HomeMy WebLinkAboutC97-082 Eagle County Department of Social Services£9Z$225EAGLECountyMPLR1ContractNumbeDepartmentofSocialServicesDIVISIONOCjSUPPORTENrORcMENTCHILDSUPPORTENFORCEMENTCOOPERATIVEREIMBURSEMENTAGREEMEN]Thisagreementisexecutedasof1/1/97byandbetweentheEagleCountyAttorney’sOfficebyheBoardofCountyCoiggionrs(hereinafter“Contractor”)andtheEagleCountyDepartmentofSocialServices(hereinafter“Department”);ThisAgreementshallbeineffectfrom1/1/97through12I31/97andshallnotexceedtwelve(12)months.TheDepartment,underPartDofTitleIVoftheSocialSecurityAct,45CFR92,232,301through307,and26-13-101,et.seq.,C.R.S.,hasbeendelegatedresponsibilityforthedevelopmentandimplementationofaprogramtosecuresupportandestablishpaternityforanyperson(s)eligibleforIV-DserviceswithinthemeaningofFederalregulations,andTheDepartmentdesirestoenterintoanagreementwiththeContractorto:1)assisttheDepartmentinprovidingtheservicesnecessarytoestablishpaternity,establishsupportobligations,andsecuresupportforanyperson(s)eligibleforIV-DserviceswiththemeaningofFederalregulations,and2)assistinotherchildsupportenforcementmattersofcommonconcerntotheDepartmentandtheContractor,andtheContractordesirestoenterintosuchanagreementwiththeDepartment;TheDepartmentandtheContractorthereforeagreeasfollows:1.ScopeofServicesServicesshallbeprovidedbytheContractortoanyperson(s)eligibleforIV-DservicesincompliancewithExhibitI“ScopeofServices”,acopyofwhichisattachedandincorporatedbyreference.2.PersonnelTheContractorshallidentifyinExhibitII“ComputationofPersonnelCostsforServices”allpersonnelbytitlewhoprovideservicespursuanttothisAgreement.AcopyofExhibitIIisattachedandincorporatedbyreference.TheadditionordeletionofpersonnellistedinExhibitIIofthisAgreementmustbeaccomplishedbyamemorandumwithanupdatedExhibitIIsubmittedbytheContractor,withinten(10)daysofanychangesofpositions,totheDepartmentandsubjecttoapprovaloftheExecutiveDirector,ColoradoDepartmentofHumanServices,ordesignee.ThenewExhibitIImustcomplywiththerequirementsofthisparagraph-two(2).CSE-1(REVIsED11i5) CSE-AGREEMENTFORSERVICESPAGE3.Paymenta.PaymentshallbemadeonthebasisofExhibitIll,“AgreementBudget”,acopyofwhichisattachedandincorporatedbyreference.TheAgreementBudgetshallestablishthemaximumreimbursementwhichwillbepaidfromcombinedcounty,andFederalfundsduringthedurationofthisagreement.b.TheContractorshallsubmitanitemizedmonthlybillingtotheDepartmentforallcostsincurredpursuanttoExhibitIofthisAgreementinaccordancewiththerulesandregulationsoftheColoradoDepartmentofHumanServices.BillingsshallbesubmittedonForm5310.211,StatementofMonthlyAmountsDueforChildSupportEnforcementandPaternityDetermination.TheContractorshallsubmitallitemizedmonthlybillingsandForm5310.211totheDepartmentpriortothesixth(6)dayofthemonthfollowingthemonththecostwasincurred.Billings,includingtheForm5310.211,mustbesignedbytheContractor.FailuretosubmitmonthlybillingsandForm5310.211inaccordancewiththetermsofthisagreementshallresultintheContractor’sforfeitureofallrightstobereimbursedforsuchexpenses.c.PaymentstotheContractorshallbemademonthlybytheDepartmentuponreceiptofsuchitemizedbillingsasfollows:1)PersonalServices-Actualcosts(wagesorsalariesandemployeebenefits)determinedbymultiplyingthenumberofhoursworkedbytheAttorneyandhis/heremployeestoprovideservicesunderthisAgreementbytheiractualhourlyratesincludingemployeebenefits.Forstaffprovidingfull-timeservicesundertheAgreementcurrentjobdescriptionsoftheirresponsibilitiesshallsubstantiatebillings.Forstaffprovidingpart-timeservicesundertheAgreement,timesheetsdocumentingalltimeusedworkingonlV-Dcasesshallsubstantiatebillings.2)OperatingExpenses-Operatingexpensesincludesupplies,materials,equipment,printing,reproduction,rent,normaltelephonecharges,utilities,repairsandmaintenance.ChargesforoperatingexpensesshallbesubstantiatedbyanallocationmethoddistributingcostsequitablytoallunitsoftheDistrict,CountyorCityAttorney’soffice.3)Non-legalServices-CostsaredeterminedbymultiplyingtherateshowninExhibitIIbytheestimatednumberofhoursorestimatednumberofservicestobeprovided.Costsaresubstantiatedbypertinentrecordsofservicescompleted.4)Travel-ReimbursementfortheContractorandstafftimespentintravelingshallbenegotiatedbetweentheContractorandtheDepartment.Costsshallbesubstantiatedbyrecords(suchasbills,tickets,etc.)indicatingthedates,purposes,destinations,andcostsofsuchtravel.5)Training-ReimbursementforContractorandstaffforcostofandtimespentintrainingshallbenegotiatedbetweentheContractorandtheDepartment.Costsshallbesubstantiatedbyrecordsindicatingthedates,trainingsubjects,andcostsofsuchtraining.IntheeventsuchtrainingismademandatorybytheDepartment,suchchargesshallbereimbursed.6)Specificactualexpenses-OthercostsrelatedtoprovidingservicesundertheAgreementmayincludelongdistancetelephonecalls,bloodtests,polygraphtests,expertwitnessfees,transcripts,andservicespurchasedfromsubcontractors.Costsshallbesubstantiatedbyrecordsindicatingthereasonsandthedatesofthecharges. CSE-AGREEMENTFORSERVICESPAGEd.ReimbursementofcostsincurredpursuanttothisAgreementisexpresslycontingentupontheavailabilityoffederalfundstotheColoradoDepartmentofHumanServicesandtheDepartment.e.TheDepartmentshallnotbebilledfor,andreimbursementshallnotbemadefor,timeinvolvedinactivitiesoutsideofthosedefinedinExhibitI.4.TerminationforConvenienceatforCauseThisAgreementmaybeterminatedwithorwithoutcausebyeitherpartyuponwrittennoticeofatleastthirty(30)dayscitingreason(s)fortermination.Uponsuchtermination,theContractorshallfurnishtotheDepartment,aspropertyoftheDepartment,allproperty,recordsandpertinentinformationwhichtheDepartmentprovidedunderthisagreement.Uponreceiptofsaiditems,theDepartmentshallpaytheContractorforactualcostsincurredthroughthedatethisAgreementisterminatedinaccordancewithsection3“Payment”ofthisAgreement.5.AmendmentThisAgreementmaybeamendedbymutualconsent,providedthattheamendmentiswrittenonFormCSE-4,properlyexecutedandmadeapartofthisAgreement.AllamendmentsareexpresslymadesubjecttotheapprovaloftheExecutiveDirector,ColoradoDepartmentofHumanServices,ordesignee;however,theStateofColorado,theColoradoDepartmentofHumanServicesandtheExecutiveDirector,ordesignee,arenotpartytothisAgreement.6.Reports.Records.andRetentionPeriodsTheContractorshallmaintainsuchrecordsasaredeemednecessarypursuanttotheColoradoDepartmentofHumanServices’rulestoassureaproperaccountingforallcostsandfundscollected.TheserecordsshallbemadeavailableforauditpurposetotheU.S.DepartmentofHealthandHumanServices,theStateDepartment,ortheCountyDepartment,andshallberetainedforthree(3)yearsaftertheexpirationofthisagreementorafteranauditiscompletedunlesspermissiontodestroythemisgrantedbytheColoradoDepartmentofHumanServices.TheContractorshallsubmitfinancial,programprogressandotherreportsasrequestedbytheDepartmentortheColoradoDepartmentofHumanServices.7.EquipmentPurchasedwithFederal,StateandCountyMoneyTitletoallequipmentacquiredbytheContractorunderthisagreementatacostof$500ormoreforwhichtheContractorisreimbursedbytheDepartmentshallvestintheDepartment.Uponterminationofthisagreement,theDepartmentmayrequitetheContractortodelivertotheDepartmentanysuchequipmentacquiredfortheperformanceofthisagreement.8.ConfidentialityInformationprovidedbytheDepartmentforpurposesofthisAgreementshallbeusedonlyforthepurposeintendedandinaccordancewithfederalandstatelawsandregulations. 