This Project Agreement (agreement) is hereby made and entered into by and between Eagle
County, State of Colorado, hereinafter referred to as "the County or Cooperator," and the USDA,
Forest Service, White River National Forest, hereinafter referred to as the "U.S. Forest Service,"
as specified under the authority and provisions of the Cooperative Forest Road Agreement # 17-
RO-11421500-444 executed between the parties on July 18, 2017.
Project Title: NFR 400.2 — EAGLE-THOMASVILLE ROAD RECONSTRUCTION (MP
6.80 — MP 20.80)
I. BACKGROUND:
The parties entered into a Forest Road Cooperative Agreement (Coop Agreement) on July 18,
2417. This Coop Agreement allows for the parties to cooperate in the planning, survey, design,
construction, reconstruction, improvement and maintenance of certain forest roads. The
Schedule A, which is attached to the Coop Agreement, identifies the maintenance responsibilities
of the parties to the specific road systems and may be revised as necessary. The process of
revising the Schedule A can be labor intensive and time consuming due to requiring extensive
valuations and several levels of formal review. Accordingly, formal revision of the Schedule A
does not readily lend itself to rapid response times, adjusting to limited funding opportunities and
a high degree of site condition specificity.
The Coop Agreement allows for specific Project Agreements between the parties with the intent
of completing work as expeditiously as available funds or work opportunities allow.
The Coop Agreement identifies numerous requirements for the development of Project
Agreements. These requirements include but are not limited to:
• The specific project (road) must be included in an approved U.S. Forest Service —
Cooperator plan (Schedule A).
• Mutual approval.
• The cost to be borne by each party.
• The amount of cooperative funds as set forth in the Project Agreement shall be the
maximum commitment of either party unless changed by a formal modification prior to
incurring any expense.
• Work must be completed in accordance with agreed upon standards.

II. PURPOSE:
The purpose of this Project Agreement (agreement) is to document the parties' cooperation in the
NFR 400.2 — EAGLE-THOMASVILLE ROAD RECONSTRUCTION (MP 6.80 — MP 20.80.
The work is as described in the hereby incorporated Annual Operating Plan (Exhibit A), Project
Details and Specifications (Exhibit B), (Project Location Map; Exhibit C), and (Financial Plan;
Exhibit D), as attached.
III. THE COOPERATOR SHALL:
A. Perform in accordance with the Annual Operating Plan (Exhibit A), Project Details and
Specifications (Exhibit B), (Project Location Map; Exhibit C), and (Financial Plan;
Exhibit D), as attached
IV. THE U.S. FOREST SERVICE SHALL:
A. Perform in accordance with the Annual Operating Plan (Exhibit A), Project Details and
Specifications (Exhibit B), (Project Location Map; Exhibit C), and (Financial Plan; Exhibit
D), as attached
V. IT IS MUTUALLY AGREED AND UNDERSTOOD BY AND BETWEEN THE

B. In the event of a conflict between this Project Agreement and the Coop Agreement, the
later shall take precedence.
C. FREEDOM OF INFORMATION ACT (FOIA). Information furnished to the U.S. Forest
Service under this agreement is subject to the Freedom of Information Act (5 USC 552).
D. TEXT MESSAGING WHILE DRIVING. In accordance with Executive Order (EO)
13513, "Federal Leadership on Reducing Text Messaging While Driving," any and all text
messaging by Federal employees is banned: a) while driving a Government owned vehicle
(GOV) or driving a privately owned vehicle (POV) while on official Government business;
or b) using any electronic equipment supplied by the Government when driving any vehicle
at any time. All cooperators, their employees, volunteers, and contractors are encouraged to
adopt and enforce policies that ban text messaging when driving company owned, leased or
rented vehicles, POVs or GOVs when driving while on official Government business or
when performing any work for or on behalf of the Government.
E. FUNDING EQUIPMENT. Federal funding under this agreement is not available for
reimbursement of Cooperator's purchase of equipment.
F. PARTICIPATION IN SMLAR ACTIVITIES. This agreement in no way restricts the
U.S. Forest Service or Cooperator from participating in similar activities with other public
or private agencies, organizations, and individuals.
G. ENDORSEMENT. Any of Cooperator's contributions made under this agreement do not
by direct reference or implication convey U.S. Forest Service endorsement of Cooperator's
products or activities.
H. ALTERNATE DISPUTE RESOLUTION. In the event of any issue of controversy under
this agreement, the parties may pursue Alternate Dispute Resolution procedures to
voluntarily resolve those issues. These procedures may include, but are not limited to,
conciliation, facilitation, mediation, and fact finding_

