapproval,clearanceandcoordinationhasbeenaccomplishedfromandwithappropriateagencies;andWHEREAS,itisthedesireofthepartiesthattheStateprovidethlltimeradiodispatchingservicestomoreefficientlydischargethedutiesofthelawenforcementagenciesoftheAuthorityBoardandtheState;andWHEREAS,theStatecannotprovidesuchserviceswiththepresentstaffingoftheColoradoStatePatrol;andWHEREAS,theAuthorityBoardiswillingtoreimbursetheaverageexpensesofone(1)additionalCommunicationOfficerinordertoreceivethedesireddispatchingservices;WHEREAS,allexpensesoftheadditionalCommunicationOfficershallbepaidbytheChiefoftheCSPinthesamemannerasotheremployeesofsaidCSParepaid;andNOWTHEREFORE,itisherebyagreedthat1.TheStatePatrolshallmakereasonableadministrativeeffortstomaintaintheequivalentof(1)communicationofficerconsistentwithexistingresourcesoftheEagleCommunicationCenter.PersonnelincreasedthroughthiscontractshallbeemployeesoftheStatePatrolforallpurposesincluding,butnotlimitedto,selection,assignment,certificationbeyondprobationaryperiod,methodsandproceduresofoperation,compensation,administrationofholidays,vacation,sickleave,andothertypesofleave,grievances,andcorrectiveordisciplinaryactionssubjecttochangebytheChiefoftheStatePatrol.TheyshallbeunderthegeneraladministrativecontrolanddirectsupervisionofthePatrolAdministratorfortheCommunicationCenterorhis/herdesignee.2.TheStateshallbilltheAuthorityBoardsemi-annuallyforone-haffoftheannualagreementamount.Suchbillingshallbepaidwithinseven(7)daysofreceiptbycheckorvoucherpayabletoCSP.TheStatewillincludetheadvancebillingforthemonthofJuneinthesecondsemi-annualbilling.Thefollowinginformationwillshowthecontractamountanditscomponents:ForthefiscalyearJuly1,1996toJune30,1997theaveragestatewidecostforaStatePatrolPoliceCommunicationsTechnician,includingallsalaries,shiftdifferential,PERA,Medicare,insuranceandotherbenefits,andindirectcostsare$36,843.Forpurposesofthisagreementtheamountforthisfiscalyear,JanuarythroughJune30,1997willbe$18,421. BeginningJuly1,19S..theannualizedcostwillbeaccessedwitnadjustmentsbasedonchangesinthestatewideaveragecostsforallPoliceCommunicationsTechniciansplusadjustmentsintheindirectcostrate.3.ThehiringofanyadditionaldispatchpersonnelwirichisnecessitatedcompletelyorinpartbytheadditionalworkloadgeneratedbytheAuthorityBoardtrafficshallbesubjectofaseparateorsupplementalagreement.4.ThetermofthisagreementshallbeforfiscalyearsbeginningJuly1,andcontinuingthroughJune30,unlessearlierterminatedasprovidedherein.TheagreementmaybeterminatedbytheAuthorityBoardortheState,subjecttothirty(30)dayswrittennotice.5.TheCommunicationOfficersprovidedshallkeepwrittenandtapedrecordsofalltransmissionsmadeatorfromthecentralconsoleorfromanystationormobileunitoperatingonthefrequenciesoftheradiosystem.6.ThefinancialobligationoftheStateofColorado,theAuthorityBoard,payableafterthecurrentfiscalyeariscontingentuponfundsforthatpurposebeingappropriated,budgetedandotherwisemadeavailable,andislimitedtotheamountoffunds,ifany,appropriated,budgetedorotherwisemadeavailableforthepurposesofthisagreement.AgreedtoonFor:EagleCounty911AuthorityBoardAgreedtoon3/17/g7date-‘zChiefLonnieJ.WestphalFor:ColoradoStatePatrolC:\WPWIN6O\WPDOCS\DISPAGR.EMT(11-96)
