HomeMy WebLinkAboutR17-061 Boulders Subdivision File No. SUS-6809 and SUP-6808 Eagle County, co 201717504 Regina O'Brien 09/12/2017 Pgs: 5 12:14:09 PM REC: $0.00 DOC: $0.00 Commissioner l'' OV -01-`'' moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 2017- 4� t RESOLUTION A?PROVING A COMBINED SKETCH AND PRELIMINARY PLAN FOR SUBDIVISION FOR THE BOULDERS SUBDIVISION FILE NO.SUS-6809 AND SUP-6808 WHEREAS, on or about May 25, 2017, the County of Eagle, State of Colorado, accepted for filing an application submitted by 3010 Basingdale LLC (hereinafter the "Applicant") requesting approval of a combined Sketch and Preliminary Plan for Subdivision for the Boulders Subdivision for the creation of six(6) legal lots on certain real property located in the Residential Suburban Medium Density Zone District in the unincorporated area of Eagle County more particularly described as follows: Lot 14A, Lot 14B and Lot 14C, Boulders Subdivision, according to the plat recorded September 1, 2015 at Reception No. 201516569,County of Eagle, State of Colorado(the "Property");and WHEREAS, the six (6) legal lots to be created by this subdivision process are designated as follows: Lot 14A-E: .242 acres; Lot 14-A-W: .236 acres; Lot 14B-E: .233 acres; Lot 14B-W: .235 acres; Lot 14C-E: .199 acres; and Lot 14C-W: .395 acres; and WHEREAS, notice of the combined Sketch and Preliminary Plan for Subdivision was given to all proper agencies and departments as required by Section 5-210.E, ECLURs-Notice ofPublic Hearings; and WHEREAS, public notice was posted in a newspaper of general circulation and said notice was sent to all adjacent property owners as required by the Section 5-210.E, -Notice of Public Hearings, ECLURs;and WHEREAS, at its regular meeting held on August 2, 2017 the Eagle County Planning Commission (the "Planning Commission") considered the proposed combined Sketch and Preliminary Plan for Subdivision; associated plans; the statements and concerns of the Applicant; the Eagle County Community Development Staff;the Eagle County Engineering Staff; and other interested persons and, based on its findings, voted to recommend approval of the proposed combined Sketch and Preliminary Plan for Subdivision; and WHEREAS, at its regular meeting held on August 22, 2017, the Board of County Commissioners (hereinafter "the Board") considered the proposed combined Sketch and Preliminary Plan for Subdivision; associated plans; the statements and concerns of the Applicant, the Eagle County Community Development staff, and other interested persons; and the recommendation of the Planning Commission, and voted unanimously to approve the combined Sketch and Preliminary Plan for Subdivision with the conditions listed herein; and WHEREAS,based on the evidence, testimony, exhibits, and study of the Comprehensive Plan for the unincorporated areas of Eagle County, as well as comments of the Eagle County Community Development Department, comments of public officials and agencies, and comments from all interested parties, the Board finds as follows: 1. That proper publication and public notice was provided as required by law for the hearings before the Board. 2. That pursuant to ECLURs Section 5-280.B.3.e - Standards for the review of a combined Sketch and Preliminary Plan, all standards required for the Combined Sketch and Preliminary Plan have been met as follows: (1) Conformance with Comprehensive Plan. The proposed subdivision is in substantial conformance with the purposes, intents, goals, and policies of the Eagle County Comprehensive Plan, Area Community Plans, and any applicable ancillary County adopted documents pertaining to natural resource protection, affordable housing, or infrastructure management. (2) Consistent with Land Use Regulations. The proposed subdivision does comply with all of the provisions of these Land Use Regulations, including, but not limited to, the applicable standards of Article 3, Zone Districts, and Article 4, Site Development Standards. (3) Spatial Pattern Shall Be Efficient. The proposed subdivision is located and designed to avoid creating spatial patterns that cause inefficiencies in the delivery of public services, or require duplication or premature extension of public facilities, or result in a "leapfrog" pattern of development. (a) Utility and Road Extensions. Proposed utility extensions are consistent with the utility's service plan. 2 (b) Serve Ultimate Population. Utility lines are sized to serve the planned ultimate population of the service area to avoid future land disruption to upgrade undersized lines. (c) Coordinate Utility Extensions. As conditioned utility extensions have been allowed and the entire range of necessary facilities will be provided. (4) Suitability for Development. The property is suitable for development, considering its topography, environmental resources and natural or man-made hazards that may affect the potential development of the property, and existing and probable future public improvements to the area. (5) Compatible with Surrounding Uses. The proposed subdivision is generally compatible with the existing and currently permissible future uses of adjacent land, and other substantially impacted land, services, or infrastructure improvements. (6) Adequate Facilities. The applicant has demonstrated that the development proposed in the combined Sketch and Preliminary Plan will be provided adequate facilities for potable water supply, sewage disposal, solid waste disposal, electrical supply, fire protection and roads and will be conveniently located in relation to schools, police and fire protection, and emergency medical services. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of the County of Eagle, State of Colorado: THAT the application for combined Sketch and Preliminary Plan for Subdivision for the Boulders Subdivision located in the unincorporated area of Eagle County for the Property described herein, is hereby approved, subject to the following conditions: 1. Except as otherwise modified by this development permit, all material representations made by the Applicant in this application and in public meeting shall be adhered to and considered conditions of approval. 3 2. Prior to scheduling a plumbing inspection for each of the six(6)building permits for each lot in the subdivision, the Owner/Developer shall have an approved, established connection to the Eagle River Water and Sanitation Department system. 3. The Owner/Developer shall comply with the following wildfire standards in conjunction with construction on any lot in the subdivision: a. Require Class-A roof assemblies on all structures; b. Provide 3 feet of non-combustible landscaping (ie. rock, gravel or stone) surrounding all homes; c. No coniferous trees or shrubs (ie. spruce, pine, juniper, etc.) may be planted within 30 feet of structures (particularly between homes for screening) —rather rather incorporate native, low-growing plant and shrub species, and promote aspen growth when possible; d. Maintain emergency access to subdivision and neighboring homes by minimizing vegetation planted near/adjacent to ROW; e. Adhere to additional requirements related to the use of ignition resistant construction for(per Eagle Building Resolution): i. Ignition resistant deck construction ii. Non-combustible siding and soffit construction (eg. stone, stucco, heavy timbers,cement fiber board, etc.) iii. Exterior venting and other openings (protected with non-combustible coverings and minimum 1/4 screening); and f Create/maintain defensible space surrounding all homes within Boulder's Subdivision by removing vegetation with high combustion potential. THAT, the Board directs the Community Development Department to provide a copy of this Resolution to the Applicant.
