THIS CORRECTIVE DEED, made this rt day of
1996, between Knapp Agricultural Management Company, LLC, a
Q Colorado limited liability company, Grantor, and The Board of
County Commissioners of Eagle County, Colorado whose legal
address is 500 Broadway, Eagle, Colorado 81631, Grantee.
WHEREAS, Grantor is owner of certain real property
located in Eagle County, Colorado described as: Parcel 4 as
shown on the Parcel Map filed on July 20, 1995 in the official
records of the Eagle County Recorder's office in Book No. 671
at Page 601 as Reception No. 567619 ("Property"); and
r, WHEREAS, pursuant to the Amended Plat of Tenderwild
recorded on July 6, 1971 in the office of the Clerk and
0-0 Recorder of Eagle County, Colorado at Book No. 220, Page No.
0 949 at Reception No. 116618 (the "Amended Plat of Tenderwild")
U a roadway named Holy Cross Drive was created on the Property
and dedicated as a public roadway (the "Roadway"); and
WHEREAS, on April 3, 1972, the Amended Plat of
Tenderwild was vacated by Resolution of the Board of County
Commissioners of Eagle County; however, the Resolution did not
vacate the Roadway which remained as a public roadway; and

WHEREAS, the actual and planned location of certain
o parts of the Roadway differs from the dedicated location of
U such Roadway in the Amended Plat of Tenderwild; and

C) ---i WHEREAS, Grantor and Grantee desire to modify and
0 correct the legal description of the publicly dedicated
� �4 Roadway to correspond with the actual and planned location of

such Roadway; and

WHEREAS, pursuant to a Quitclaim Deed of even date
herewith made by the Grantor therein (which is the same party
as the Grantee herein) such Grantor quitclaimed to the Grantee
�.� therein (which is the same party as the Grantor herein), all
of the right, title and interest of the Grantor under the
Quitclaim Deed in and to the Roadway as described in the
Amended Plat of Tenderwild, in consideration for the
reconveyance and public dedication of such Roadway to the
Grantee herein by this Deed, which modifies and corrects the
legal description of such Roadway.
NOW THEREFORE, Grantor, for and in consideration of
the sum of TEN and N0/100 Dollars ($10.00) the receipt and
sufficiency of which is hereby acknowledged, and other
consideration as recited herein, has granted, bargained, sold
and conveyed and by these presents does grant, bargain, sell,
convey and confirm, unto Grantee, its heirs, successors and
assigns forever, all the real property, together with all
improvements situate, lying and being in the County of Eagle,
State of Colorado, which actually constitutes the Roadway and
which is described in Exhibit A attached hereto and
incorporated herein;
TOGETHER with all and singular the hereditaments and
appurtenances thereto belonging, or in anywise appertaining,
and the reversion and reversions, remainder and remainders,
rents, issues and profits thereof, and all the estate, right,
title, interest, claim and demand whatsoever of the Grantor,
either in law or equity, of, in and to the above -bargained
premises, with the hereditaments and appurtenances, but
subject to all exceptions and encumbrances of record as of the
date hereof.
TO HAVE AND TO HOLD the said premises above
bargained and described with the appurtenances, unto Grantee,
its heirs, successors and assigns forever.
IN WITNESS WHEREOF, Grantor has executed this
Corrective Deed on the date set forth above.