I. MODIFICATION. Modifications within the scope of this agreement must be made by
mutual consent of the parties, by the issuance of a written modification signed and dated by
all properly authorized, signatory officials, prior to any changes being performed. Requests
for modification should be made, in writing, at least 30 days prior to implementation of the
requested change. The U.S. Forest Service is not obligated to fund any changes not
properly approved in advance.
J. TERMINATION. Either party, in writing, may terminate this agreement in whole, or in
part, at any time before the date of expiration. Neither party shall incur any new
obligations for the terminated portion of this agreement after the effective date and shall
cancel as many obligations as possible. Full credit shall be allowed for each party's
expenses and all non -cancelable obligations properly incurred up to the effective date of
termination.
K. COMMENCEMENTIEXPIRATION DATE. This agreement is executed as of the date of
last signature and is effective through October 1, 2018 at which time it will expire unless
extended.
L. AUTHORIZED REPRESENTATIVES. By signature below, the parties certify that the
individuals listed in this document as representatives of each party are authorized to act in
their respective areas for matters related to this agreement.
This agreement shall be effective as of the date herein written and shall supersede all prior
existing agreements, if any, for the same roads.

I. GENERAL PROJECT DESCRIPTION:
The U.S. Forest Service and Eagle County have determined that there is a need to reconstruct
various sections of road between MP 6.80 and MP 20.80 on NFR 400.2, EAGLE-THOMASVILLE
ROAD (E -T road).
Reconstruction may include, but is not limited to the following activities:
• Between MP 6.80 — MP 12.00, provide water tender/ roadway watering services during Forest
Service road reconditioning activities, this includes coordinating with Forest Service road
construction and maintenance crew during operations. It is anticipated that 2 trips per day (2
loads) will be needed.
• Between MP 14.90 and 20.80, provide Ditch reconditioning, shoulder reconditioning, roadbed
reconditioning, aggregate base and surfacing placement and compaction, removing and
disposing of existing culverts up to 48 -inches in diameter, installing culverts up to 48 -inches in
diameter, cattleguard removal and disposal, gate removal and disposal, gate installation, cleaning
culvert inlets and outlets, cleaning lead -out ditches, installing drivable dips, and roadside
vegetation management (brushing).
• Eagle County Road and Bridge Representative(s), Miles Barkhurst, and Bret Conant will conduct
a pre -work site visit prior to commencement of the project.
• See Exhibit B for detailed work specifications, locations, descriptions, quantities, and estimated
costs.
II. PROJECT LOCATION
See Exhibit C for Project Location Map.
III. PROJECT SPECIFICS
A. THE U.S. FOREST SERVICE SHALL:
• Mark the work locations on the ground prior to commencement of project work.
• Provide on-site inspections at the discretion of the project manager and perform a final
inspection.
• Provide a technical and administrative contact for the project (see Contact Info below III. D.).
B. THE COOPERATOR (EAGLE COUNTY) SHALL:
• Agree to perform all agreed upon work between MP 6.80 to MP 20.80 on NFR 400.2.
• Provide all necessary labor and equipment to perform the work outlined in Exhibit B.
• Provide a load tickets to the project manager for tracking quantity of aggregate hauled from
commercial source(s).
• Be responsible for providing and implementing all necessary erosion control materials and safety
precautions, including traffic control.
• Be responsible for ensuring all personnel on site follow all applicable Federal, State and local
safety, fire and environmental regulations.
• Notify U.S. Forest Service project manager upon completion of field work. Following this,
Cooperator (or a representative) shall be available to participate in a final inspection by US FS
White River engineering staff. Cooperator is responsible for complying with deficiencies noted in
final inspection.
• Perform work in a manner to preserve and protect roads and appurtenances, constructed
features, and prevent erosion damage to roads, streams, and other Forest resources.
• Re -vegetate all disturbed ground with a seed mix furnished by White River National Forest.

This work consists of controlling and protecting public traffic adjacent to and within the project. Perform
work in a manner that ensures the safety and convenience of the public and protects improvements and
facilities adjacent to the site. Accommodate public traffic on roads adjacent to and within the project until
the project is accepted by the U.S. Forest Service.
A. Maintaining roadways during work.
a. Maintain a dust -free traveled way such that visibility and air quality are not affected. This work
shall be considered incidental to the project.
b. Maintain the roadways in a safe and acceptable condition, during work and during periods when
work is not in progress.
B. Limitations on Construction Operations:
a. Operate equipment in the direction of Traffic, where applicable.
b. Any staging areas shall be as designated by the U.S. Forest Service Roads Manager.
C. Accommodating Traffic During Work.
a. Traffic control plan shall conform to the current edition of the Manual on Uniform Traffic Control
Devises (MUTCD).
b. Closures up to 2 hours are allowed.
c. Coordination with the White River NF Project Manager will be required.
D. Temporary Traffic Control.
This work consists of furnishing, maintaining, relocating and moving temporary traffic control devices
for the control and protection of traffic through the project.
a. All traffic control devices shall conform to the current edition of the MUTCD.
b. All devices and signs shall be type III, VII, or VIII retroreflective sheeting.
c. Flaggers, if required, shall be certified by American Traffic Safety Services Association (ATTSA),
National Safety Council (NSC), a state agency, or other acceptable organization. Use type III, VII
or VIII retroreflective sheeting on flagger panels. Do not use flags.
E. Traffic and Safety Supervisor.
Provide a traffic and safety supervisor who is certified by a state highway agency or other acceptable
certification program. Furnish the supervisor's name, address, 24-hour telephone number prior to the
start of the work. At all times, during the project, including periods of suspension and shutdown,
perform all of the following:
a. Implement traffic control plan.
b. Ensure the condition and placement of traffic control devices in use.
c. Immediately correct deficiencies.

