SPECIAL WARRANTY DEED

THIS DEED made this j,�''—qday of 1996, by and
between The Board of County Commissioners, ounty of Eagle, State
of Colorado referred to as the "Grantor", and the Eagle Valley
Library District, a Colorado special district, by and through its
Board of Trustees referred to as the "Grantee".
W I T N E S S E T H:
That the Grantor, for and in consideration of good and valuable
consideration, the receipt and sufficiency of which is hereby
acknowledged, has granted, bargained, sold, conveyed and by these
presentsdoes grant, bargain, sell, convey and confirm unto the
Grantee, its successors and assigns, forever, all the real
property, together with improvements, if any, lying and being in
the County of Eagle, State of Colorado described as follows:
Parcel A, Sixth Street Annex in the Town of Eagle, State
of Colorado, According to the Plat recorded August 29,
1983 in Book 367 at Page 26, County of Eagle, State of
Colorado.
UNDER AND SUBJECT to, all agreements, covenants, liens,
easements, reservations, exceptions, restrictions and other
encumbrances of record, to the extent still valid, subsisting, and
enforceable; and
THAT if the described property granted by this instrument
shall not be used for its intended purposes and the Grantee does
not construct a new library facility upon the described property by
December 31, 1997, then all the right, title, and interest in and
to the described property and to the improvements on such property,
shall revert to and revest in grantor or grantor's successors or
assigns, as fully and completely as if this instrument had not been
executed.
TOGETHER with all and singular the hereditament and appurte-
nances thereunto belonging or in anywise thereunto appertaining,
and the reversion and reversions, remainder and remainders, rents,
issues, and profits thereof, and all the estate, right, title,
interest, claim and demand whatsoever of the grantor, either in law
or equity, of, in and to the above bargained premises, with the
hereditament and appurtenances;
TO HAVE AND TO HOLD, the said premises above bargained and
described with the appurtenances unto the grantee, its heirs and
assigns forever. The grantor, for itself, its heirs and personal
representatives or successors, does covenant and agree it shall and
will WARRANT AND DEFEND the above -bargained premises in the quiet
and peaceable possession of the grantee, its heirs and assigns,
against all and every person or persons claiming the whole or any
part thereof, by, through or under the grantor under and subject as
aforesaid.
IN WITNESS WHEREOF, the Grantor has executed this deed on the
date set forth above.
