RESOLUTION NO.2017- v 1k
RESOLUTION CONCERNING ADVERTISEMENTS ON EAGLE COUNTY MASS
TRANSPORTATION VEHICLES AND PROPERTY
WHEREAS,Eagle County is a financially sound,high performing organization focused
on protecting the natural environment,promoting a resilient economy and making Eagle County
(the"County") a great place to live for all while supporting local businesses; and
WHEREAS,the County regularly places advertisements on County property including
mass transit vehicles; and
WHEREAS,in 2012,the County issued a reque g�als and received competitive
proposals from multiple contractors to sell advertising space tu�thCounty's mass transit
vehicles; and k...
WHEREAS,on September 18th2012,the Count - to an agreement with Street
Media Group LLC, an advertising agency which specializes in corporate sponsorships and local
advertising campaigns to sell advertising space on the County's mass transit vehicles; and
WHEREAS,the agreement with Street Media Group LLC was renewed in 2016; and
WHEREAS,the County benefits from the revenue generated by such advertising
activities; and
WHEREAS, the County wants to ensure that advertisements on the County's mass
transportation vehicles and property are consistent with and appropriate for the County's strategic
priorities to advance the health, safety, and welfare of the public while maximizing revenue and
public benefits and minimizing negative influences and impressions on the County's population;
and
WHEREAS, the County desires to adopt a policy pertaining to advertisements on the
County's mass transportation vehicles and property; and
WHEREAS,the Eagle County Regional Transit Authority Advisory Board, also known
as the ECO Advisory Board, an advisory group whose mission is to provide recommendations to
the Board of County Commissioners(the"Board")regarding the provision of safe,reliable,
efficient and convenient regional transportation, made a recommendation on May 17th 2017,to
approve a draft advertising policy(hereinafter the"Advertising Policy"), attached hereto as
Exhibit A.
NOW,THEREFORE,BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT,the Advertising Policy attached hereto as Exhibit A is hereby adopted and
approved as the County' s policy regarding advertising on mass transportation vehicles and
property.
THAT,the Board hereby finds, determines and declares that this Resolution is necessary
for the public health, safety and welfare of the residents of the County of Eagle, State of
Colorado.
MOVED,READ AND ADOPTED by the Board of CountyCommissioners of the
County of Eagle, State of Colorado, at its regular meeting held the ' day of November,
2017.

EAGLE COUNTY
POLICY FOR ADVERTISEMENTS ON EAGLE COUNTY MASS TRANSIT VEHICLES AND PROPERTY
This policy shall be effective upon adoption by the Board of Eagle County Commissioners,and it shall be
incorporated as an exhibit into all contracts for advertising on Eagle County mass transportation vehicles and
property. Advertising contractors must comply with the standards set forth in this policy,as they may be amended
from time to time and Eagle County shall display only those advertisements that comply with this policy.
• All pilot programs or experimental advertisements must be approved in writing by Eagle County
in advance of the display of any such advertisements.
• All advertising contractors shall be responsible for the daily administration of Eagle County's
advertising in a manner consistent with this policy and with the terms and conditions of their
agreements with Eagle County.
• Eagle County, in its reasonable discretion, may amend,waive, modify or revoke the application
of any or all of these standards as it deems necessary or to facilitate its primary mass
transportation function,or to fulfill its strategic plan,goals and objectives.
• Eagle County, in its sole discretion,shall approve all advertising content, copy,design, and colors
to be displayed in/on Eagle County's buses or transportation facilities. Further, Eagle County, in
its sole discretion, may reject or prohibit the installation of or compel the removal of any
advertising material that it may deem offensive,controversial, immoral or inappropriate for the
community including the following:
o Advertisements that Eagle County deems to be illegal.
o Advertisements that Eagle County deems to be related to alcohol,tobacco or firearms.
o Advertisements that Eagle County deems to be adult only,obscene or pornographic in
nature, content or format.
o Advertisements that Eagle County deems to be defamatory or in support of imminent
lawlessness or violent action.
o Advertisements that Eagle County deems to concern a political candidate, ballot
measure or initiative petition.
o Advertisements that Eagle County deems to be in infringement on any copyright,trade
or service mark,title or slogan.
o Advertisements that Eagle County deems to be misaligned with Eagle County's image,
mission,vison,values,strategic plans or goals.
o Advertisements that Eagle County deems to be detrimental or unsupportive of local
businesses or economic development.
o Advertisements that partially or fully obscure logos, numbering or other designative
markings necessary to transit operations.
o Advertisements that Eagle County deems to be false, misleading or deceptive.