For work on National Forest System lands, use a washing system that traps all wash water and either
stores it for removal from National Forest System lands or recycles the water for continued use. If the
equipment recycles the water, provide adequate filters for seed removal. Dispose of the filter material
and removed seeds in an approved manner. Do not mix soaps, detergents, or other chemicals with the
wash water.
Washing. Wash the sides, tips, and undercarriages of all construction equipment. Remove all seeds,
plant, plant fragments, dirt, and debris from the construction equipment.
Inspection. Inspect the washed construction equipment, including the undercarriage, to ensure that the
washing removed the dirt, debris, and seeds from the construction equipment. Rewash the construction
equipment as necessary or as directed.
Provide wee -free certification for all organic erosion control products and materials utilized in the course
of work. These products mat include, straw bales, waddles, etc.

Replace any pipe that is distorted by more than 5 percent of nominal dimensions, or that
is ruptured or broken.
Do not place or backfill pipe that meets any of the following conditions until the
excavation and foundation have been approved in writing by the CO:
• Embankment height greater than 5 feet at subgrade centerline.
• Installation in a protected streamcourse.
• Round pipe with a diameter of 48 inches or greater.
• Pipe arches with a span of 50 inches or greater.
• Any box culvert of structure other than pipe culverts.
(b) Pipe culverts.
(1) Pipe culverts with compacted backfill.

Excavate an area on each side of the pipe as needed to effectively achieve
compaction requirements. Backfill without damaging or displacing the pipe.

Compact backfill using designated compaction method A, B, or C:
Method A. Ensure that backfill density exceeds the density of the surrounding embankment.
Method B. Adjust the moisture content of the backfill material to a moisture content suitable
for compaction. Compact each layer using appropriate compaction equipment until visual
displacement ceases. For compaction under sections 252, 254, 255, 257, 258 and 252
compact with a vibratory steel wheeled roller with a mass of at least 8 tons.

Method C. Determine optimum moisture content and maximum density according to
AASHTD T 99 method C. Adjust the moisture content of the backfill material to a moisture
content suitable for compaction. Compact material placed in all layers to at least 95 percent
of the maximum density. Determine the in place density and moisture content according to
AAS HTO T 310 or other approved test procedures.

303.01 This work consists of reconditioning ditches, shoulders, roadbeds, parking areas,
turnouts, approach road intersections, cattleguards, asphalt surfaces and aggregate surfaces.
Construct outslopes, clean and maintain all roadbed drainage structures when shown on the
plans.

303.02 Conform to the following Subsection:

Construction Requirements
303.03 Ditch Reconditioning. Remove all slide material, sediment, vegetation, and other
debris from the existing ditches and culvert inlets and outlets. Reshape ditches and culvert inlets
and outlets to achieve positive drainage and a uniform ditch width, depth, and grade. Dispose of
waste as shown on the plans.
303.04 Shoulder Reconditioning. Repair soft and unstable areas according to Subsection
204.07. Remove all slide material, vegetation, and other debris from existing shoulders
including shoulders of parking areas, turnouts, and other widened areas. Dispose of waste as
shown on the plans.
303.05 Roadbed Reconditioning Repair soft and unstable areas according to Subsection
204.07. Remove all organic, deleterious material larger than 6 inches from the top 6 inches of
subgrade. Dispose of waste as shown on the plans. Scarify, rip and shape the traveled way and

shoulders at locations and to the depth and width designated on the plans. Remove surface
irregularities and shape to provide a uniform surface.
Dispose of rock larger than 4 inches brought to the surface during scarification in areas
designated on the plans.

