Fisher Eagle County Clerk & Recorder 0.00 QUITCLAIM DEED THIS QUITCLAIM DEED, made this 14il day of MWLK , 1996, between The Board of County Commissioners of Eag County, Colorado, Grantor, and Knapp Agricultural Management Company, LLC, a Colorado limited liability company, whose legal address is 10100 Santa Monica Boulevard, Los Angeles, California 90067, Grantee. WHEREAS, Grantee is owner of certain real property located in Eagle County, Colorado described as: Parcel 4 as shown on the Parcel Map filed on July 20, 1995 in the official records of the Eagle County Recorder's office in Book No. 671 at Page 601 as Reception No. 567619 ("Property"); and WHEREAS, pursuant to the Amended Plat of Tenderwild recorded on July 6, 1971 in the office of the Clerk and Recorder of Eagle County, Colorado at Book No. 220, Page No. 949 at Reception No. 116618 (the "Amended Plat of Tenderwild") that certain roadway known as Holy Cross Drive was created on the Property and dedicated as a public roadway (the "Roadway"); and WHEREAS, on April 3, 1972, the Amended Plat of Tenderwild was vacated by Resolution of the Board of County Commissioners of Eagle County; however, the Resolution did not vacate the Roadway which remained as a public roadway; and WHEREAS, the actual and planned location of certain parts of the Roadway differs from the dedicated location specified for such Roadway in the Amended Plat of Tenderwild; and WHEREAS, Grantor and Grantee desire to modify and correct the legal description of the publicly dedicated Roadway to correspond with the actual and planned location of such Roadway, and to facilitate this Grantor desires to quitclaim to Grantee all of Grantor's right, title and interest in and to the Roadway, in consideration of the reconveyance and public dedication of such Roadway to the Board of County Commissioners of Eagle County in a Corrective Deed to be made concurrently herewith, by which the legal description of the Roadway shall be modified and corrected. NOW THEREFORE, Grantor, for and in consideration of the sum of TEN and N0/100 Dollars ($10.00) the receipt and sufficiency of which is hereby acknowledged, and other consideration as recited herein, has released, remised, sold and quitclaimed and by these presents does release, remise, sell, and quitclaim, unto Grantee, its heirs, successors and assigns forever, all right, title, interest, claim and demand DOC C r^- F-+ G'i which the Grantor has in and to the real property, together with all improvements, if any, situate, lying and being in the County of Eagle, State of Colorado, which presently constitute the Roadway as described in the Amended Plat of Tenderwild; TO HAVE AND TO HOLD the same, together with all and singular the appurtenances and privileges thereunto belonging or in anywise thereunto appertaining, and all the estate, right, title, interest and claim whatsoever of the Grantor, either in law or equity, to the only proper use and benefit of the Grantee, its heirs, successors and assigns forever.