0‘CSE-AGREEMENTFORSERVICESPAGE9.PoliticalActivitiesNoneofthefunds,materials,property,personnelorservicescontributedbytheUnitedStates,theStateofColorado,theColoradoDepartmentofHumanServicesortheDepartmentunderthisagreementshallbeusedforanypartisanpoliticalactivity,ortofurthertheelectionordefeatofanycandidateforpublicofficeinamannerwhichwouldconstituteaviolationoffive(5)U.S.C.Sections1501et.seq.10.SafeguardingInformationTheContractorshallprovideforthesecurityofinformationcollectedpursuanttothisAgreementandasprovidedintherulesandregulationsoftheColoradoDepartmentofHumanServices.11.CompliancewithApplicableLawsTheContractorshallatalltimesduringtheexecutionofthisAgreementstrictlyadheretoallapplicablefederalandstatelawsandimplementingregulationsastheycurrentlyexistandmayhereafterbeamended.Thisincludesprotectionoftheconfidentialityofallrecipient/applicantrecords,papers,documents,tapesandanyothermaterialsthathavebeenormayhereafterbeestablishedwhichrelatetothisagreement.TheContractoracknowledgesthatthelawsincludeTitleIV(Title45CodeofFederalRegulations),andTitleVIIoftheCivilRightsActof1964,Section504oftheRehabilitationActof1973,theAgeDiscriminationActof1975,theAgeDiscriminationinEmploymentActof1967,theEqualPayActof1963andtheEducationAmendmentsof1972,andallregulationsapplicabletotheselawsprohibitingdiscriminationbecauseofrace,color,nationalorigin,handicap,age,sexandreligion.12.StudiesandInvestigationsAllofficialreportsofcases,recoveries,investigations,studies,etc.,madeasaresultofthisagreementshallacknowledgethesupportprovidedbytheDepartmentofHealthandHumanServicesandtheColoradoDepartmentofHumanServices.13.SubcontractsNosubcontractshallbemadebytheContractorwithanyotherpartyforfurnishinganyservicescontractedforwithoutthepriorw!ttenconsentandapprovaloftheDepartment.Forservicesprovidedunderanysubcontract,theContractorshallberesponsibleforcontractperformanceandcomtiancewiththetermsandconditionsofthisagreement.TheContractorshallselectsubcontractorsonacompetitivebasistothemaximumpracticalextentconsistentwiththeobjectivesandrequirementsofthisagreement.14.PerformanceStandardsTheDepartmentandContractorshalldefinestandardsofperformancethatwillallowforanaccurateevaluationoftheservicesbeingprovidedbytheContractor.Thestandardsshallbeclearanddefiniteandbebothqualitativeandquantitativeincontent.Thestandardsshallprovideareliablerealisticmeansforestablishingsatisfactorylevelsofperformanceandforrecognizingperformancewhichiabovetheexpectedlevelforreward/incentivepurposesorforinitiatingcorrectiveactionifperformancEhasfallenbelowthestandard.PerformanceStandardsshallbeprovidedpursuanttoExhibitl\‘PerformanceStandards”.Acopyofwhichisattachedandincorporatedbyreference. C)CSE-AGREEMENTFORSERVICESPAGE15.ResponsibilityforConductofIndividualsTheContractorissolelyresponsiblefortheconductofindividualsemployedbyandunderthedirectsupervisionorcontroloftheContractor,asidentifiedinExhibitIl,ComputationofPersonnelCostsforServices”.GovernmentalfunctionsprovidedinsupportofthechildsupportenforcementprogrambyindividualsotherthanthoseidentifiedinExhibitIIarenottheresponsibilityoftheContractorexceptforacceptanceorrejectionoftheworkproductofsuchindividuals.16.SpecialAttorneyTheContractorortheDepartmentmaydeterminethattheContractorhasaconflictofinterestwhichwillpreventtheContractorfromfulfillingorcompletingallthetermsofthisagreement.Uponsuchadetermination,theDepartmentisauthorizedtohirea“special”attorneytofulfillandcompletesuchduties.ThespecialattorneyshallbegivenandactunderthesamepowersastheContractorhiredunderthisagreement.ThespecialattorneyshallreceivepaymentforservicesfromtheContractorunderthetermsofthisagreementwiththerequirementthattheDepartmentreimbursetheContractorfortheexpense.17.AttorneyAppearanceTotheextentreasonableandpracticable,andconsistentwithapplicablestateregulations,theContractoragreestoappearinproceedingsbeforethecourtsofhiscountyonbehalfofotherCountyDepartmentswhenauthorizedbytheDepartment.