For portions of roads not requiring scarification, the roadbed may contain rocks larger than 4
inches provided they do not extend above the finished roadbed surface. Reduce in place or
remove rock extending above the finished roadbed surface. Dispose of removed rock in areas
designated on the plans.
Compact using the following method as specified:
(a) Compaction A. Operate equipment over the full width.
(b) Compaction B. Operate rollers over the full width of each layer until visual
displacement ceases, but not fewer than three complete passes. Use rollers that meet the
following requirements:
(1) Steel wheeled rollers, other than vibratory, capable of exerting a force of not less than
250 pounds per inch of width of the compression roll or rolls.
(2) Vibratory steel wheeled rollers equipped with amplitude and frequency controls with
a minimum weight of 6 tons, specifically designed to compact the material on which it is
used.
(3) Pneumatic -tired rollers with smooth tread tires of equal size that will provide a
uniform compacting pressure for the full width of the roller and capable of exerting a

surface or to a depth of 8 inches, whichever is less, and remove surface irregularities. Reshape,
finish, and compact the entire aggregate surface according to Section 308.
303.07 Roadway Reconditioning. Perform all the applicable work described in Subsections
303.03 through 303.06.
Maintain the existing cross slope or crown unless otherwise shown on the plans. Establish a
blading pattern that will retain the surfacing on the roadbed and provide a through mixing of the
materials within the completed surface width.
Blade and shape the subgrade for both surfaced and unsurfaced roads when moisture content is
suitable for compaction.
303.08 Pulverizing. Scarify the surface to the designated depth and width. Pulverize all
material to a size one and one half times the maximum sized aggregate or to 11/z inches,
whichever is greater. Mix, spread, compact, and finish the material according to Section 341.
303.09 Acceptance. See Table 303-1 for sampling and testing requirements. Road
reconditioning work will be evaluated under Subsections 106.02 and 146.44.
Measurement
303.10 Measure the Section 303 items listed in the Schedule of Items according to Subsection
109.02 and the following as applicable.
Measure ditch reconditioning and shoulder reconditioning by the mile, by the station or foot
horizontally along the centerline of the roadway for each side of the roadway.
Measure roadbed reconditioning, aggregate surface reconditioning, roadway reconditioning, and
pulverizing by the mile, by the station, or by the square yard.

322.01 This work consists of constructing one or more courses of aggregate on a prepared
surface. Work includes producing aggregate by grid rolling, screening, or crushing methods, or
placing pit -run or Government -furnished aggregate.

Construction Requirements
322.03 General. Prepare the surface on which the aggregate course is placed according to Section
204 or 343 as applicable.
Request approval of the roadbed in writing before placing aggregate.
Develop, haul, and apply water in accordance to Section 170.
No quality requirements or gradation other than maximum size will be required for pit run and
grid -rolled material. For grid rolling, use all suitable material that can be reduced to maximum
size.
After processing on the road, remove all oversize material from the road and dispose of it as
directed by the CO.
If the aggregate is produced and stockpiled before placement, handle and stockpiled according to
Section 320. Establish stockpile sites at approved locations.
322.04 Mixing and Spreading. Mix the aggregate and adjust the moisture content to obtain a
uniform mixture with a moisture content suitable for the specified compaction method. Spread and
shape the mixture on the prepared surface in a uniform layer with no segregation of size, and to a
loose depth that will provide the required compacted thickness.

Do not place in layers exceeding 6 inches in compacted thickness for aggregate base and surface
courses or twice the maximum particle size for screened aggregate. When more than one layer is
necessary, compact each layer according to Subsection 322.05 before placing the next layer. Route
hauling and leveling equipment uniformly over the full width.
When placing aggregate over geotextile, place aggregate in a single lift to the full depth specified.
322.05 Compacting. Compact each layer full width. Roll from the sides to the center, parallel to
the centerline of the road. Along curbs, headers, walls, and all places not accessible to the roller,
compact the material with approved tampers or compactors.
Compact the aggregate using one of the following methods as specified:
Compaction A. Operating spreading and hauling equipment over the full width of the
travelway.
For all compaction methods, blade the surface of each layer during the compaction operations to
remove irregularities and produce a smooth, even surface.
322.06 Construction Tolerance. If grade finishing stakes are required, finish the surface to
within ±0.10 feet from staked line and grade elevation.
If grade finishing stakes are not required, shape the surface to the required template and check the
surface with a 10 -foot straightedge. Defective areas are surface deviations in excess of 112 inch in
10 feet between any two contacts of the straightedge with the surface.
Correct all defective areas by loosening the material, adding or removing material, reshaping, and
compacting.
Ensure that the compacted thickness is not consistently above or below the specified thickness.
The maximum variation from the compacted specified thickness is 1/2 inch.
Ensure that the compacted width is not consistently above the specified width. The maximum
variation from the specified width will not exceed +12 inches at any point.
322.07 Maintenance. Maintain the aggregate course to the correct line, grade, and cross-section
by blading, watering, rolling, or any combination thereof until placement of the next course.
Correct all defects according to Subsection 322.06.
